COOKEVILLE PLANNING COMMISSION MINUTES JUNE 25, 2007 The Cookeville Planning Commission met on Monday, June 25, 2007 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Judy Jennings, Dr. Roy Loutzenheiser, Nina Lunn, Jim Stafne, Chris Wakefield, and Tod Williams. MEMBERS ABSENT: Don Prince, Dr. Angelo Volpe and Ryan Williams. (Note: Ryan Williams arrived late to the meeting and did not vote on any of the issues.) STAFF MEMBERS PRESENT: James Mills, Jayne Barns, and Suzanne Garnmeister. OTHERS PRESENT: Aaron Bernhardt, Jerry Gaw, & Bob Faulhaber. CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Tod Williams made the motion to approve the agenda as submitted. Judy Jennings seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR APPROVAL THE MINUTES OF MAY 21, 2007. Judy Jennings made the motion to approve the minutes of May 21, 2007. Dr. Roy Loutzenheiser seconded the motion and the motion carried unanimously. APPROVED. ` CONSIDER FOR ACTION RENAMING TOLBERT DRIVE IN WILDWOOD SUBDIVISION TO WILDWOOD PASS. REQUEST SUBMITTED BY STAFF. (MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES THE APPROVAL OF THE PLANNING COMMISSION.) Tod Williams made the motion to move this item from study to action. Nina Lunn seconded the motion and the motion carried unanimously. APPROVED MOVING FROM STUDY TO ACTION. James Mills stated that under Title 16, Chapter 2 of the Cookeville Municipal Code specifies that the Planning Commission is responsible for the naming or renaming of city streets. Due to annexation there are now two streets located within the City of Cookeville named Tolbert Drive. One is located in the Wildwood Subdivision annexed in 2002 and the other is located in the Rebecca Place Subdivision annexed in 2007. The Cookeville Fire Department and Putnam County Emergency Services have requested that one of these streets be renamed. No properties are currently addressed off the Tolbert Drive located in the Wildwood Subdivision while numerous properties are addressed off the Tolbert Drive in the Rebecca Place Subdivision. For this reason it is proposed that the Tolbert Drive in the Wildwood Subdivision be considered for renaming. It is recommended that the street be renamed to Wildwood Pass. The proposed name of Wildwood Pass has been approved by Putnam County Emergency Services. The owners of the four parcels in the Wildwood Subdivision with frontage on the Tolbert Drive proposed for renaming have been notified as specified by Title 16. COOKEVILLE PLANNING COMMISSION 2 JUNE 25, 2007 Staff recommended approval of renaming Tolbert Drive in the Wildwood Subdivision to Wildwood Pass. Chris Wakefield made the motion to approve renaming Tolbert Drive in the Wildwood Subdivision to Wildwood Pass. Nina Lunn seconded the motion and the motion carried unanimously. APPROVED RENAMING TO WILDWOOD PASS. CONSIDER FOR ACTION FINAL PLAT OF ST. JAMES PLACE, 11 LOTS LOCATED OFF SOUTH WALNUT AVENUE. REQUEST SUBMITTED BY JERRY GAW. James Mills stated Mr. Jerry Gaw has submitted for approval a Final Plat of St. James Place, an 11-lot, 34-unit condominium/townhouse subdivision development located off South Walnut Avenue. Construction has been initiated on seven (7) of the condominiums/townhouses and the plat depicts the individual lots for these units. Resubdivision of Lots 1, 3, 4 and 5 will be required as the construction of the remaining 27 condominiums/townhouses is completed. Conditional preliminary plat approval for the St. James Place development was granted at the August 2006 meeting of the Planning Commission. The property proposed for subdivision consists of approximately 3.9 acres. It is zoned as RM-8, Multi-Family Residential. Condominium developments are permitted in the RM-8 District subject to the approval of a subdivision plat. This subdivision required street construction, sidewalk construction, the extension of water service, the provision of fire hydrants, the installation of public sewer, and the installation of underground electrical service. All required improvements, with the exception of sidewalk installation, have been completed. A Letter- of Credit in the amount of $7,000, expiring on June 4, 2009, has been submitted as a financial guarantee of the completion of the required sidewalk improvements. A Warranty of Improvements in the amount of $10,000 has been submitted and a Final Street Surfacing Fee of $6,930 had been paid. Staff recommended conditional Final Plat approval subject to the completion of plat revisions as specified by the Planning Department and to the renewal of the Grading Permit surety. Dr. Roy Loutzenheiser made the motion to grant conditional Final Plat approval subject to staff’s recommendation. Tod Williams seconded the motion and the motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL. CONSIDER FOR ACTION A REQUEST FOR A SIX (6) MONTH EXTENSION OF PRELIMINARY PLAT APPROVAL FOR MAPLE LEAF CENTER SUBDIVISION, 11 LOTS LOCATED OFF NEAL STREET. REQUEST SUBMITTED BY AEI ON BEHALF OF MAPLE LEAF DEVELOPMENT. James Mills stated that Mr. Bob Faulhaber of AEI, on behalf of Maple Leaf Developments, has submitted a request for a six month extension of the Preliminary Plat approval for the proposed Maple Leaf Center Subdivision, a proposed 11-lot commercial subdivision located off Neal Street and Old Walton Road. This proposed subdivision was originally granted preliminary approval in August of 2005. A revised preliminary plat was conditionally approved at the May 2006 meeting and a COOKEVILLE PLANNING COMMISSION 3 JUNE 25, 2007 second revised preliminary plat was conditionally approved at the June 2006 meeting. The original preliminary plat depicted a proposed subdivision of a 23.21 acre tract into 5 lots. In the first revision the developer proposed significant changes, including the addition of 6 more lots and additional street and utility construction, which required re-submittal of the plat. The property now proposed for subdivision consists of approximately 37.87 and includes both tracts of the Eye Centers of Cookeville, Phase I Division. The property proposed for subdivision is zoned as CR, Regional Commercial. The subdivision will require new street construction, which must be done to Major Collector Street construction standards, the installation of sidewalks on one side, and utility installation. A grading permit has been issued and some work has been initiated. The surety serving as a warranty of improvements required for the issuance of the grading permit has expired and a new surety must be submitted. Staff recommended conditional approval of six-month extension of preliminary approval subject to the conditions established at the June 2006 meeting of the Planning Commission and subject to the submittal of a new surety as a Warranty of Improvements for the work specified for the grading permit. Tod Williams made the motion to grant conditional approval of a six-month extension subject to staff’s recommendations. Judy Jennings seconded the motion and the motion carried unanimously. CONDITIONAL SIX-MONTH EXTENSION APPROVAL. CONSIDER FOR ACTION FINAL PLAT OF STONE CREEK SUBDIVISION, 17 LOTS LOCATED OFF BRASWELL AVENUE. REQUEST SUBMITTED BY AARON BERNHARDT. James Mills stated that Mr. Aaron Bernhardt has submitted for approval a Final Plat of Stone Creek, a 17 lot subdivision located off Braswell Avenue. The property proposed for subdivision is zoned as RD, Single Family and Duplex Residential. The original preliminary plat of this subdivision was approved in September 2005. A revised preliminary plat was approved in June 2006. The primary revision approved in 2006 was the construction of a cul-de-sac instead of the extension the proposed Stone Creek Drive through to Crescent Drive. This subdivision required street and sidewalk construction, the extension of water service, the provision of fire hydrants, the installation of public sewer and the installation of underground electrical service. All required improvements, with the exception of sidewalk installation, have been completed. A Letter-of Credit in the amount of $5,000, expiring on June 2008, has been submitted as a financial guarantee of the completion of the required sidewalk improvements. A Warranty of Improvements in the amount of $10,000 has been submitted and a Final Street Surfacing Fee of $9,500 had been paid. The plat depicts the dedication of right-of-way along Braswell Avenue. Braswell Avenue is a substandard street with a width of only 13 to 14 feet. The Subdivision Regulations require that the developer bring up to standard any substandard streets necessary for the development of a subdivision; however, the Planning Commission previously approved a COOKEVILLE PLANNING COMMISSION 4 JUNE 25, 2007 request from Mr. Bernhardt to postpone the improvements to Braswell Avenue until lots are divided off the substandard street. Staff recommended conditional Final Plat approval subject to the following: • Revisions to Final Plat as determined by the Planning Department • Revisions to as-built plans as determined by the Water Quality Control Department • Renewal of Grading Permit Surety Tod Williams made the motion to grant conditional Final Plat approval, subject to staff’s recommendation.
