COOKEVILLE PLANNING COMMISSION MINUTES JANUARY 26, 2009 The Cookeville Planning Commission met on Monday, January 26, 2009 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Stafne, Tod Williams, Dr. Angelo Volpe, Dr. Roy Loutzenheiser, Judy Jennings, Chris Wakefield, Ryan Williams, Aaron Bernhardt, and Randy Dalton. STAFF MEMBERS PRESENT: James Mills, Jayne Barns, and Ken Young. OTHERS PRESENT: Heather Mullinex, J. D. Parks, and Rob Schabert. ELECTION OF CHAIRMAN AND VICE CHAIRMAN. Dr. Angelo Volpe made the motion to elect Jim Stafne as Chairman and Tod Williams as Vice-Chairman and to close further nominations. Chris Wakefield seconded the motion and the motion carried unanimously. JIM STAFNE ELECTED CHAIRMAN AND TOD WILLIAMS ELECTED VICE-CHAIRMAN. CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Dr. Angelo Volpe made the motion to approve the agenda with the addition of Action Item #5: Consider for action extension of Final Plat approval for Blackwell Park, 13 lots located off Blackwell Road. Request submitted by J. D. Parks. Judy Jennings seconded the motion and the motion carried unanimously. APPROVED AMENDED AGENDA. CONSIDER FOR APPROVAL THE MINUTES OF NOVEMBER 24, 2008. Tod Williams made the motion to approve the minutes of November 24, 2008. Dr. Angelo Volpe seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION REQUIRED STREET IMPROVEMENT ALTERNATIVE FOR STONE CREEK DIVISION, PHASE II. REQUEST SUBMITTED BY AARON BERNHARDT. THIS ITEM WAS POSTPONED AT THE NOVEMBER 24, 2008 MEETING. THE PROPERTY OWNER HAS REQUESTED THAT THIS ITEM BE WITHDRAWN FROM THE AGENDA. James Mills stated that Aaron Bernhardt has submitted a request that this item be withdrawn from consideration at this time. Staff recommended approval of the withdrawal. Chris Wakefield made the motion to approve withdrawing this item from the agenda. Dr. Roy Loutzenheiser seconded the motion. Motion carried. WITHDRAWN. COOKEVILLE PLANNING COMMISSION 2 JANUARY 26, 2009 CONSIDER FOR ACTION APPROVING PLANS FOR RAILS AND TRAILS. REQUEST SUBMITTED BY CROUCH ENGINEERING. (MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES THE APPROVAL OF THE PLANNING COMMISSION.) Dr. Angelo Volpe made the motion to approve moving this item from study to action. Tod Williams seconded the motion and the motion carried unanimously. APPROVED MOVING FROM STUDY TO ACTION. James Mills stated that Crouch Engineering, on behalf of the Tennessee Central Heritage Rail Trail Authority, has submitted for review and approval plans for the Putnam County Rails with Trails project. The purpose of the review is to evaluate the plans in terms of compliance with the Cookeville Comprehensive Future Land Use Plan. The portion of the proposed Rails with Trails project located within the corporate limits of Cookeville is approximately four (4) miles in length. It begins at the Cookeville Depot and follows the Nashville and Eastern Railroad right-of-way, with some deviations, in a northeasterly direction to the Cookeville eastern corporate limits at State Highway 111. The plan depicts the location of two (2) trail heads within the corporate limits, with one in the vicinity of the depot and the second at Cinderella Park. The proposed Rails with Trails project is identified in the 2003 Pedestrian and Bicycle Circulation Plan prepared and approved by the Cookeville Greenways/Bike Trails/Pedestrian Circulation Task Force. The project is specifically identified in the plan as the Cookeville Greenway/Cookeville Railroad Greenway. The Pedestrian and Bicycle Circulation Plan was adopted as a part of the Pedestrian Circulation Plan Element of the Cookeville Comprehensive Future Land Use Plan in 2003. Staff recommended approval of plans as to conformity with the Comprehensive Future Land Use Plan. Dr. Roy Loutzenheiser made the motion to approve the plans in compliance with the Comprehensive Future Land Use Plan for the portion of the Rails and Trails that is located inside the city limits of Cookeville. Dr. Angelo Volpe seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION EXTENSION OF FINAL PLAT APPROVAL FOR BLACKWELL PARK, 13 LOTS LOCATED OFF BLACKWELL ROAD. REQUEST SUBMITTED BY J. D. PARKS. James Mills stated that J. D. Parks has submitted a request for an extension of final plat approval for Blackwell Park Subdivision that was granted by the Planning Commission on November 24, 2008. Mr. Parks indicated that weather conditions have prevented further work on the road. Staff recommended a 90 day extension. Randy Dalton made the motion to grant a 90 day extension of the Final Plat for Blackwell Park. Judy Jennings seconded the motion and the motion carried unanimously. APPROVED 90 DAY EXTENSION. COOKEVILLE PLANNING COMMISSION 3 JANUARY 26, 2009 Staff requested that the Board vote on Study Items #1 and #3-7 separately to allow discussion on Study Item #2. REQUEST SUBMITTED BY CROWN PROPERTIES. (7) CONSIDER FOR STUDY REZONING 6.7 ACRES ON GAINESBORO GRADE (TAX MAP 39, PARCEL 58.04) FROM CL (LOCAL COMMERCIAL) AND RS-10 (SINGLE-FAMILY RESIDENTIAL) TO RS-5 (SINGLE FAMILY RESIDENTIAL). REQUEST SUBMITTED BY H & E ENTERPRISES. James Mills stated that he wanted to clarify some of the changes to the Architectural Design requirements that relate to the appeals process before it is taken for study. The Board felt that the first step would be in house review by the Planning and Codes Departments to see if the plans meet the design standards. All appeals would go to the Architectural Review Board and after that the appeals would go to court. Judy Jennings made the motion to take Item #2 for study with the revisions to in house review and appeals board. Dr. Angelo Volpe seconded the motion and the motion carried unanimously. STUDY ITEM.
