APRIL 23, 2012
The Cookeville Planning Commission met on Monday, April 23, 2012 at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.
MEMBERS PRESENT: Jim Stafne, Dr. Roy Loutzenheiser, Judy Jennings, Chris
Wakefield, Aaron Bernhardt, Randy Dalton, David Webb, and Jim Woodford.
MEMBERS ABSENT: Dr. Angelo Volpe.
STAFF MEMBERS PRESENT: James Mills, Jayne Barns, Ken Young, and Jim Shipley.
OTHERS PRESENT: Gary Hendrick and J. D. Parks.
CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Dr. Roy
Loutzenheiser made the motion to approve the agenda as submitted. Jim Woodford
seconded the motion and the motion carried unanimously. APPROVED.
CONSIDER FOR APPROVAL THE MINUTES OF MARCH 26, 2012. Jim
Woodford made the motion to approve the minutes of March 26, 2012. Chris Wakefield
seconded the motion and the motion carried unanimously. APPROVED.
CONSIDER FOR ACTION REZONING 730, 740 & 750 BLACKWELL PARK
(TAX MAP # 83, PORTION OF PARCELS 77.03, 77.10 AND 77.11) FROM RS10
(SINGLE FAMILY RESIDENTIAL) TO LM (LIGHT MANUFACTURING);
REZONING 761, 781, 790 & 800 BLACKWELL PARK (TAX MAP # 83, PORTION
OF PARCELS 77.12, 77.14, 77.06 AND 77.05) FROM CI (COMMERCIAL-
INDUSTRIAL MIXED USE) TO LM (LIGHT MANUFACTURING); AND
REZONING 1601 BLACKWELL ROAD & VACANT LOT LOCATED ON
BLACKWELL ROAD (TAX MAP #83, PORTION OF PARCELS 73.00 & 74.00)
FROM LM (LIGHT MANUFACTURING) TO CI (COMMERCIAL INDUSTRIAL
MIXED USE). REQUEST SUBMITTED BY J. D. PARKS. James Mills stated that
Mr. J. D. Parks has submitted a request to rezone from RS-10, Single Family Residential,
to LM, Light Manufacturing, his properties located at 730, 740 and 750 Blackwell Park
and identified as all or portions of Parcels 77.03, 77.11 and 77.10 on Tax Map 83; from CI,
Commercial Industrial Mixed Use to LM his properties located at 761, 781, 790 and 800
Blackwell Park and identified as portions of Parcels 77.12, 77.14, 77.06 and 77.05 on Tax
Map 83; and from LM to CI his properties located at 1601 Blackwell Road and a vacant lot
located at the northern intersection Blackwell Road and Blackwell Park identified as
portions of Parcels 73.00 and 74.00 on Tax Map 83.
There are two primary purposes for the rezoning requests: the first being the extension of
LM zoning to the west of Blackwell Park and the second being to place a number of

parcels currently with split zoning into one particular zone. When the Blackwell Park
Subdivision was approved in 2009 the property was located within three (3) different
zoning classifications, RS-10, CI and LM. The Planning Department suggested that Mr.
Parks address the split zoning issue at the time; however, he chose not to do so.
The current RS-10/LM zoning boundary is approximately located at the beginning of the
cul-de-sac at the end of Blackwell Park. Two (2) entire parcels and a portion of one (1)
parcel accessed by Blackwell Park are zoned as RS-10. The extension of LM zoning of
between approximately 250 and 350 feet to the west would rezone a portion of Parcel
77.10 at 750 Blackwell Park from RS-10, all of Parcel 77.11 at 740 Blackwell Park from
RS-10, and a portion of Parcel 77.03 at 730 Blackwell Park. Parcel 77.03 at 730 Blackwell
Park is a large tract consisting of more than 10 acres that extends westward to Pigeon
Roost Creek. Immediately adjacent to the west of Pigeon Roost Creek are parcels within
the Town and County Estates Subdivision. The proposed extension of LM zoning on
Parcel 77.03 located at 730 Blackwell would end at an existing tree line and where there is
also a significant drop in the topography of the property. Approximately 9.5 acres of the
property would remain zoned as RS-10 and in the opinion of the Planning Department this
would provide a substantial protective buffer for the residentially developed area to the
west.
As a result of the development of the Blackwell Park Subdivision the zoning of several
newly created parcels was split between LM and CI. In the proposed request the parcels
with split zoning would be rezoned so that they are placed entirely within the zone
covering the majority of the parcel. On two (2) parcels (Parcels 73.00 and 74.00) the
rezoning would be from LM to CI and on four (4) parcels (Parcels 77.05, 77.06, 77.12 and
77.14) it would be from CI to LM. In the opinion of the Planning Department the rezoning
of these six (6) parcels so that they are entirely within one zoning district would resolve an
ambiguous and confusing situation.
Staff recommended approval of rezoning requests.
J. D. Parks stated that the proposed changes in zoning reflect what the majority of the
current lots are already zoned.
Dr. Roy Loutzenheiser made the motion to approve the rezoning requests. Chris
Wakefield seconded the motion and the motion carried unanimously. APPROVED
REZONINGS.
Jim Woodford made the motion to take the following items for study. Dr. Roy
Loutzenheiser seconded the motion and the motion carried unanimously. STUDY

(3) CONSIDER FOR STUDY AMENDMENTS TO THE ZONING CODE TO PROVIDE
INCENTIVES FOR DEVELOPMENT IN AREAS IDENTIFIED IN THE
