MINUTES
JULY 27, 2015
The Cookeville Planning Commission met on Monday, July 27, 2015 at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.
MEMBERS PRESENT: Dr. Roy Loutzenheiser, Judy Jennings, David Webb, Jim
Woodford, Kay Starkweather, Leslie Sullins, and Tracy Cody.
MEMBERS ABSENT: Jim Stafne and Chris Wakefield.

CONSIDER FOR APPROVAL THE AGENDA AS AMENDED. James Mills stated
that after Thursday’s work session that David Allen asked if he could make a presentation
at tonight’s meeting. Mr. Allen is with the “Auxin” Group that is acquiring land in the
downtown area for the possible development of a hotel and convention center. Mr. Allen
would like to bring the Planning Commission up-to-date on his group’s plans. Mr. Mills
added that the presentation will be held at the end of the agenda during staff reports.
Kay Starkweather made the motion to approve the agenda as amended to add Staff Report
#2: Presentation from Auxin Group. Jim Woodford seconded the motion and the motion
carried unanimously. AMENDED AGENDA APPROVED.
CONSIDER FOR APPROVAL THE MINUTES OF JUNE 22, 2015. Kay
Starkweather made the motion to approve the minutes of June 22, 2015. Jim Woodford
seconded the motion and the motion carried unanimously. APPROVED.
CONSIDER FOR ACTION AMENDMENT TO THE ZONING CODE RELATING
TO INCREASING THE DENSITY FOR TOWNHOUSES, CONDOMINIUMS, AND
MULTI-FAMILY RESIDENTIAL USES IN CBD (CENTRAL BUSINESS
DEVELOPMENT). REQUEST SUBMITTED BY JERRY C. GAW. THIS ITEM
WAS POSTPONED AT LAST MONTH’S MEETING. James Mills stated that Mr.
Jerry C. Gaw has submitted a request for amendments to the provisions of the CBD,
Central Business District regarding multi-family residential, condominium, and
townhouses developments.
Mr. Gaw, with Mr. Paul Gaw, has recently purchased property at 9 South Cedar Street.
This property, which consists of approximately 1.09 acres, is zoned as CBD, Central
Business District. Mr. Gaw has discussed with the Planning Department the possibility of
developing the property for multi-family, condominium or townhouse purposes. In the

CBD townhouses and condominiums are currently uses permitted on review and approval
by the Planning Commission subject to specific conditions. Multi-family residential uses
in the CBD are uses permitted on appeal to the Board of Zoning Appeals and subject to the
requirements of the RM-14, Multi-family Residential District. Under the current provisions
of the CBD the maximum number of multi-family units that could be constructed on the
1.09 acre tract is 15 (3,000 square feet per dwelling unit). The maximum number of
condominiums or townhouses that could be constructed is 22 (21 dwelling units per acre).
For all three housing types a minimum of 1.25 off-street parking spaces is required per
bedroom for the first 50 dwelling units and 2 spaces per dwelling unit for every dwelling
unit exceeding 50.
Mr. Gaw is requesting that in the CBD the density for multi-family, condominium and
townhouse developments be based on the number of off-street parking requirements that
can be provided. He is also requesting that the minimum off-street parking requirement be
reduced to 1.1 parking space per bedroom. The City of Murfreesboro is offered as an
example. The Planning Department has reviewed the off-street parking requirements of
several cities in the state similar in size to Cookeville. Cookeville’s off-street parking
requirements for multi-family and similar uses are higher than any of the compared cities.
In the Cookeville 2030 Plan two (2) policies were adopted relative to housing in the
downtown area. Under the objective of providing for a variety of housing types and
densities for a wide range of family incomes, sizes and life-styles while protecting and
maintaining existing neighborhoods, Policy 4 states as follows: “Encourage and
concentrate higher-density housing development in the central city area and along major
traffic corridors with access to retail business, pedestrian amenities, cultural activities,
schools and parks.” Additionally Policy 13 states as follows: “Encourage the development
of housing in and near the downtown area.”
Higher density residential development is commonly located in the downtown areas of
most mid-size and larger cities. The Planning Department has examined the zoning
provisions from a number of cities in Tennessee similar in size to Cookeville regarding the
regulation of high density residential developments in central business districts. As can be
seen in the enclosed chart, the regulation of such uses varies significantly. While several
of the cities listed appear to allow multi-family uses in their downtowns, most are intended
to allow residential use in the upper floors of existing commercial structures.
While the Planning Department is of the opinion that higher density residential
development should be encouraged in the downtown, there are certain concerns that should
be addressed:
• Parking. The availability of off-street parking in downtown areas is typically an
issue in most cities and Cookeville is no exception. Most of the cities reviewed
require significantly less off-street parking than the City of Cookeville, with two (2)
per dwelling unit the most common.
• Building Height. Cookeville currently has no maximum building height requirements
other than to meet building codes. The Cookeville Fire Chief indicates that the

maximum height the Fire Department can reach is seven (7) stories. Few of the cities
reviewed have high rise structures. Those that do have set height limits.
• Adequate Utilities. Water and sewer systems in the downtowns of many cities are
often some of the oldest with significant limitations on capacity. Specific
requirements for verification of adequate utilities were not found in the provisions of
the cities reviewed.
The following amendments to Section 219, CBD, Central Business District, were
originally recommended:
• Amend Section 219.3 Uses Permitted on Review to read as follows:
SECTION 219.3 USES PERMITTED ON REVIEW
The following uses are permitted upon approval by the Planning Commission of a site plan
meeting the requirements of Section 233.5 of this Zoning Code and, if applicable, a
subdivision plat submitted in accordance with the Cookeville Subdivision Regulations:
219.3A Multi-family residential, efficiency apartments, single-family attached dwellings
(townhouses) and condominiums subject to the following:
1. The maximum building height shall be five (5) stories or 60 feet above street level,
whichever is less. For each story over three (3), or for every ten (10) feet in height
over 35 feet from street level, a building setback of five (5) feet from all property lines
shall be provided.
2. Verification from the Department of Water Quality Control shall be provided that
existing water and sewer capacities are adequate to serve the proposed development.
3. On site off-street parking shall be provided at a ratio of one (1) space per efficiency
apartment, 1.1 space per bedroom for multi-family residential dwellings, and two (2)
spaces per dwelling unit for townhouses and condominiums.
4. Dwelling units shall be limited to a maximum of three (3) bedrooms.
5. A minimum square footage per dwelling unit of 650 square feet for a one-bedroom
unit, 800 square feet for a two-bedroom unit, and 1000 square feet for a three bedroom
unit shall be provided.
6. The Architectural Design Requirements of Section 208A of this Zoning Code shall
apply.
• Amend Section 219.4 Uses Permitted on Appeal to delete Section 219.4B which reads
as follows:
219.4B Multi-family residential uses and efficiency apartments meeting the requirements
of Section 216 of this Zoning Code
• Amend Section 219.6 Minimum Lot Requirements (Area and Width) to read as
follows:

Unless specified elsewhere within this Section, off-street parking shall be subject to the
requirements of Section 205 of this Zoning Code.
• Amend Section 234, Chart of Permitted Land Uses to depict multi-family residential,
efficiency apartments, single family attached and condominiums as uses permitted
upon review by the Planning Commission.
Based on Thursday’s work session it would appear that there is a consensus that an
increase in the maximum density for townhouse, condominium, and multi-family
residential dwellings in the CBD would be appropriate provided adequate parking is
required. Options for revisions to the proposed Section 219.3A (3) include the following:
o On site off-street parking shall be provided at a ratio as specified in Section 205 of
this Zoning Code. (205.8B (3) provides as follows: Multi-family dwelling: 1.25
spaces per bedroom per dwelling unit for the first 50 dwelling units and 2 spaces
per dwelling unit for every dwelling unit exceeding 50 dwelling units) If this option
is approved, then an amendment to Section 219.9 will not be necessary.
o On site off-street parking shall be provided at a ratio of 1.1 spaces per bedroom.
Where computation of the number of required parking spaces results in a fraction
the number shall be rounded up to the next whole number.
Townhouses and condominiums are not specifically identified in the off-street parking
requirements in Section 205.8 but are classified as multi-family by the Codes Department
when determining off-street parking. To provided clarification, an amendment to Section
205.8B (3) specifying that multi-family dwelling includes efficiency apartments,
townhouses and condominiums should also be considered. The amended Section 205.8B
(3) would read as follows:

3. Townhouses, condominiums, efficiency apartments and multi-family dwellings: 1.25
spaces per bedroom per dwelling units for the first 50 dwelling units and 2 spaces per
dwelling unit for every dwelling unit exceeding 50 dwelling units.
Staff recommended approval of the amendments.
Jim Woodford stated that he was concerned about the parking in the downtown area. He
added that he and his wife tried to find a parking space on Friday night in order to go to an
eating establishment and it took them a long time to find a parking space. There was 40-50
cars parked on Mr. Gaw’s property on South Cedar Avenue. Mr. Woodford continued that
he thinks that the 1.25 per bedroom is adequate and should not be decreased.
Kay Starkweather stated that she was also concerned with parking in the downtown area
and she agreed with the comments made by Jim Woodford.
Matt Allen stated his property borders Mr. Gaw’s property on South Cedar and he was
concerned about the parking in this area because he is having the same issues in the CBD
District next to the Courthouse where he purchased Liberty Square. Mr. Allen added that
he recently has had 3 long term tenants move out because of the issue with parking. So he
encouraged the Planning Commission to be cautious and not decrease the requirement for
parking in the CBD District.
Mike Reel, property owner at 109 W. Broad Street, stated that he lives there and the
shortage of parking is an issue and needs to be addressed. There are four businesses with
only 5 parking spaces and further development will only make it worst for the smaller
business owners.
Jim Woodford made the motion to approve amendments for uses permitted on review and
minimum lot requirement in the CBD District, but deny reducing the parking requirements
in the CBD District. Tracy Cody seconded the motion and the motion carried unanimously.
APPROVED AMENDMENTS FOR USES ON REVIEW AND MINIMUM LOT
REQUIREMENTS IN THE CBD DISTRICT, BUT DENIED REDUCING THE
PARKING REQUIREMENTS IN THE CBD DISTRICT.
CONSIDER FOR ACTION PRELIMINARY PLAT OF JOHNNY HAMMOCK
DIVISION, 16 LOTS LOCATED OFF HUDDLESTON DRIVE. REQUEST
SUBMITTED BY JOHNNY HAMMOCK. James Mills stated that property owner
Johnny Hammock has submitted for approval a Preliminary Plat of the Johnny Hammock
Division, a 16 lot single family detached subdivision of his property located on Huddleston
Drive.
The subject property is identified on Tax Map 27 as Parcel 134.00 which contains
approximately 4.75 acres. The property is zoned RS-5, “Single-family Residential”.
Adjacent property to the southeast is zoned RM-8, “Multi-family Residential”. All other
contiguous properties are outside of the City of Cookeville corporate boundary. Lots 1-3
and 12-16 will front Huddleston Drive. The remainder of the lots will front a proposed
extension of Morris Lane which is a county road that currently dead ends at the corporate

boundary. The proposed extension will have a 50 feet right-of-way to match the existing
50 feet right-of-way and be approximately 355 feet in length. A new eight (8) inch gravity
sewer main is proposed for the development which will connect to the manhole located on
Huddleston Drive at the corporate boundary. A new six (6) inch water line will connect to
the existing six (6) inch water line located at the corner of Sharon Avenue and Alpine
Street. Three (3) new fire hydrants are depicted on the plat that will provided adequate
coverage required by the subdivision regulations. A new four (4) foot wide sidewalk along
one side of the new street extension is required but is not shown on the plat as submitted.
Finally, the current available GIS data does not indicate that there are any sinkholes,
wetlands or waterways on the property and the property is not located in a FEMA NFIP
Special Flood Hazard Area. However, the project engineer, Lauren Shibakov, has advised
that there are areas on lots 13 through 16 that may contain wetland features. The owner did
not want to proceed with the expense involved with a professional evaluation of these areas
until after the preliminary plat was considered for approval. It should be noted that these
lots will not have any disturbance activities during the period prior to final plat approval
and all new infrastructure such as new streets and utilities will not affect these lots. It is
also possible that the results of a site evaluation may influence the owner to alter or remove
these lots from the final plat. Finally, the Public Works Director, Greg Brown, has advised
that there may be sight distance concerns on Lots 13 and 14. It is the opinion of staff that
this concern can also be addressed when consideration is given to the final plat of the
development.
Staff recommended approval of the preliminary plat subject to the following:
• Lots 13 through 16 shall have a wetland evaluation and any such areas so identified
shall be delineated on the Preliminary Plat prior to beginning any construction
• The plat must be updated to depict the required four (4) foot wide sidewalk along one
side of the Morris Lane extension
• Developer must schedule and attend a pre-construction meeting with all the appropriate
city departments Developer understands and agrees that all right-of-ways must be
cleared prior to any installation of utilities
• Developer must submit a street plan and profile with storm sewer and sidewalk details
to the Department of Public Works for all new streets. Plan shall include typical road
section, subgrade, base width, asphalt width and 2:1 slopes
• Developer shall submit a Storm Water Pollution Prevention Plan (SWPPP) to the
Department of Public Works
• Developer must provide a 15 feet wide utility easement along all road frontage on both
sides of the new streets
• Developer must submit water (including fire hydrants) and low pressure sewer plans to
the Water Quality Control Department
• Developer shall submit plans for the installation of underground electric per the
Electric Department design requirements
• Developer to submit plans for the installation of natural gas to the Gas Department
• Developer to provide all conduit for underground communications facilities, CAD files
and electrical layout plan to Frontier Communications

• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments

Tracy Cody made the motion to grant conditional preliminary plat approval of the Johnny
Hammock Division, 16 lots located of Huddleston Drive, subject to staff’s
recommendation. Leslie Sullins seconded the motion and the motion carried unanimously.
CONDITIONAL PRELIMINARY PLAT APPROVAL.
CONSIDER FOR ACTION REVISED FINAL PLAT OF WEST END
NEIGHBORHOOD, PHASE 1, 3 LOTS LOCATED ON WEST END STREET.
REQUEST SUBMITTED BY HABITAT FOR HUMANITY. James Mills stated that
Pam Ealey of Habitat for Humanity has submitted for approval a Revised Final Plat of
West End Neighborhood Phase I, which was previously granted conditional final approval
by the Planning Commission on June 23, 2015 for seven (7) lots. Habitat wishes to reduce
the number of lots in Phase I to three (3) due to a lack of current sewer availability.
The subject property is identified on Tax Map 53H Group A as Parcel 42.00 and contains
approximately 16.27 total acres and is zoned RD, “Single-family and Duplex Residential”.
The Phase I revision will occupy 0.36 acres of the parcel instead of 0.92 as previously
approved. The plat depicts a new four (4) foot wide sidewalk that will be constructed on
the subject property in front of Lots 1-3 in Phase I and Lots 4-7 in Phase II. This will be
constructed on the subject property outside of the West End Street right-of way due to the
existing slope conditions. Habitat has paid the $6,500 fee to guarantee this construction as
requested by Public Works Director, Greg Brown. Mr. Brown also stipulated that the plat
must depict a sidewalk easement and a seven (7) foot wide easement is shown on the plat.
The current available GIS data does not indicate that there are any sinkholes, wetlands or
waterways on the property. In addition, the parcel is not located in a FEMA NFIP Special
Flood Hazard Area.
Staff recommended conditional approval of the revised final plat, subject to the addition of
the sidewalk easement and additions and or corrections as requested by the Planning
Department and/or other appropriate city departments.
Bob Jett of Habitat for Humanity was present in case the Board has questions.

End Neighborhood, Phase 1, 3 lots located on West End Street, subject to staff’s

CONSIDER FOR ACTION PRELIMINARY PLAT OF WEST END
NEIGHBORHOOD PHASE II, 18 LOTS LOCATED ON WEST END STREET.

End Neighborhood Phase II, an 18 lot subdivision of a portion of their property located on
West End Street adjacent to Phase I of the development.
The subject property is identified on Tax Map 53H Group A as Parcel 42.00 and Phase II
contains approximately 2.75 total acres and is zoned RD, “Single-family and Duplex
Residential”. Adjacent properties to the north, northwest and east are zoned as RS-10,
Single family Residential”. All other contiguous properties (across the railroad right-of-
way) are zoned CI, “Commercial-Industrial Mixed Use”. Lots 4-7 and 13-21 will have rear
driveway access to a proposed 20 foot wide private alley that terminates in a hammer-head
turnaround design. In addition, two (2) new unnamed streets are proposed and the
developer is requesting that the right-of-way width requirement be reduced from 50 feet to
40 feet. Public Works and the utility departments have agreed to the reduction provided
that all the easements bordering along the new street frontages be increased from 10 feet to
15 feet. Habitat intends for the new streets to be dedicated to the city. A new sidewalk is
proposed to run the length of the new street from Lot 8 to Lot 21. As noted in the
recommendation for Phase I, Habitat has financially guaranteed the construction of the
sidewalk on Lots 4-7 along West End Street. The current available GIS data does not
indicate that there are any sinkholes, wetlands or waterways on the property. In addition,
the parcel is not located in a FEMA NFIP Special Flood Hazard Area. There are three
detention basins shown on the plat. Although these are to be physically located within the
area intended for Phase III, detention basin #1 is an infiltration area for storm water from
Phase II and detention basin #2 is an infiltration area for storm water from Phase III.
Detention basin #3 will hold the overflow water from basins #1 and #2 on a more
permanent basis. The common areas, private alley and storm water facilities are to remain
private and are to be maintained in accordance with a Homeowner’s Association
agreement that must be submitted in a timely manner after the final plat is recorded.
Staff recommended approval of the request to reduce to right-of-way width from 50 feet to
40 feet on the new streets and approval of the preliminary plat subject to the following:
• Developer must schedule and attend a pre-construction meeting with all the appropriate
city departments
• Developer understands and agrees that all right-of-ways must be cleared prior to any
installation of utilities
• Developer must submit a street plan and profile with storm sewer and sidewalk details
to the Department of Public Works for all new streets. Plan shall include typical road
section, subgrade, base width, asphalt width and 2:1 slopes
• Developer shall submit a Storm Water Pollution Prevention Plan (SWPPP) to the
Department of Public Works
• Developer must provide a 15 feet wide utility easement along all road frontage on both
sides of the new streets

Kay Starkweather asked if the residents could afford a homeowners association fee?
Bob Jett responded that the homeowner’s fee is built into the cost of the house and that
they have educational classes with the owners to go over what the fees cover.
Leslie Sullins made the motion to approve reducing the right-of-way width requirement
from 50’ to 40’ and to grant conditional preliminary plat approval for West End
Neighborhood Phase II, 18 lots located on West End Street, subject to staff’s
recommendation. Kay Starkweather seconded the motion and the motion carried
unanimously. APPROVED REDUCING THE RIGHT-OF-WAY WIDTH
REQUIREMENT FROM 50’ TO 40’ AND TO GRANT CONDITIONAL
PRELIMINARY PLAT APPROVAL FOR THE WEST END NEIGHBORHOOD
PHASE II.
CONSIDER FOR ACTION FINAL PLAT OF WILLOW PROPERTIES PHASE II,
3 LOTS LOCATED ON SOUTH WILLOW AND BILL SMITH ROAD. REQUEST
SUBMITTED BY JOHNNY STITES. James Mills stated that Johnny Stites with South
Willow Properties, LLC has submitted for approval a Final Plat of Willow Properties
Subdivision Phase II, a three (3) lot subdivision of their property bounded by South
Willow Avenue on the east, Humble Drive on the north and Bill Smith Road on the
southwest.
The subject property is identified on Tax Map 065 as Parcel 58.00 and contains
approximately 22.021 total acres and is zoned CG, “General Commercial”, as are adjacent
properties to the north, east and south. Adjacent properties to the west are zoned RM-8,
“Multi-family Residential” and the property to the northwest is zoned RS-15, “Single
Family Residential”. As per the Subdivision Regulations, the proposal does not require
prior preliminary plat approval due to the fact it contains less than 10 lots and water,
sewer, electric and fire hydrants are available. There is a sinkhole floodplain demarcated
on the plat which is identified in the City’s GIS data as Sinkhole Retention Area (SRA) #
219 with a base flood elevation of 1030 feet. Within the confines of this SRA there is a
sinkhole of approximately 0.02 acres that has been owned by the City of Cookeville since
1997. Any future development on Lots 2 and 3 will have to be done in accordance with the
SRA regulations specified in Section 231 of the Zoning Code. There is a recorded shared
non-exclusive drive easement between Lot 1 and the property bordering on the south
occupied by Bojangles to serve Lot 2. Finally, the Water Quality Control Department has
requested that a 20 feet wide utility easement be shown on the plat from the manhole west
of Humble Drive.
Staff recommended conditional approval of the Final Plat, subject to the inclusion of a
utility easement as requested by the Department of Water Quality Control and additions

and or corrections as requested by the Planning Department and/or other appropriate city
departments.
Jim Woodford made the motion to grant conditional final plat approval of Willow
Properties, Phase II, 3 lots located on South Willow Avenue and Bill Smith Road, subject
to staff’s recommendation. Tracy Cody seconded the motion and the motion carried
unanimously. CONDITIONAL FINAL PLAT APPROVAL.
CONSIDER FOR ACTION FINAL PLAT OF DOWNTON SQUARE, PHASE II, 13
LOTS LOCATED ON DOWNTON AVENUE. REQUEST SUBMITTED BY JERRY
GAW AND AARON BERHNARDT. James Mills stated that Jerry Gaw and Aaron
Bernhardt have submitted for approval the Final Plat of Downton Square Phase II, a 13 lot
single family attached development that was granted conditional Preliminary Plat approval
by the July 28, 2014.
The subject property is identified on Tax Map 53M Group B as Parcel 2.00. The property
is zoned CG, “General Commercial” and the entire development site consists of
approximately 9.18 total acres. Phase II comprises 1.46 acres with 12 building lots and Lot
13 encompassing the remaining common area of this phase. All of the dwelling units are
being outfitted with sprinkler systems that meet the National Fire Protection Association
design standard 13D. In addition, there will be two (2) new hydrants across the new street,
Downton Avenue, in Phases III and IV that will be well within the proximity required by
the subdivision regulations for fire protection. All of the property including the streets,
common areas and infrastructure components are private. Repair and maintenance of the
common elements will be covered under a homeowner’s association agreement that is to
be submitted in a timely manner after the plat is recorded. The developers intend to
complete the construction of the street and the sidewalk depicted on the plat within 90 days
of receiving conditional final approval. No Warranty of Improvements is required due to
the private nature of the infrastructure.
Staff recommended conditional approval of the Final Plat as submitted, subject to the
completion of the street and sidewalk, the installation of street signs and stop signs as well
as additions and corrections to the plat as requested by the Planning Department and/or
other appropriate city departments.
Leslie Sullins asked about the ingress & egress and if they were planning on one-way in
and out.
James Mills stated that at this time they are planning two way ingress and egress at both
entrances.
