The Cookeville Planning Commission met on Monday, November 28, 2016 at 5:30 p.m.,
in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.
MEMBERS PRESENT: Jim Stafne, Judy Jennings, Chris Wakefield, David Webb, Jim

CONSIDER FOR ACTION REZONING 570 STATE STREET FROM RS10
(SINGLE-FAMILY RESIDENTIAL) TO RM8 (MULTI-FAMILY RESIDENTIAL).
REQUEST SUBMITTED BY JACK & CONNIE MITCHELL. James Mills stated
that Ms. Connie Mitchell has submitted for consideration a request to rezone from RS-10,
Single Family Residential to RM-8, Multi-Family Residential, property located at 570
State Street.
The subject property is identified as Parcel 2.04 on Tax Map 53 and consists of 1.00 acres
surveyed or 43,560 square feet. The parcel was created as a part of the Upper Cumberland
Christian Home Division, which was approved and recorded in 2007. It is contiguous with
properties zoned as RS-10 to the north, east and south and as RM-8 to the west. The
Upper Cumberland Christian Home, a 33 unit senior housing complex, is adjacent to the
south and west of the property.
The RS-10 district is intended to provide a low to moderate density single-family
residential environment. Permitted uses are primarily limited to single-family detached
dwellings at a density of no less than 10,000 square feet per dwelling unit. The RM-8
district is intended to provide a moderate density multi-family, two-family and single

family residential environment. The minimum lot area per dwelling unit requirement in
the RM-8 district is 5,000 square feet. With a land area of one (1) acre the maximum
number of dwelling units that could be located on the subject property under RM-8 zoning
is eight (8). A maximum of four (4) bedrooms can be provided per dwelling unit.
The property was purchased by the Mitchells from Upper Cumberland Christian Home,
Inc. in 2007. Upper Cumberland Christian Home, Inc. purchased the property from
Satellite Homes, Inc. in 2004. The property was originally developed by Satellite Homes,
Inc. in around 1982 as a group home for approximately eight (8) residents. When the
property was purchased by the Mitchells they converted the structure to a single family
dwelling with separate living quarters for their parents.
In 2012, Ms. Mitchell submitted a request to rezone the subject property to RM-8 for the
purpose of converting the structure to a hospice residence home. The request to rezone the
property to RM-8 was denied, however, an amendment to the Zoning Code to allow
hospice residence homes in the RS-10 zoning district as a use permitted on appeal (special
exception) was approved and adopted through Ordinance Number O12-08-17. In
November of 2012 a special exception was approved by the Board of Zoning Appeals to
allow a hospice residence home at 570 State Street. The property was subsequently used
as a hospice residence home until earlier this year.
Ms. Mitchell indicates in attached correspondence that the operation of the hospice
residence home was discontinued due to financial difficulties. In order to continue to
provide the hospice care she would like to expand the facility to include housing for non-
hospice care residents. According to Ms. Mitchell the additional housing would be catered
to seniors and persons with disabilities. In the opinion of the Planning Department, the
desired housing for seniors and persons with disabilities would be classified as an assisted
living/residential care facility. An assisted living/residential care facility is a use permitted
on appeal (special exception) in the RM-8 zoning district; however, one of the
requirements for approval is that the site must contain a minimum of five (5) acres. As
previously noted, the subject project consists of approximately one (1) acre.
Hospice residence home is a permitted use in the requested RM-8 zoning subject to the
same conditions as the RS-10 zoning. These conditions include a minimum lot area of
40,000 square feet for the facility and a maximum of 10 residents at the facility. If the
intent is continue the operation of a hospice residence home, the subject property could not
be used for any additional purpose whether it is rezoned as RS-10 or RM-8.
While the additional use of the property proposed by Ms. Mitchell would not be permitted
if it were to be rezoned to RM-8 under its current provisions, rezoning of the property may
still be appropriate. If it is determined that the additional uses for the property proposed by
Ms. Mitchell are appropriate, then the provisions of the Zoning Code would have to be
amended. In the opinion of the Planning Department the additional uses proposed by Ms.
Mitchell would be more suitable in the RM-8 zoning district rather than the RS-10 zoning
district. Potential Zoning Code amendments to allow the uses proposed by Ms. Mitchell
include reducing the land area requirements for hospice residence homes and/or assisted

living/residential care facilities in the RM-8 zoning district. As previously noted the
residential structure was originally built as a group home, which could be considered a
higher density residential use. With existing RS-10 zoning reuse of the dwelling is
significantly limited.
Staff recommended approval of the rezoning request.
Connie Mitchell, property owner of 570 State Street, stated that the hospice house is not
economically feasible and that she is requesting the rezoning in order to turn the 10
bedrooms into 24 bedrooms for a home for the aged. She stated that she would place a
deed restriction on the property limited its use to hospice/assisted living/residential care
facility/group home or single family use.
Leslie Sullins Draper asked if the property owner could add a deed restriction to the
property to prevent them from selling the property for apartments.
James Mills stated that the property owner can voluntarily agree to a deed restriction
before the rezoning has been approved, but it can’t be required.
Jim Woodford was concerned about doubling the number of bedrooms.
Mrs. Mitchell added that she would be operating a nonprofit facility with 20 permanent
residents with 24 hour care and that most of the residents would not be driving.
Connie Mitchell added that she is voluntarily agreeing to add a deed restriction to the
property that it will not be used for apartments or sold as apartments.
Paul Pippin of Upper Cumberland Christian Homes stated that they were opposed to RM8
because it allows apartments and was concerned about the property being sold in the future
for apartments. Mr. Pippin added that he was not against the Hospice House use.
James Mills stated that since the home for the aged is not currently allowed in the RM8
zone that Zoning Code amendments will have to be made for all RM8 zones and that it
could take at least six (6) months to come up with the guidelines.
Tracy Cody made the motion to approve rezoning 570 State Street from RS10 (Single-
Family Residential) to RM8 (Multi-Family Residential), subject to Mrs. Mitchell’s
voluntarily deed restriction to not use or sell the property for multi-family purposes to be
completed and recorded prior to the Ordinance being adopted by the City Council. Chris
Wakefield seconded the motion. Votes: Jim Stafne - yes, Judy Jennings - nay, Chris
Wakefield - yes, David Webb - yes, Jim Woodford - nay, Leslie Sullins Draper - nay,
Tracy Cody - yes, and Jim Cobb - yes. Motion passed. APPROVED REZONING

CONSIDER FOR ACTION REZONING PROPERTY LOCATED OFF LOCUST
GROVE ROAD (TAX MAP # 54-1.07) FROM CI (INDUSTRIAL COMMERCIAL
MIXED USE) TO RS20 (SINGLE FAMILY RESIDENTIAL). REQUEST
SUBMITTED BY J. T. TURNBOW. James Mills stated that Mr. J. T. Turnbow has
submitted a request to rezone from CI, Commercial-Industrial Mixed Use to RS-20, Single
Family Residential property located off Locust Grove Road identified as Parcel 1.07 on
Tax Map 54.
The subject property consists of approximately 25 acres. It is contiguous with properties
zoned as CI and RS-20 to the east, as CI to the north and west, and as RS-20 to the south.
The property is located in an area that was annexed by the City of Cookeville in 2013 and
the current zoning of the subject property was established at the time of annexation
through Ordinance No. O12-10-19. The property was zoned as CI at the request of the
then property owner Oscar Gaw.
The Cookeville 2030 Plan depicts the subject property as primarily being best suited for
commercial/industrial mixed use, which complies with the current zoning. The southern
portion of the subject project is depicted as being best suited for lower density residential
development, which complies with the requested rezoning. The 2030 Plan also depicts the
location of the Bennet Road extension, which is currently under construction, and the
proposed location of an east-west connector street.
The proposed rezoning is somewhat unique in that it is a “downzone” or a rezoning to a
more restrictive zoning classification. Mr. Turnbow indicates that he is purchasing the
property from the Gaws for the purpose of constructing a home. Single family residential
development is not a permitted use in the CI zoning district. Based on the current
development in the immediate area, the development of a single family home on the
subject property would not be out of character. To allow the construction of a dwelling
unit the property would have to be rezoned as requested.
It should be noted that the parcel is identified as Tract 2 in the Oscar W. and Betty Sue
Gaw Property Subdivision which was apparently recorded earlier this year. No plat was
submitted to the Planning Department and the subdivision was not approved by the City of
Cookeville. Tracts 1 and 2 of the subdivision, both of which were purchased by Mr.
Turnbow from the Gaws, currently have no public street frontage. It is possible that they
may be able to be accessed from the extension of Bennett Road when it is constructed.
Additionally, Tract 1 does not have access to public water. Based on the lack of access to
a public street and the lack of necessary utilities, in the opinion of the Planning Department
the Oscar W. and Betty Sue Gaw Property Subdivision is an illegal subdivision and no
building permit can be issued by the City of Cookeville until such time as the subdivision
complies with the provisions of the Cookeville Subdivision Regulations.
Staff recommended approval of the rezoning request, subject to Mr. Turnbow combining
both lots into one lot to comply with State law and submitting to the Planning Department
for recording prior to the Ordinance becoming effective.

J. T. Turnbow stated that he will be using the property for a family farm and he wants to
build his home on the property. Mr.Turnbow agreed to submit a plat combining the two
lots into one.
Chris Wakefield made the motion to grant conditional approval of the rezoning from CI
(Commercial Industrial Mixed Use), subject to a minor plat combining both lots into one
tract and submitted to the Planning Department prior to the Ordinance becoming effective.
Jim Woodford seconded the motion and the motion carried unanimously.
CONDITIONAL APPROVAL OF REZONING FROM CI TO RS20, SUBJECT TO
A COMBINATION PLAT BEING SUBMITTED TO THE PLANNING
DEPARTMENT AND RECORDED PRIOR TO THE ORDINANCE BECOMING
EFFECTIVE.
CONSIDER FOR ACTION CLOSING UNDEVELOPED ALLEYS LOCATED OFF
SOUTH OAK AVENUE & DEPOT STREET AND DECLARING THEM AS
SURPLUS AND DECLARING PORTIONS OF THE RIGHT-OF-WAY ALONG
DEPOT STREET AS SURPLUS. REQUEST SUBMITTED BY DAVID ALLEN.
James Mills stated that Mr. David Allen, of Auxin, LLC, has submitted the following three
(3) requests:
1) Closure and abandonment of two (2) alleys bisecting property owned by Auxin, LLC
and located on South Oak Avenue and Depot Street and declaring them as surplus and
making them available for purchase
2) Declaration as surplus portions of the southern right-of-way of Depot Street between
South Oak Avenue and South Cedar Avenue and making the property available for
purchase.
3) Purchase by the City of Cookeville of a portion of property owned by Auxin, LLC
where South Oak Avenue and Depot Street encroaches their property.
Auxin, LLC has acquired three (3) parcels of property located between South Oak and
South Cedar Avenues south of Depot Street for the announced purpose of constructing a
hotel and conference center. The three (3) parcels are identified as Parcels 7.00, 8.00 and
10.00 on Tax Map 53G, Group F. These parcels are the only parcels contiguous with the
alleys requested for closure and abandonment.
The first alley extends from west to east from South Oak Avenue for a distance of
approximately 100 feet and has an approximate width of 20 feet. It is contiguous with
Parcel 8.00 to the north and south and with Parcel 10.00 to the south. According to a
survey submitted by the petitioner, this section of alley consists of approximately 1,971
square feet. The second alley extends from north to south from Depot Street for a distance
of approximately 250 feet and then extends to the west for a distance of approximately 80
feet. It is contiguous with Parcel 7.00 to the east and south and with Parcel 8.00 to the
west and north. According to the survey, this section of alley consists of approximately
6,953 square feet. Combined the two sections of alley right-of-way consist of
approximately 8,924 square feet. These two (2) alleys were previously connected. In

1951, through Ordinance Numbers 407 and 409, the Cookeville City Council closed and
abandoned 117 feet of the middle portion of the alley that runs east-west.
The procedure for the closure and abandonment of streets or right-of-ways is specified in
Title 16, Chapter 4 of the Cookeville Municipal Code. The procedure includes the
following:
• Submittal of written request and payment of fee,
• Submittal of survey,
• Confirmation that all affected property owners have been contacted and concur with
the closure and abandonment (it is city policy that all adjoining property owners have
the right to purchase, if closure and abandonment are approved, one-half the right-of-
way along which the property is contiguous),
• Review by applicable city departments,
• Review and approval of Planning Commission,
• Approval of City Council, and
• Purchase of property based on a value established by the City Manager (any appraisal
and/or recording costs to be paid for by the petitioner). An analysis of the tax
appraised land values for the parcels adjacent to the Auxin, LLC site indicates an
average land value of $8.28 per square foot.
The proposed closure has been submitted to and approved by all applicable city
departments. The Water Quality Control Department indicates that it has a sewer line
located within the alley that extends southward from Depot Street. The department has
requested that a utility easement the entire width of the right-of-way be retained where the
line is located, or that the line be removed or dedicated to the property owner. The
submitted survey indicates that there may be some storm sewer facilities located within the
same alley right-of-way. The Public Works Department recommends that the storm sewer
facilities be abandoned to the property owner if the alley is closed and abandoned. No
water, electric or natural gas lines or facilities are located within the portion of the alley
right-of-way proposed for closure.
In addition to the request to close and abandon the alleys, Auxin, LLC is requesting that
portions of the southern right-of-way of Depot Street be declared as surplus and made
available for purchase by the petitioner. According to the submitted survey the first
portion of right-of-way is contiguous with the northern boundary of Parcel 7.00 and
consists of approximately 1,413 square feet. At its widest point, the section of Depot
Street right-of-way adjacent to Parcel 7.00 is approximately 10 feet in width. Due to the
potential need for improvements to the intersection of Depot Street and South Cedar
Avenue and the possibility of a sidewalk and decorative street lighting project along Depot
Street, the Public Works Department recommends against declaring this section of right-
of-way as surplus. The second portion of right-of-way is contiguous with the northern
boundary of Parcel 8.00 and consists of approximately 7,029 square feet. Due to the
possibility of a sidewalk and decorative street lighting project along Depot Street, the
Public Works Department recommends that the City retain a portion of this section of
right-of-way extending 10 feet south of the southern edge of the street pavement.

In exchange for a portion of the value of the sections of Depot Street right-of-way, the
petitioner proposes to trade portions of Parcel 8.00 where the pavement of South Oak
Avenue encroaches on said parcel. According to the submitted survey, approximately
4,491 square feet of Parcel 8.00 is encroached by South Oak Avenue.
As an additional exchange the City of Cookeville would like to acquire portions of the
petitioner’s property extending two (2) feet to the back or west of the existing sidewalk
along South Cedar Avenue. This would consist of portions of Parcels 7.00 and 8.00.
Acquisition of this property would allow the City to relocate existing street lights off the
existing sidewalk.
Staff recommended the following:
• Approval of the closure and abandonment and declaration as surplus property for sale
to the adjoining property owners at a price approved by the City Council subject to the
retention of a utility easement the entire width of the right-of-way where the existing
sewer line is located or to the acceptance of the line by the adjoining property owner.
• Approval of declaration as surplus property a portion of the southern right-of-way of
Depot Street adjacent to Parcel 8.00 on Map 52G, Group F beginning at a point 10 feet
south of the existing edge of pavement subject to the retention of utility easements as
may be appropriate.
• Approval of the acquisition of a portion of the property owned by Auxin, LLC (said
Parcel 8.00) where South Oak Avenue and Depot Street encroaches their property in
exchange for a portion of the value of the rights-of-way to be acquired by Auxin.
• Approval of the acquisition of a portion of the property owned by Auxin, LLC (said
Parcel 8.00 and Parcel 7.00 on Map53G, Group F) extending two (2) feet from the
back or west of the existing sidewalk along South Cedar Avenue in exchange for a
portion of the value of the rights-of-way to be acquired by Auxin.
Leslie Sullins Draper made the motion to approve closing the undeveloped alleys located
off South Oak Avenue and Depot Street and Declaring them as surplus and declaring
portions of the right-of-way along Depot Street as surplus, according to staff’s
recommendation. Jim Cobb seconded the motion and the motion carried unanimously.
APPROVED CLOSING UNDEVELOPED ALLEYS LOCATED OFF SOUTH OAK
AVENUE AND DEPOT STREET AND PORTIONS OF THE RIGHT-OF-WAY
ALONG DEPOT STREET AND DECLARING THEM AS SURPLUS.
CONSIDER FOR ACTION REVISED PRELIMINARY PLAT OF EYE CENTERS
OF COOKEVILLE PHASE II REDIVISION OF TRACT 2 - 1 LOT LOCATED
OFF OLD WALTON ROAD. REQUEST SUBMITTED BY RKB GROUP LLC.
James Mills stated that the RKB Group LLC has submitted for approval the Preliminary
Plat of the Redivision of Tract 2 Revised Plat of the Eye Centers of Cookeville, a one (1)
lot commercial development located on Old Walton Road between Neal Street and South
Maple Avenue. Although only one (1) new lot is proposed, the project requires the
extension of sewer and improvements to the existing street, therefore the submission of a

preliminary plat and consideration by the Planning Commission is required by the
Subdivision Regulations.
The subject property is identified on Tax Map 66 as a 1.94 acre portion of the 28.37 acre
Parcel 33.00. The remainder of the parcel is not required to be surveyed because it is
greater than five (5) acres. The entire 38.25 acre parcel was originally platted into two (2)
lots in August 2005 and a revised plat was recorded in July 2014.The entire property is
zoned CR, “Regional Commercial”. The Public Works Department has requested that the
plat be corrected to show the existing asphalt width on Old Walton Road. In addition,
Public Works requires that a turning lane from Neal Street to the northern property lot line
be constructed due to anticipation of future development on the remaining property. Public
Works Director Greg Brown stated the developer would be allowed to submit a financial
guarantee in lieu of constructing this improvement for a period not to exceed 12 months.
Mr. Brown stressed that any renewal of the financial guarantee would be subject to
recalculation based on the cost of materials at that time. Mr. Brown further stipulated that
the developer will be required to widen the section of Old Walton Road along the proposed
lot frontage to 24 feet as a condition of approval and cannot financially guarantee this
portion in lieu of improvement.
The existing eight (8) inch water line located in the right-of-way of Old Walton Road will
serve the lot. The Water Quality Control Department requires that in order to install a force
main lateral for sewer the developer must install a manhole along Neal Street to pump into.
This new manhole is to be dedicated to the City and the force main and pump station are to
be private, therefore a private sewer easement must be shown on the plat. In addition, the
Water Department requires a 15 foot utility easement along the property street frontage for
potential future gravity sewer installation. There is an existing hydrant located in at the
intersection of Neal Street and Old Walton Road that is within the required proximity to
the new lot. The Electric Department stipulates that a 20 foot easement be provided for all
power and the conduit must be installed per there specifications. The Gas Department
reports that natural gas is available to the site. There are no topographic constraints such as
sinkholes, wetlands, streams or flood hazard areas indicated by available GIS data on this
site.
Staff recommended conditional approval of the Preliminary Plat subject to the following:
• Plat must be corrected to show Old Walton Road existing pavement width,
• Developer must submit a street plan and profile to the Department of Public Works for
the street improvements to Old Walton Road. Plan shall include typical road section,
subgrade, base width and asphalt width,
• Developer shall submit a Storm Water Pollution Prevention Plan (SWPPP) to the
Department of Public Works,
• Developer must submit sewer plans to the Water Quality Control Department and a
private sewer easement must be shown on the plat,
• Developer shall submit plans for the installation of underground electric per the
Electric Department design requirements,

• Developer to submit plans for the installation of natural gas to the Gas Department if
gas service is desired,
• Developer to provide all conduit for underground communications facilities, CAD files
and electrical layout plan to Frontier Communications,
• Developer shall provide all utility easements as required by the Electric, Gas and Water
Quality Control Departments, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
Jim Woodford made the motion to grant conditional Preliminary Plat approval, subject to
staff’s recommendation. Leslie Sullins Draper seconded the motion and the motion carried
unanimously. CONDITIONAL PRELIMINARY PLAT APPROVAL.
CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE
PRELIMINARY PLAT OF CROSS POINTE SUBDIVISION PHASE II, 36 LOTS
LOCATED ON THE NORTHEAST CORNER OF OLD SPARTA ROAD AND BOB
BULLOCK ROAD. REQUEST SUBMITTED BY BERNHARDT LLC. James Mills
stated that Mr. Aaron Bernhardt has submitted a request for a six (6) month extension of
the Preliminary Plat of his Cross Pointe Phase II Subdivision, which is a 36 lot single
family detached subdivision located at the corner of Old Sparta Road and Bob Bullock
Road. The Preliminary Plat was approved by the Planning Commission on November 23,
2015 for a period of one year.
As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, an
extension of time can be applied for by the developer and granted by the Planning
Commission provided a $50.00 fee is submitted with the request. Mr. Bernhardt has
submitted the fee along with his request for an extension. Work is ongoing to install the
improvements on the site and there have been no changes made to the plat since the
preliminary plat was approved.
Staff recommended approval of the request for a six (6) month extension of the
Preliminary Plat as requested.
Jim Woodford made the motion to approve the six (6) month extension of the Preliminary
Plat of Cross Pointe Subdivision Phase II. Jim Cobb seconded the motion and the motion
carried unanimously. APPROVED SIX (6) MONTH EXTENSION OF THE
PRELIMINARY PLAT OF CROSS POINTE SUBDIVISION PHASE II.
CONSIDER FOR ACTION CANCELLING THE DECEMBER PLANNING
COMMISSION MEETING. REQUEST SUBMITTED BY STAFF. James Mills
recommended that the December Planning Commission Meeting be cancelled.
