COOKEVILLE PLANNING COMMISSION MINUTES SEPTEMBER 24, 2018 The Cookeville Planning Commission met on Monday, September 24, 2018 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Stafne, Judy Jennings, Chris Wakefield, David Webb, Kay Starkweather, Jim Cobb and Eric Walker. APPROVED. CONSIDER FOR ACTION ESTABLISHMENT OF AN HS (HISTORIC DISTRICT) OVERLAY ZONE FOR CERTAIN PROPERTIES LOCATED ALONG EAST 8TH STREET. REQUEST SUBMITTED BY SUSAN VANDERGRIFF ON BEHALF OF THE PROPERTY OWNERS. James Mills stated that the Historic Zoning Commission has recommended for the establishment of a Historic District for certain properties located along East 8th Street between North Washington and North Jefferson Avenues. The proposed district consists of 19 parcels of property. The underlying zoning for all properties in the proposed district is RS-10, Single Family Residential. All of the properties appear to be used for single family residential purposes with the exception of the property at 322 East 8th Street which has been converted to a two-family residence. The proposed establishment of this district was initiated by property owners in the area. The COOKEVILLE PLANNING COMMISSION 2 SEPTEMBER 24, 2018 oldest structure in the proposed district was built in approximately 1920 with the majority constructed in the 1940’s or earlier. To be considered historic a structure must be at least 50 years old. Under the provisions of the Historic Zoning Regulations of the Cookeville Zoning Code a simple majority of property owners in any area proposed for HS Historic District overlay zoning shall be in favor of such rezoning. The owners of 15 of the 19 properties signed a petition requesting the establishment of the HS District, well exceeding the required simple majority. The original petition proposed the establishment of the district for 17 parcels. When the petition was reviewed by the Historic Zoning Commission an additional property owner located at the southeast corner of East 8th Street and North Washington Avenue (718 North Washington Avenue) requested that her property be included in the district. It was determined by the Historic Zoning Commission, for the purposes of continuity and comprehensiveness, that the property at the northeast corner of East 8th Street and North Washington Avenue (806 North Washington Avenue) also be included in the district. This increased the number of parcels to be included in the district from 17 to 19, with the owners of 16 of the 19 parcels requesting inclusion (84 percent). Staff recommended approval of establishment of a Historic District Overlay Zone for the East 8th Street area as recommended by the Historic Zoning Commission. Chris Wakefield seconded the motion and the motion carried unanimously. APPROVED ESTABLISHMENT OF HISTORIC DISTRICT OVERLAY ZONE. CONSIDER FOR ACTION REZONING 1501 BUNKER HILL ROAD FROM RS15 (SINGLE FAMILY RESIDENTIAL) TO RS10 (SINGLE FAMILY RESIDENTIAL). REQUEST SUBMITTED BY MITCH COPELAND ON BEHALF OF WILLOW PARK PARTNERS. James Mills stated that Mr. Mitch Copeland, on behalf of the property owner Willow Park Partners, has submitted a request to rezone from RS-15, Single Family Residential to RS-10, Single Family Residential property identified as Parcel 9.00 on Tax Map 83 and located at 1501 Bunker Hill Road. The subject property consists of approximately 7.5 acres. It is contiguous with properties zoned as RS-15 to the north, south and west and as RS-10 to the east. An older single family dwelling is currently located on the property. The primary difference between the RS-15 and RS-10 zoning districts is the minimum land area requirement per dwelling unit. The RS-15 district requires 15,000 square feet and the RS-10 requires 10,000 square feet. Both districts are generally limited to single family detached residential uses. The availability of public wastewater service is required for development in both. Mr. Copeland indicates in his petition that the purpose for the rezoning is to allow the subdivision of the property in a manner similar to the subdivision developments located on the east side of Bunker Hill Road. The Cookeville 2030 Plan primarily depicts the COOKEVILLE PLANNING COMMISSION 3 SEPTEMBER 24, 2018 property as being suitable for lower density residential development. The current RS-15 zoning and the proposed RS-10 zoning are compatible with this land use classification. Staff recommended approval of the rezoning. Janet Larson, property owner at 10 Messenger Road, stated that she lived across the road from this property and she wanted to know how many acres were being rezoned. Mrs.Larson asked if the development would be income base housing. James Mills responded that the rezoning consisted of 7.5 acres. Mitch Copland, developer for the request, stated that this development would not be income based and that he was planning to build about 20 homes on the site. Mr. Copeland added that he has checked and the development has the capacity for water and sewer. Randy Chaffin stated that the property for rezoning is located in a curve and could be a safety hazard. Sandra Hunt, property owner at 1470 Bunker Hill Road, stated that Bunker Hill Road is dangerous and she was concerned that people pulling out of this development causing wrecks. J. Wallace Webb, property owner at 1466 Bunker Hill Road, stated that he lived across from the development. Mr. Webb was concerned because people drive 40-50 mph instead of 30 mph and that he had called the Police Department multiple times about it. The traffic needs to be slowed down or this development will be a hazard for people trying to get in or out of this development. Kay Starkweather asked if there have been any studies on the traffic in this area. James Mills replied that there had not been any traffic studies for this property. Chris Wakefield made the motion to approve rezoning 1501 Bunker Hill Road from RS15 (Single Family Residential) to RS10 (Single Family Residential). Jim Cobb seconded the motion and the motion carried unanimously. APPROVED REZONING FROM RS15 TO RS10. CONSIDER FOR ACTION REZONING 2245, 2301, 2309 NORTH WASHINGTON AVENUE AND A VACANT LOT FROM LM (LIGHT MANUFACTURING) TO CL (LOCAL COMMERCIAL). REQUEST SUBMITTED BY JUSTIN CUMBY ON BEHALF OF TITAN DEVELOPMENT AND JOHN THOMAS. James Mills stated that Mr. Justin Cumby of Titan Development and Mr. John Thomas have submitted a request to rezone from LM, Light Manufacturing to CL, Local Commercial their properties identified as Parcels 3.00, 4.02, 6.00 and 7.00 on Tax 40C, Group E and located on North Washington Avenue and Vickers Lane. COOKEVILLE PLANNING COMMISSION 4 SEPTEMBER 24, 2018 Mr. Cumby, who owns the properties at 2301 and 2309 North Washington Avenue, initiated the proposed rezoning and Mr. Thomas, who owns the properties at 2245 and 2267 North Washington Avenue, agreed to include his properties. The properties are contiguous with properties zoned as CL to the east, west and south and to the north as CI, Commercial-Industrial Mixed Use. Located on the property to the north is Cookeville High School and the Life Church campus is located on the properties contiguous to the east and south. Mr. Cumby has indicated that the purpose of the rezoning is to allow the development of eight (8) townhomes on the parcels he owns. Mr. Thomas has not indicated that there are any immediate plans for the development of his parcels. Townhomes are not permitted in the LM district and are uses permitted upon review in the CL district. The Cookeville 2030 Plan indicates that the subject properties would be suitable for commercial or industrial development. In the opinion of the Planning Department, based on surrounding land uses, the proposed rezoning would be appropriate. Staff recommended approval of the rezoning. Jim Cobb made the motion to approve rezoning 2245, 2301, 2309 North Washington Avenue and a vacant lot from LM (Light Manufacturing) to CL (Local Commercial). Kay Starkweather seconded the motion and the motion carried unanimously. APPROVED REZONING FROM LM TO CL. CONSIDER FOR ACTION FINAL PLAT OF MCCULLEY FARMS, 18 LOTS LOCATED ON MCCULLEY LANE. REQUEST SUBMITTED BY RAY WEAR ON BEHALF OF JANE ANN MCBROOM & SARA ELIZABETH PARKER. Ken Young stated that Mr. Ray Wear with Sunset Ventures has submitted for approval the Final Plat of McCulley Farms Subdivision, an 18 lot single family detached development of their property located at McCulley Road and Burton Lane. The property proposed for development is identified on Tax Map 52 as Parcel 51.00 and contains approximately 26.03 acres. This property is zoned as RS-20, “Single Family Residential” as are all adjacent properties. The plat depicts a new street with a cul-de-sac named McCulley Lane that is approximately 1,790 feet in length. This exceeds the 1,200 feet limit in the Subdivision Regulations for developments with only a single point of ingress and egress. The Planning Commission granted a variance in September 2017 to allow the cul-de-sac length. New four (4) foot wide sidewalks are to be constructed along both sides of the new street and will comply with current ADA requirements. Construction of the new street is underway. Public Works reports that the subgrade remains to be proof rolled and that the base stone will require proof rolling after it is applied. Once the asphalt binder is in place the curb and gutter construction will follow. The developer will be required to submit funds to the City to cover the estimated cost of the final surface. In lieu of construction, the developer is allowed to submit a financial guarantee for sidewalk construction for a period up to five (5) years. The amounts for both final surfacing and sidewalks guarantees will be determined by the Director of Public COOKEVILLE PLANNING COMMISSION 5 SEPTEMBER 24, 2018 Works. Verification of the sinkhole retention area volume and rain gardens must be completed. The Water Quality Control reports that water and sewer have been installed and the developer has been notified of items that need to be adjusted and/or completed and that “as-builts” must be submitted for review and approval. Two (2) new hydrants have been installed within the development. The department stipulated that a one (1) year financial guarantee in the amount of $3,000 must be submitted to guarantee any adjustments of water and sewer appurtenances. The Electric Department requires a utility easement 15 feet wide on each side of the new street and states that additional street lights may be required near the junction of the new street with Burton Lane. The Gas Department reports that the installation of the gas main is close to completion. As the new street and other improvements are to be dedicated to the public, the developer must also submit a $10,000 letter of credit for a two (2) year period payable to the City of Cookeville as a Warranty of Improvements. Staff recommended conditional Final Plat approval subject to the following conditions: • Submission of a one (1) year letter of credit payable to the City of Cookeville in an amount to be determined by the Public Works Director to guarantee up to an additional two (2) inches of base stone if needed, completion of the two (2) inch binder surface and curb and gutter may be submitted by the developer in lieu of completion, • Submission of a letter of credit (period up to 60 months) payable to the City of Cookeville in an amount to be determined by the Public Works Director may be submitted to guarantee sidewalk construction in lieu of completion, • Submission of a certified check payable to the City of Cookeville in an amount to be determined by the Public Works Director to pay for final street surfacing, • Developer shall pay $150 to the Public Works Department for street signage, • Developer shall submit “as-built” plans for water and sewer to Water Quality Control for review and approval, • Submission of a one (1) year financial guarantee in the amount of $3,000 to guarantee any adjustments of water and sewer appurtenances, • Developer shall submit a Warranty of Improvements two (2) year letter of credit in the amount of $10,000 payable to the City of Cookeville, with timing coordinated by Planning Department staff, and • Completion of corrections or additions to the plat as determined necessary by the Planning Department and/or other appropriate city departments. CONDITIONAL FINAL PLAT APPROVAL. COOKEVILLE PLANNING COMMISSION 6 SEPTEMBER 24, 2018 CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE PRELIMINARY PLAT OF EDGINGTON COURT, 25 LOTS LOCATED ON WEST BROAD STREET AND CHESTNUT AVENUE. REQUEST SUBMITTED BY JERRY C. GAW INC/WEST BROAD PARTNERS. Ken Young started that Mr. Jerry Gaw of West Broad Partners has submitted a request for a second six (6) month extension of the Preliminary Plat of Edgington Court, a 25 lot single family attached development of their property fronting West Broad Street and Chestnut Avenue. The plat was initially approved on March 27, 2017 and a six (6) month extension was granted on March 26, 2018. The Subdivision Regulations provides that up to two (2) six month extensions of preliminary plat approval may be requested by the developer. Building permits have been applied for but no work has begun on the site. The subject property is identified on Tax Map 53B Group P as Parcel 005.04. The property is zoned CL, “Local Commercial” and consists of approximately 1.77 acres. Adjacent properties to the north and northeast are zoned MS, “Medical Services”, remaining properties to the east are zoned CL as are two (2) parcels to the west. The remaining parcels to the west are zoned CL and RD, “Single-Family and Duplex Residential” respectively. The proposed development consists of 24 building lots and Lot 25 will encompass the remaining common areas. There have been no changes to the plat as previously approved. Staff recommended approval of a second six (6) month extension of the Preliminary Plat subject to the original terms and conditions specified at the March 27, 2017 meeting. Kay Starkweather made the motion to grant conditional approval of a second six (6) month extension of the Preliminary Plat of Edgington Court, subject to the original terms and conditions specified at the March 27, 2017 meeting. Jim Cobb seconded the motion and the motion carried unanimously. CONDITIONAL SIX (6) MONTH EXTENSION. CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE PRELIMINARY PLAT OF RESUBDIVISION OF LOT 4 OF 10TH & FISK PROPERTIES, LLC DIVISION, 10 LOTS LOCATED AT 1020 FISK ROAD. REQUEST SUBMITTED BY MATT DAVIDSON ON BEHALF OF TENTH AVENUE PARTNERS, LLC. Ken Young stated that Mr. Matt Davidson on behalf of Tenth Avenue Partners LLC has submitted for approval a request for a second six (6) month extension of the Preliminary Plat of 10th & Fisk Properties LLC Division, Re- subdivision of Lot 4, a 10 lot single family attached development of their property fronting Fisk Road. The Subdivision Regulations provides that up to two (2) six month extensions of preliminary plat approval may be requested by the developer. The initial preliminary plat for this development was conditionally approved by the Planning Commission on March 27, 2017 and an extension was granted on March 26, 2018. The subject property is identified on Tax Map 40L Group K as Parcel 013.03. The property is zoned CN, “Neighborhood Commercial” and consists of approximately 1.03 acres. Adjacent properties to the south and west are also zoned CN, and remaining properties to the north are zoned RS-10, “Single-Family Residential”. The proposed development consists of nine (9) building lots and Lot 10 will encompass the remaining common areas. COOKEVILLE PLANNING COMMISSION 7 SEPTEMBER 24, 2018 On January 12, 2017 the Board of Zoning Appeals granted a variance to reduce the total square footage per dwelling unit to allow a maximum of nine (9) dwelling units to be constructed on the site based on the submitted site plan. There have been no changes to the plat as previously approved. Construction on the site is well underway. Staff recommended approval of a second six (6) month extension of the Preliminary Plat subject to the original terms and conditions specified at the March 27, 2017 meeting. REQUEST SUBMITTED BY LARRY SUGGS OF P & N INVESTMENTS LLC. Ken Young stated that Mr. Larry Suggs on behalf of P & N Investments LLC has submitted for approval a request for a six (6) month extension of the Preliminary Plat of Franklin Court, a five (5) lot single family attached residential development of their property located on South Franklin Avenue. The Subdivision Regulations provides that up to two (2) six month extensions of preliminary plat approval may be requested by the developer. The development was granted conditional preliminary approval at the September 25, 2017 Planning Commission meeting. The undeveloped site is identified on Tax Map 053I Group B as Parcel 023.00 and consists of approximately 0.32 acres total prior to right-of-way dedication. The plat depicts the dedication of approximately five (5) feet of property along the right-of-way of South Franklin Avenue to provide for future widening of the road. The size of the parcel remaining after the dedication is approximately .29 acres. The parcel is zoned as CL, local commercial as are all surrounding parcels. Section 221.31 of the Zoning Code states in part that single family attached dwellings (townhouses) are a use permitted on review subject to conditions which include submittal to and approval of the Planning Commission of a site plan depicting the location of all proposed structures and improvements. The plat depicts Lots 1-4 as attached building lots. Lot 5 is the total area of the parcel excluding Lots 1-4 and is common area only and not a building lot. There have been no changes to the plat as previously approved. Staff recommended approval of a six (6) month extension of the Preliminary Plat subject to the original terms and conditions specified at the September 25, 2017 meeting. COOKEVILLE PLANNING COMMISSION 8 SEPTEMBER 24, 2018 CONSIDER FOR ACTION REVISED PRELIMINARY PLAT OF 700 BROAD, 63 LOTS LOCATED ON EAST BROAD STREET. REQUEST SUBMITTED BY CHAD GILBERT OF PUTNAM PROPERTIES. STAFF HAS REQUESTED THAT THIS ITEM BE MOVED FROM STUDY TO ACTION. MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES THE APPROVAL OF THE PLANNING COMMISSION. James Mills stated that Mr. Chad Gilbert with Putnam Properties has submitted for approval a Revised Preliminary Plat of 700 Broad, a single family residential development on East Broad Street with secondary access to East Spring Street. The plat was originally approved by the Planning Commission on April 23, 2018 as 43 lots on 3.75 acres. Since that time, additional adjacent property has been acquired and Mr. Gilbert is proposing that the development be expanded to 63 lots on 5.45 acres. The subject property is identified on Tax Map 53L, Group C as Parcels 16.00 and 16.01. A plat titled the Burgess Family Partnership Lot Line Revision was recorded in March that provides an ingress/egress access easement to East Spring Street. The portion of the property fronting East Broad Street is zoned RM-14 (Multi-family Residential) and the remainder is zoned CL (Local Commercial) The development site consists of approximately 3.75 acres. The adjacent parcel to the northeast is zoned RS-15 (Single- family Residential). The Saxony Apartments property to the southeast is zoned RM-14 and all adjacent parcels to the west are zoned CL. Sections 216.3 and 221.3 of the Zoning Code stipulate that single family attached dwellings (townhouses) and detached single-family cluster developments are allowed in the RM-14 and in the CL zone as a use permitted on review, subject to the submission of a plat in accordance with the Cookeville Subdivision Regulations. The property is now proposed to be developed as 56 single family detached cluster dwellings and six (6) single family attached townhomes. It should be noted that Lot 63 is the remaining common area and is not a building lot. The Directors of the Planning and Codes Departments will make a determination regarding screen and buffer requirements adjacent to the two (2) properties used as single family residential. Construction on the site is underway. Staff recommended conditional approval of the revised Preliminary Plat subject to the terms and conditions as established at the April 23, 2018 Planning Commission meeting and screen and buffer requirements as determined by the Directors of the Planning and Codes Departments. James Mills added that staff will be meeting tomorrow with the adjacent property owners concerning screening. Kay Starkweather made the motion to grant conditional approval of the revised Preliminary Plat subject to the terms and conditions as established at the April 23, 2018 Planning Commission meeting and screen and buffer requirements as determined by the Directors of the Planning and Codes Departments. Chris Wakefield seconded the motion and the motion carried unanimously. CONDITIONAL REVISED PRELIMINARY PLAT APPROVAL. COOKEVILLE PLANNING COMMISSION 9 SEPTEMBER 24, 2018 CONSIDER FOR ACTION FINAL PLAT OF DONOVAN GRIMWOOD SUBDIVISION, 3 LOTS LOCATED AT 503 & 507 WEST STEVENS STREET AND 325 CARR AVENUE. REQUEST SUBMITTED BY DONOVAN GRIMWOOD. Ken Young stated that Mr. Donovan Grimwood has submitted for approval a final plat of the Donovan Grimwood Subdivision, a three (3) lot single family detached subdivision of his property located at West Stevens Street and Carr Avenue. A preliminary plat is not required because the development requires no new street or utility construction and there are less than 10 lots proposed. The subject property is identified on Tax Map 53I as Parcel 015.00 containing approximately 1.17 acres and is zoned RS-14, “Multi Family Residential” as are the adjacent parcels to the east, south and west. Property to the north is zoned CL, “Local Commercial”. The proposed subdivision consists of three (3) lots, each containing existing single family residential structures. Two (2) of the structures were built when the area was outside the city limits and therefore, were not subject to zoning. The remaining structure at 507 West Stevens was constructed after the area was annexed and was built in compliance with the zoning code. The RM-14 Multi-Family Residential District regulations of Cookeville Zoning Code, in Section 216.6E , minimum lot requirements, provides “When a property has an existing single family structure and the structure is to remain, the minimum lot requirements of the RS-5 Single Family Residential District shall be met for the single family structure.” The existing home at 503 West Stevens is nonconforming to the front yard setback requirement from West Stevens Street and Carr Avenue. This setback encroachment along West Stevens Street has been increased due to an additional five (5) foot dedication of right-of- way. The existing home at 325 Carr Avenue is nonconforming to the front yard setback from Carr Avenue. These structures are nonconforming to these setback requirements prior to subdivision. The proposed lot at 507 West Stevens Street is compliant with all setback requirements. The proposed lot at 503 West Stevens Street (at the corner of West Stevens Street and Carr Avenue) also includes an existing block garage. The RS5 District requires a 7.5 foot minimum interior side yard setback. The western leading vertical edge of this accessory structure is located approximately 1.5 feet from the proposed lot line. This encroachment decreases to approximately four (4) feet at the eastern leading vertical edge. On September 13, 2018, the Cookeville Board of Zoning Appeals granted a variance to reduce the side yard setback requirement from 7.5 feet to 1.5 feet decreasing to four (4) feet for approximately 24 feet for the existing block accessory structure located on Tract 3 (503 W. Stevens St.) as shown on the Donovan Grimwood Final Plat. This variance was granted to allow for the subdivision of property. The BZA further stipulated if the subject structure is ever removed or destroyed, any replacement must comply with setback requirements. The BZA action authorizing the variance and the condition is noted on the submitted subdivision plat. Staff recommended conditional approval of the Final Plat subject to the completion of corrections or additions to the plat as may be determined necessary by the Planning Department and/or other appropriate city departments.
