COOKEVILLE PLANNING COMMISSION MINUTES JANUARY 28, 2019 The Cookeville Planning Commission met on Monday, January 28, 2019 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. COOKEVILLE PLANNING COMMISSION 2 JANUARY 28, 2019 CONSIDER FOR ACTION REZONING 420 & 430 PEEK DRIVE AND 412 BLAKE CIRCLE FROM RS-10 (SINGLE FAMILY RESIDENTIAL) TO RM-8 (MULTI- FAMILY RESIDENTIAL). REQUEST SUBMITTED BY MICHAEL GAW. James Mills stated Nolan Goolsby, Attorney for Michael Gaw, faxed a letter this afternoon asking that this item be postponed to allow more time to gather cost estimates for the construction of the recommended entrance into the property from Blake Circle. Staff recommended that this item be postponed until February 25, 2019. Chris Wakefield made the motion to postpone this request until February 25, 2019. Jim Cobb seconded the motion and the motion carried unanimously. POSTPONED UNTIL FEBRUARY 25, 2019. CONSIDER FOR ACTION REZONING 515 SOUTH WALNUT AVENUE FROM RM8 (MULTI-FAMILY RESIDENTIAL) TO CG (GENERAL COMMERCIAL). REQUEST SUBMITTED BY ELAINA MORGAN OF F & M PROPERTIES. Jon Ward stated that Ms. Elaina Morgan of F & M Properties has submitted a request to rezone from RM-8, Multi-Family Residential, to CG, General Commercial, property identified as Parcel 19.00 on Tax Map 53O, Group B, located at 515 South Walnut Avenue. The subject property consists of approximately 0.71 acres and is contiguous with properties zoned as RM-8, Multi-Family Residential to the east, south and west, and CG, General Commercial to the north. A single family structure is located on the property. Tax records indicate this home was constructed in 1947 and was acquired by the current owner on September 14, 2018. The CG, General Commercial District is intended for moderate and larger sized offices, personal and business services and general retail business, and is considered the least restrictive commercial zoning district. Ms. Morgan has requested the rezoning to remodel the existing home to use as a small business office. A site plan was submitted depicting an additional seven (7) parking spaces to be installed on the property to accommodate converting the home to a small business office. The Future Land Use Concept Plan component of the Development Plan Element of the Cookeville 2030 Plan is intended as a guide for land use decisions. In particular, zoning/rezoning decisions should be made in harmony with the Concept Plan. Rezoning proposals that significantly deviate from the Concept Plan generally should not be approved. The Future Land Use Concept Plan primarily depicts this area as best suited for mixed density residential development. Different phases of the St. James Place townhome development are located adjacent to the subject property to the south and east. The Planning Department has received a petition and numerous correspondences in opposition of the rezoning. Much of this opposition is from property owners in the St. James Place developments. While the subject property is adjacent to CG, General Commercial zoning to the north, the existing commercial properties all have frontage on West Jackson Street. The St. James North townhome development property is the only parcel on South Walnut Avenue that is COOKEVILLE PLANNING COMMISSION 3 JANUARY 28, 2019 zoned CG, General Commercial that does not have frontage on Jackson Street and this property was development for residential purposes. It would appear that the subject property could be developed in a similar fashion. The Planning Department has concerns with extending the commercial zoning along South Walnut Avenue for properties that do not have frontage on West Jackson Street. Staff recommended denial of the rezoning request due to concerns with extending the CG, General Commercial Zoning District to properties along South Walnut Avenue that do not have frontage on West Jackson Street. Elaina Morgan stated that she is with Tru Blue Realty and she bought the house at 515 South Walnut Avenue as an investment and she had planned on building a 6 apartment building on the site. Ms. Morgan stated that she changed her mind and would like to rehab the house and put her real estate office at that location. Brenda Huddleston, property owner at 200 St. James West, stated that it took her a year to find a condo to buy and that there is a need for more single level condo’s. Mrs. Huddleston stated that the residents in St. James area are a tight knit community and they were against commercial being located next to their homes. Ms. Huddleston added if Mrs. Morgan decided to sell the property then any business allowed in the CG could go there. Bill McElhaney, property owner at 214 St. James West, stated that there are a lot of accidents in the area due to people not following the speed limit traveling south on South Walnut. Mr. McElhaney added that the property for rezoning would be a hazard for anyone pulling out of that driveway and that he was opposed to the rezoning request. Elaine Morgan asked the Planning Commission to postpone action for legal consultation. Jim Stafne stated that this rezoning does not go along with the long range plans for the City and he ask for a motion to stop the debate. Leslie Sullins Draper made a motion to end the debate. Eric Walker seconded the motion and the motion carried unanimously. MOTION TO END THE DEBATE. The Planning staff did not see a need to postpone action on this item. Leslie Sullins Draper made the motion to deny the rezoning request since the Future Land Use Concept Plan primarily depicts this area as best suited for mixed density residential development. Kay Starkweather seconded the motion and the motion carried unanimously. REZONING REQUEST DENIED. James Mills stated the Alana Morgan had the right to appeal the decision to the City Council within 30 days of this meeting. Mr.Mills added that if Mrs. Morgan submits and appeal, then a sign will be posted on the property, but the surrounding property owners would not be notified. COOKEVILLE PLANNING COMMISSION 4 JANUARY 28, 2019 CONSIDER FOR ACTION A VARIANCE TO AMEND THE FINAL PLAT OF THE REVISION OF LOT 2 OF THE THOMAS RANDOLPH DIVISION TO ALLOW THE INSTALLATION OF A RESIDENTIAL SPRINKLER SYSTEM IN LIEU OF THE INSTALLATION OF A FIRE HYDRANT IN ORDER TO CONSTRUCT A SINGLE FAMILY HOUSE ON LOT 1. REQUEST SUBMITTED BY TOMMY RANDOLPH. James Mills stated that Mr. Tommy Randolph has submitted a request for a variance to waive a requirement established as condition for the approval of the Final Plat of the Revision of Lot 2 of the Thomas Randolph Division. The Final Plat of the Revision of Lot 2 of the Thomas Randolph Division was conditionally approved by the Planning Commission at its June 27, 2016 meeting. The division created two (2) lots with one of the lots having an existing single family home. The parcels are zoned as RS-20, Single Family Residential. The approval also included a variance to allow the creation of a flag lot. The approval was subject to any corrections to the final plat as determined necessary by the Planning or other city department. Following Planning Commission approval it was determined by the Fire Department that the existing fire hydrant depicted on the plat was located on a four (4) inch water line and did not have adequate pressure for fire protection. The Final Plat was recorded with a restriction that no building permit would be issued for Lot 1 until adequate fire protection was provided in compliance with the City of Cookeville Subdivision Regulations. The subject property is located in the Double Springs Water Service Utility District. The area was annexed by the City in 2002 and the Plan of Services specifies that the Cookeville Water Department will complete necessary improvements to the water system, including the provision of fire hydrants, once it has acquired the service area from the utility district. The city has not yet acquired the service area and there is no specific timetable for doing so. Until such time as the system is upgraded no hydrant can be provided. Mr. Randolph has offered to require that any dwelling built on Lot 1 be constructed with a residential sprinkler system in lieu of the provision of a fire hydrant. While some communities, including Putnam County, have provisions in their Subdivision Regulations to allow the use of sprinkler systems in lieu of the provision of fire hydrants, the City of Cookeville does not. A variance must be approved to vary the requirements for fire protection. Cookeville Fire Chief Daryl Blair has indicated that he would approve the use of a sprinkler system in lieu of the provision of a fire hydrant due to inadequate water supply. Staff recommended approval of the variance request subject to the submittal of a revised Final Plat meeting the conditions established when originally approved and to the requirement for a residential sprinkler system. Tommy Randolph stated that he was cutting off the lot for his son to live there. Kay Starkweather COOKEVILLE PLANNING COMMISSION 5 JANUARY 28, 2019 seconded the motion and the motion carried unanimously. CONDITIONAL APPROVAL. CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE COTTAGES, 49 LOTS LOCATED OFF MCCULLEY ROAD & SPRINGBORO ROAD. REQUEST SUBMITTED BY TIM HUDDLESTON. James Mills stated that Mr. Tim Huddleston has submitted a request for a second six (6) month extension of The Cottages Subdivision Preliminary Plat, which is a 49 lot single family detached residential subdivision located off of McCulley Road and Springboro Road. The current Preliminary Plat was granted a six (6) month extension by the Planning Commission on July 23, 2018. The initial preliminary plat of the development was approved on July 26, 2010. As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, an extension of time can be applied for by the developer and granted by the Planning Commission provided a $50.00 fee is submitted with the request. Mr. Huddleston submitted the fee with his request for an extension. Limited grading work has been done on the site and no changes been made to the plat since the most recent preliminary plat was approved. Staff recommended approval of a six (6) month extension of the Preliminary Plat as requested. Keith Morrison, property owner at 577 Rockwell Drive, stated that stormwater has been a problem since Mr. Huddleston started moving dirt and that his basement was recently flooded, and that Mr. Huddleston paid for the damage. Mr. Morrison would concerned about future flooding and he would like for the City to look at the stormwater issues in the area. Tracy Cody made the motion to approve the six (6) month extension of the Preliminary Plat of The Cottages. Jim Cobb seconded the motion and the motion carried unanimously. APPROVED SIX (6) MONTH EXTENSION. CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE PRELIMINARY PLAT OF THE JOHNNY HAMMOCK DIVISION, 16 LOTS LOCATED OFF HUDDLESTON DRIVE. REQUEST SUBMITTED BY LAUREN SHIBAKOV ON BEHALF OF JOHNNY HAMMOCK. James Mills stated that Mr. Johnny Hammock has submitted a request for a second six (6) month extension of the Preliminary Plat for his Johnny Hammock Division, which is a 16 lot single family residential subdivision located off of Huddleston Drive. The Preliminary Plat was initially approved by the Planning Commission on July 21, 2015 for a period of one year. Since that time, multiple extension requests have been submitted and approved by the Planning Commission the most recent being on July 23, 2018. As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, an extension of time can be applied for by the developer and granted by the Planning Commission provided a $50.00 fee is submitted with the request. Mr. Hammock submitted the fee with his request for an extension. No work has begun to install improvements on COOKEVILLE PLANNING COMMISSION 6 JANUARY 28, 2019 the site, nor have any changes been made to the plat since the most recent preliminary plat was approved. Staff recommended approval of the request for a six (6) month extension of the Preliminary Plat as requested. Jim Cobb made the motion to approve the six (6) month extension of the Preliminary Plat of the Johnny Hammock Division. Kay Starkweather seconded the motion and the motion carried unanimously. APPROVED SIX (6) MONTH EXTENSION. CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE PRELIMINARY PRD PLAN/PLAT OF THE AERIE, 1 LOT LOCATED ON WEST 9TH STREET AND NORTH FRANKLIN AVENUE. REQUEST SUBMITTED BY JUSTIN CUMBY ON BEHALF OF TITAN DEVELOPMENT. James Mills stated that Mr. Justin Cumby, on behalf of Titan Development, LLC has submitted a request for a final six (6) month extension of the Preliminary PRD Plan/Plat of The Aerie. The Aerie is a proposed Planned Residential Development located on West 9th Street and North Franklin Avenue on Parcels 1.00 and 2.00, Tax Map 40I, Group D. The Preliminary PRD, as approved by the Planning Commission at its November 27, 2017 meeting, depicts the construction of a student housing complex consisting of 160 dwelling units with a total of 412 bedrooms. The Cookeville City Council, through Ordinance Number O17-12-24, approved the rezoning to PRD for the development at its January 18, 2018 meeting. Said Ordinance became effective 14 days after adoption (February 1, 2018). Section 218.17B(6) of the Zoning Code provides that the Preliminary PRD Plan will expire six (6) months after the effective date of the rezoning action of the City Council, if no Final PRD Plan has been submitted to and approved by the Planning Commission. This same section provides that extensions, totaling no more than 18 months after the effective date of rezoning action by the City Council, may be granted by the Planning Commission upon written request by the developer. Using the effective date of February 1, 2018 placed the original expiration date of the Preliminary PRD as August 1, 2018. A six (6) month extension of the Preliminary PRD was approved by the Planning Commission in May of 2018 extending the time period for submittal of the Final PRD to February 1, 2019. Mr. Cumby has now submitted a request for a second and final six (6) month extension of the approval of the Preliminary PRD Plan. He has informed the Planning Department that due to inclement weather and other reasons that it he would not be able to have the Final PRD Plan ready for submittal to the Planning Commission for its January, 2019 meeting. Approval of the request would extend the time period for the submittal of the Final PRD Plan to August 1, 2019, which means it would have to be submitted by the July 2019 meeting. Staff recommended approval of final six (6) month extension of the Preliminary PRD Plan for The Aerie subject to the same conditions as previously established by the Planning Commission and City Council. COOKEVILLE PLANNING COMMISSION 7 JANUARY 28, 2019 Leslie Sullins Draper made the motion to approve the final six (6) month extension of the Preliminary PRD Plan for The Aerie subject to the same conditions as previously established by the Planning Commission and City Council. Eric Walker seconded the motion and the motion carried unanimously. APPROVED FINAL SIX (6) MONTH EXTENSION, SUBJECT TO THE SAME CONDITIONS AS PREVIOUSLY ESTABLISHED. CONSIDER FOR ACTION PRELIMINARY PLAT OF CLAREMONT SUBDIVISION, 12 LOTS LOCATED AT 507 WEST STEVENS STREET. REQUEST SUBMITTED BY BERNHARDT CONSTRUCTION. THE DEVELOPER REQUESTED THAT THE STUDY PERIOD BE WAIVED. WAIVING THE STUDY PERIOD REQUIRES THE APPROVAL OF THE PLANNING COMMISSION. James Mills stated that Mr. Aaron Bernhardt has submitted for approval a Preliminary Plat of Claremont Subdivision, a 12 lot single family attached development of his property located on West Stevens Street. The subject property is identified on Tax Map 53I, Group A, as Parcel 15.00 and contains approximately 0.88 acres. The property is zoned RM-14, Multi-family Residential as are the adjacent properties to the east, west and northwest. The remaining property to the north of the site is zoned CL, Local Commercial. Section 216.3 of the Zoning Code stipulates that single family attached dwellings (townhouses) are allowed in the RM-14 zone as a use permitted on review, subject to the submission of a plat in accordance with the Cookeville Subdivision Regulations. The development consists of ten (10) single family attached building lots and the construction of a private street with four (4) foot wide interior sidewalks and installation of utilities. The plat also depicts a new five (5) foot wide public sidewalk that will be constructed along the West Stevens Street frontage, however, due to consideration of possible widening of West Stevens Street the Public Works Director recommends that the developer pay $4,389.00 into the sidewalk fund in lieu of construction. Lot 11 will contain an existing single-family dwelling at 507 West Stevens Street and Lot 12 is the remaining common area and is not a building lot. A currently unnamed private street is proposed for access for the townhouses. The new street profile must be added to the plat showing the proposed extruded curbing and a four (4) foot wide sidewalk along one side. The developers must submit drainage and street construction plans to the Public Works Department. Water service will connect to the existing six (6) inch water line located in the right-of-way of West Stevens Street and the lots will be served by either a master meter or individual meters set near the street right-of-way with the determination to be made whether the water is to be public or private. Private sewer will connect to the existing eight (8) inch gravity sewer line also located within the street right-of-way. The developers must submit state approved water and sewer plans to the Department of Water Quality Control for review and approval prior to construction. There is one (1) existing hydrant located approximately 115 feet to the east in the right-of-way of West Stevens Street and the dwelling units will have sprinkler systems. The developer has advised that Clinton Engineering is in the COOKEVILLE PLANNING COMMISSION 8 JANUARY 28, 2019 process of preparing all required engineering plans for the development including detention areas. Public Works has advised the developer that a concrete apron must be constructed at the proposed entrance off West Stevens Street and that a turnaround must be provided on the site to accommodate vehicular access and movement. Individual receptacles will be utilized for trash pickup. All common areas, streets, sewer and other infrastructure improvements are private and will be maintained via a Homeowner Association Agreement that will be required upon final plat recording. No portion of the subject property is located in a Special Flood Hazard Area according to the Flood Insurance Rate Maps for the area, nor are there indications of Sinkhole Retention Areas according to the available GIS data. Staff recommended conditional approval of the Preliminary Plat subject to the following: • Developer shall schedule and attend a pre-construction meeting with all the appropriate city departments, • Developer understands and agrees that all right-of-ways must be cleared prior to installation of utilities, • Developer must submit a street plan and profile with storm sewer details to the Department of Public Works for all new streets. Plan shall include typical road section, subgrade, base width and asphalt width, • Developer shall submit a Storm Water Pollution Prevention Plan (SWPPP) to the Department of Public Works, • Developer must submit state approved water and sewer plans to the Water Quality Control Department, • Developer must work with Public Works to make arrangements for trash pickup, • Developer shall submit plans for the installation of underground electric per the Electric Department design requirements , • Developer to provide all conduit for underground communications facilities, CAD files and electrical layout plan to Frontier Communications, • Developer shall provide all utility easements as required by the Electric and Water Quality Control Departments, and • Completion of corrections or additions to the plat as determined necessary by the Planning Department and/or other appropriate city departments. CONSIDER FOR ACTION PRELIMINARY PLAT OF WESTVIEW SUBDIVISION, 4 LOTS LOCATED AT 620 HUGHES STREET. REQUEST SUBMITTED BY BERNHARDT CONSTRUCTION. THE DEVELOPER REQUESTED THAT THE STUDY PERIOD BE WAIVED. WAIVING THE STUDY PERIOD REQUIRES THE APPROVAL OF THE PLANNING COMMISSION. James Mills stated that Mr. Aaron Bernhardt has submitted for approval a Preliminary Plat of Westview Subdivision, a four (4) lot single family attached COOKEVILLE PLANNING COMMISSION 9 JANUARY 28, 2019 development of his property located on Hughes Street adjacent to Stevens Point townhouses. The subject property is identified on Tax Map 53I, Group A, as Parcel 8.00 and contains approximately 0.25 acres. The property is zoned RM-14, Multi-family Residential as are all the adjacent properties. Section 216.3 of the Zoning Code stipulates that single family attached dwellings (townhouses) are allowed in the RM-14 zone as a use permitted on review, subject to the submission of a plat in accordance with the Cookeville Subdivision Regulations.
