COOKEVILLE PLANNING COMMISSION
MINUTES
AUGUST 23RD, 2021
The Cookeville Planning Commission met on Monday, August 23rd, 2021, at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.
MEMBERS PRESENT: Jim Cobb, Chad Gilbert, Judy Jennings, Jim Stafne, Eric Walker & Jim
Woodford.
MEMBERS ABSENT: Lauren Metts, Kay Starkweather & Leslie Sullins.
STAFF MEMBERS PRESENT: Jon Ward, Ken Young, Christopher Phillips & Haley Dickson.
STAFF MEMBERS ABSENT: James Mills.
OTHERS PRESENT: Aaron Bernhardt, Betsy Scarisbrick & Lindsay Pride
ESTABLISHMENT OF QUORUM: Chairman Stafne announced that a quorum was present for
the meeting.
CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Jim Cobb made the motion
to approve the agenda as submitted. Eric Walker seconded the motion and the motion carried
unanimously. APPROVED.
CONSIDER FOR APPROVAL THE MINUTES OF JULY 26TH, 2021. Jim Woodford made
the motion to approve the minutes of July 26th, 2021. Chad Gilbert seconded the motion and the
motion carried unanimously. APPROVED.
CONSIDER FOR ACTION THE PRELIMINARY PLAT OF ENCORE SUBDIVISION, SIX
(6) LOTS LOCATED ON EAST 10TH STREET. REQUEST SUBMITTED BY CAPITAL
COMMUNITIES, LLC. DEVELOPER HAS REQUESTED THIS ITEM BE POSTPONED
UNTIL THE SEPTEMBER 27TH PLANNING COMMISSION MEETING. Jon Ward stated
that the developer has requested that this item be postponed until the September 27th, 2021 Planning
Commission meeting. Jim Woodford made the motion to approve the postponement request. Jim
Cobb seconded the motion and the motion carried unanimously. APPROVED.
CONSIDER FOR ACTION RESUBMISSION OF PRELIMINARY PLAT OF
WESTBROOK FARMS PHASE II, 30 SINGLE-FAMILY DETACHED LOTS LOCATED
OFF CORA ROAD. REQUEST SUBMITTED BY HAROLD BROWN ON BEHALF OF
ERB PROPERTIES. Jon Ward stated that Mr. Harold Brown with ERB Properties has
resubmitted his Westbrook Farms Preliminary Plat, which is a 30-lot single family detached
subdivision located off of Cora Road. The Preliminary Plat was approved by the Planning Commission
on July 22, 2019 for a period of one (1) year. A six (6) month extension was granted by the Planning
Commission on July 27, 2020. A second six (6) month extension was granted by the Planning
Commission on January 25, 2021.
Analysis: As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, up
to two (2) six (6) month extensions can be applied for by the developer and granted by the Planning
Commission. After the expiration of the second six (6) month extension, resubmittal of the plat is
required to continue the project. No work has begun to install improvements on the site, nor have
any changes been made to the plat since the preliminary plat was approved.
Recommendation: Approval of the resubmission of the preliminary plat subject to all conditions
as established by the Planning Commission on July 22, 2019.

CONSIDER FOR ACTION RESUBMISSION OF PRELIMINARY PLAT OF LANDMARK
COURT, 20 SINGLE-FAMILY ATTACHED LOTS LOCATED ON EAST 10TH STREET.
REQUEST SUBMITTED BY JERRY GAW. Jon Ward stated that Mr. Jerry Gaw and Mr. Aaron
Bernhardt have resubmitted their Landmark Court Preliminary Plat, which is a 19-lot single family
attached subdivision located off East 10th Street. A resubmitted Preliminary Plat was approved by
the Planning Commission on August 26, 2019 for a period of one (1) year. A six (6) month
extension was granted on August 24, 2020. A second six (6) month extension was granted by the
Planning Commission on February 22, 2021.
Analysis: As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, up
to two (2) six (6) month extensions can be applied for by the developer and granted by the Planning
Commission. After the expiration of the second six (6) month extension, resubmittal of the plat is
required to continue the project. A significant amount of work has occurred on the site and there
have been no changes made to the plat since the preliminary plat was reapproved in August 2019.
Recommendation: Approval of the resubmission of the Preliminary Plat subject to all
conditions as established by the Planning Commission on August 26, 2019.
Jim Woodford made the motion to approve the request submitted by staff. Eric Walker seconded
the motion and the motion carried unanimously. APPROVED.
CONSIDER FOR ACTION THE REZONING OF PROPERTY LOCATED ON SALEM
CHURCH ROAD AND ENGLAND DRIVE (TAX MAP 066 PARCEL 036.00) FROM CR
(REGIONAL COMMERCIAL) AND RS-15 (SINGLE-FAMILY RESIDENTIAL) TO CG
(GENERAL COMMERCIAL). REQUEST SUBMITTED BY AARON BERNHARDT. Jon
Ward stated that Mr. Aaron Bernhardt on behalf of property owner Terry Bullock, submitted a
request to rezone from RS15, Single Family Residential and CR, Regional Commercial to CG,
General Commercial property located on Salem Church Road and England Drive.
Analysis: The subject property is identified as Tax Map 066, Parcel 036.00 and consists of
approximately 13.82 acres. The entire rezoning area including right-of-way consists of
approximately 31.13 acres. The property is bordered by CR, Regional Commercial to the south,
CR and RS15 Single Family Residential to the west, CR, Regional Commercial to the north and CR
Regional Commercial and RS20 Single Family Residential to the east. The parcel is split by
England Drive. The northern portion of the property borders Salem Church Road to the west and
England Drive to the south. the southern portion borders England Drive along the northern and
western boundaries and Interstate 40 right-of-way to the south. The entire parcel borders Highway
111 to the east. The application was submitted to allow for single-family attached townhome
residential development of the property.
The area located north of England Drive is split zoned with a portion zoned RS15, Single Family
Residential, and a portion zoned CR, Regional Commercial. The area located south of England
Drive is zoned CR, Regional Commercial. The RS15 District is intended to provide a low density
single-family residential environment in areas where public wastewater services are available, and
the CR District is intended for medium to large-scale commercial operations of a predominately
regional nature. The CG District is intended for moderate and larger sized offices, personal and
business services, and general retail business. The maximum square footage of individual
developments is restricted to 120,000 square feet. It is the intent of this district to promote the
clustering and development of commercial facilities that are directly dependent on transient
patronage or draw users from an area beyond the immediate environs of the city. Higher density

residential development, including single-family attached (townhomes), is permitted upon review
by the Planning Commission in the CG General Commercial Zoning District. The rezoning request
would be an up zoning of the existing RS15 portion and a downzoning of the CR portion.
The Future Land Use Concept Plan element of the Cookeville 2030 Plan depicts this area as best
suited for regional commercial development. The CG, General Commercial District is compliant
with the Future Land Use Plan. The area located south of England Drive is encumbered with a
TVA utility easement along the northern portion of the property. Both areas north and south have
sections of property with challenging topography. The Water Quality Control Department has
approved a sewer service availability request, confirming capacity for 100 townhomes on the
parcel. In the single-family zoned area located west of Salem Church Road are three (3) existing
single-family homes. Townhome development would provide a buffer area between the limited
access Highway 111 and the existing single-family residential area to the west.
Recommendation: Approval of the rezoning request.
Jon Ward stated that the Planning Department has reviewed the road classification and Salem
Church Road is intended to support commercial development.
Jim Stafne asked if anyone had contacted the Planning Department regarding the townhome
development.
Jon Ward stated that letters were sent out to the homeowners near the development and there have
been no phone calls regarding this development.
Aaron Bernhardt stated that the neighbors to the property are the ones selling the property. He has
spoken to the owners through the realtors and the property owners are aware of his development
intentions. Mr. Bernhardt stated that he is wanting to do a U-shaped development where all access
will be off of England Drive as it is easy access to Highway 111 and closer to town. He stated that
there is no need to reopen the road as there will be two (2) access cuts on England Drive. He wants
to leave the trees bordering the development so there will be no access onto Salem Church Road.
Jon Ward stated that Salem Church Road would need major engineering and grading in order for it
to be reopened.
Eric Walker stated that the land is suitable for commercial development and the rezoning to General
Commercial would require the Planning Department to look at reopening Salem Church Road. Mr.
Walker stated that both roads are classified as a local street and asked if the road would need to be
reclassified before the plat is recorded.
Jon Ward stated that the road was never reclassified when Salem Church Road was closed. The
Planning Commission would need to amend the Major Street Plan to reclassify the street if the
property is rezoned to General Commercial.
Jim Cobb stated that in Section 2 of Ordinance O01-12-17 that closed Salem Church Road stated
that access for emergency vehicles is required. The road doesn’t seem to meet those standards and
would need to be looked at.
Jon Ward stated that in order for Salem Church Road to reopen, the City Council would hold a
public hearing and notify all residents on the road.
Eric Walker made the motion to approve the request submitted by staff and add the
recommendation that the Planning Commission study the road connection between Salem Church
Road and England Drive. Jim Cobb seconded the motion and the motion carried unanimously.

(Single-Family Residential) to CG (General Commercial). Request submitted by Aaron
Bernhardt.
Jim Cobb made the motion to approve the request submitted by staff. Jim Woodford seconded the
motion and the motion carried unanimously. APPROVED.
