August 26th, 2024
The Cookeville Planning Commission met on Monday, August 26th, 2024, at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.
Members Present: Councilman Ali Bagci, Jim Cobb, Bob Faulhaber, Jason Fowler, Judy Jennings,
Mallie Rogers, Kay Starkweather & Jim Woodford.
Members Absent: Lauren Metts.
Staff Members Present: Christopher Phillips, Jon Ward & Haley Dickson & Ken Young.
Staff Members Absent: James Mills & Matt Billings.
Others Present: Ken Matheney & Nathaniel Wolffe.
Establishment of Quorum: Chairman Woodford announced that a quorum was present for the
meeting.
Consider for Approval the Agenda as Submitted. Kay Starkweather made the motion to approve
the agenda as submitted. Jim Cobb seconded the motion and the motion carried unanimously.
Approved.
Consider for Approval the Minutes of July 22nd, 2024. Jim Cobb made the motion to approve the
minutes of July 22nd, 2024. Kay Starkweather seconded the motion and the motion carried
unanimously. Approved.
Consent Agenda:
All matters listed under the Consent Agenda are considered to be routine and will be enacted by one
motion. There will be no separate discussion of these items unless a Planning Commission member
so requests, in which case the item will be removed from the Consent Agenda and considered
separately. Additionally, any citizen or agenda applicant may request that consideration be given by
the Planning Commission to remove any item from the Consent Agenda so that discussion may be
held on the item.
a. Consider the resubmission of Saxony Phase IV Preliminary Plat, 123 lots located on East
Spring Street (Tax Map 053-L, Group C, Parcel 017.01). Request submitted by Gary McNabb.
b. Consider the six-month extension of the preliminary plat of The Reserve at the Country Club.
Phase VI, 31 lots located on Couples Drive and Nicholas Avenue (Tax Map 041 portion of
parcel 027.00). Request submitted by Tom Sergio with Design Development of TN, LLC.
c. Consider the six-month extension of the preliminary plat of Lone Oak Townhomes, 15 lots
located on Lone Oak Drive (Tax Map 066-A, Group A, Parcel 010.00). Request submitted by
Chris Shah.
d. Consider the six-month extension of the preliminary plat of Glenview Phase II, 32 lots located
on Glenview Drive (Tax Map 066-A, Group A, Parcel 009.00). Request submitted by Aaron
Bernhardt.
e. Consider the six-month extension of the preliminary plat of the Mahler-Walnut Townhomes,
five (5) lots located on North Walnut Avenue and Mahler Avenue (Tax Map 053-B, Group H,
Parcel 009.00). Request submitted by Jack Lynn.
Recommendation: Approval of the Consent Agenda.
Councilman Ali Bagci made the motion to approve the request recommended by staff. Kay
Starkweather seconded the motion, and the motion was carried unanimously. Approved.

Consider for action the preliminary plat of Conexus Park Subdivision, 28 lots located on Old
Sparta Road, South Jefferson Avenue & River Bluff Road (Tax Map 096, Parcel 078.04).
Request submitted by Raj Patel. Mr. Jon Ward stated that Mr. Raj Patel has submitted for approval
the preliminary plat of Conexus Park Subdivision, a 28-lot single-family attached development
located on Old Sparta Road, South Jefferson Avenue, and River Bluff Road.
Analysis: The subject property is identified as Parcel 078.04 on Tax Map 096 and contains
approximately 2.76 acres. The property is zoned CL, “Local Commercial” as are the adjacent
properties to the north and south. The property is bordered by RS-20, “Single-Family Residential”
to the east and west.
The plat depicts 27 single-family attached townhomes. Lot 28 is common area and not a buildable
lot. Two (2) ingress/egress points are depicted from Old Sparta Road and one ingress/egress point is
depicted from South Jefferson Avenue. Sidewalks will be required along all public street frontage,
an in-lieu of fee or waiver can be requested.
A plat review meeting was held on August 13, 2024. All relevant city departments were present and
provided comments for conditional approval.
Recommendation: Conditional approval of the preliminary plat subject to the following:
Fire hydrant to be installed, per Cookeville Fire Department
Adjacent zoning to be added to the plat, per Planning Division
Sidewalks required along all street frontage (in-lieu of fee or waiver can be requested)
Provide storm drainage system plan showing existing and proposed features, culverts,
drainpipes, structures, filtration, and ponds, per Public Works
Provide a landscape plan, per Public Works
CAP Form and Fee to be submitted to Water Quality Control
Proposed water and sewer to be shown on plat, per Water Quality Control
Water Quality Control requests a 20-foot easement
Preconstruction meeting to be held with all relevant city departments
Completion of corrections and/or additions to the plat as determined necessary by Planning
and/or other appropriate city departments
Jim Cobb made the motion to approve the request recommended by staff. Councilman Bagci
seconded the motion, and the motion was carried unanimously. Approved.
Consider for action the preliminary plat of Big Oak Tree Commons, 101 lots located on South
Jefferson Avenue & Old Sparta Road (Tax Map 096, Parcel 057.01). Request submitted by
Burnett Properties, LLC. The developer has requested this plat be postponed to the September
23, 2024, meeting.
Kay Starkweather made the motion to approve the request to postpone the request. Councilman
Bagci seconded the motion, and the motion was carried unanimously. Postponed.
Consider for action the preliminary plat of Windle Subdivision, three (3) lots located on West
Broad Street (Tax Map 054-D, Group A, Parcel 027.00). Request submitted by David M.
Windle. The Developer has requested this plat be withdrawn from Planning Commission
consideration.

Councilman Bagci made the motion to approve the request to withdraw the plat from consideration.
Kay Starkweather seconded the motion, and the motion was carried unanimously. Withdrawn.
Review of recommended amendments to the Zoning Code relative to defining Truck Stops,
Automobile and Truck Fuel Centers, and Gasoline and Motor Fuel – Retail, and to allow
Automobile and Truck Fuel Centers in the CI, “Commercial-Industrial Mixed Use” Zoning
District as a use permitted by right. Request submitted by Staff. Jon Ward stated that the
Planning Commission recommended amendments to the Zoning Code relative to defining truck
stops, automobile and truck fuel centers and gasoline and motor fuel – retail and allowing automobile
and truck fuel centers in the CI, Commercial-Industrial Mixed-Use District at the July 22nd, 2024,
meeting. The City Council has set-a-date for September 5th, 2024, to consider the amendments.
Analysis: The Planning Commission discussed some concerns with proposed definitions relative
to diesel fuel. Diesel is utilized by some passenger vehicle and is available at many automobile fuel
centers that are not intended to provide fueling service for long-haul trucks. The Planning Division
has prepared some revisions to the definitions to include diesel fuel for automobile fuel stations, and
to provide clarification for truck as follows:
Gasoline and Motor Fuel – Retail: An establishment used for the retail sale and dispensing of
automotive and diesel fuel, oil, and accessories in connection therewith and for the self-servicing
of consumer and passenger vehicles, often with a small convenience store carrying a limited
selection of grocery and household items. The establishment may also include restaurants as a
secondary use.
Automotive and Truck Fuel – Retail: An establishment used for the retail sale and dispensing
of automotive and diesel fuel, oil, and accessories in connection and for the self-servicing of
passenger vehicles and commercial trucks, often with a small convenience store carrying a
limited selection of grocery and household items. On-site truck parking, overnight parking, truck
wash bays or garages are prohibited within an automobile and truck fuel establishment. The
establishment may also include restaurants as a secondary use.
Truck Stop: A site of more than two (2) acres providing specialized facilities for retail fueling
services for automobiles and long-haul trucks, often with a small convenience store carrying a
limited selection of grocery and household items. The use may include truck parking, overnight
truck parking, shower accommodations, sleeping quarters, servicing and repair facilities and
other facilities or services for large trucks. The establishment may also include restaurants as a
secondary use. Truck stops are built to accommodate the needs of truck drivers who might be on
the road for extended periods and require more extensive services than an automotive and truck
fuel – retail establishment.
Recommendation: Approval of the revised definitions.
Kay Starkweather made the motion to approve the request recommended by staff. Councilman Bagci
seconded the motion, and the motion was carried unanimously. Approved.
Consider a Resolution in support of a street improvement project on South Willow Avene and
submittal of the project to the Tennessee Department of Transportation’s Statewide
Partnership Program. Request submitted by Staff. Mr. Jon Ward stated that the Planning Staff
have prepared a Resolution in support of a street improvement project to be submitted to the
Tennessee Department of Transportation Statewide Partnership Program. The project will provide
improvements to South Willow Avenue (SR 135).

Analysis: The Statewide Partnership Program was enacted as a component of the Tennessee
Department of Transportation’s 10-Year Project Planning process as a means for municipalities and
local stakeholders to provide input on the priority of the projects they would like to see completed.
The program allows local authorities to maximize funding dollars for the most impactful projects to
their communities. TDOT states, “The SPP is primarily meant as a first step in the planning process
to gather data on local needs, priorities, and ability to partner with TDOT.” The process is meant to
serve as an “open enrollment” for projects to be considered for TDOT funding.
The City of Cookeville has identified multiple street improvement projects throughout the
municipality. City departments identified traffic congestion along South Willow Avenue (SR 135)
as a priority project for TDOT consideration. The proposed project includes the construction of a
dedicated right-turn lane from South Willow Avenue (SR 135) to Interstate Drive. The city has
continued to observe increased traffic congestion at this intersection and queuing at the westbound
off-ramp of Interstate 40 onto South Willow Avenue (SR 135).
The City Council approved the Resolution, R24-08-18 at the August 15th meeting, authorizing
submittal of the project to the Statewide Partnership Program and committing funding to the project.
Planning Staff have prepared a Resolution for consideration by the Planning Commission in support
of the project.
Recommendation: Approval of the Resolution.
Jim Cobb made the motion to approve the request recommended by staff. Councilman Bagci
seconded the motion, and the motion was carried unanimously. Approved.

(1) Consider for study rezoning property located on at 220 West 2nd Street & property located on
Montgomery Avenue (Tax Map 053-B, Group M, Parcels 010.00 & 012.01) from MS (Medical
Services) to CL (Local Commercial). Request submitted by Ray Wear on behalf of DEL
Properties.
Kay Starkweather made the motion to accept the above items for study. Councilman Bagci seconded
the motion, and the motion was carried unanimously. Approved.
