The City Council of the City of Coppell met in Regular Session on Tuesday, March 28, 2023, at 5:30 p.m. in the City Council Chambers of Town Center, 255 Parkway Boulevard, Coppell, Texas. 1. Call to Order Mayor Wes Mays called the meeting to order, determined that a quorum was present and convened into the Executive Session at 5:30 p.m. 2. Executive Session (Closed to the Public) 1st Floor Conference Room Section 551.071, Texas Government Code - Consultation with City Attorney. A. Seek legal advice from the City Attorney concerning the Spectrum Settlement. Discussed under Executive Session City of Coppell, Texas Page 1 City Council Minutes March 28, 2023 Section 551.072, Texas Government Code - Deliberation regarding Real Property. B. To deliberate the purchase, exchange, lease, or value of real property located north of Southwestern Boulevard and west of Denton Tap Road. Discussed under Executive Session 3. Work Session (Open to the Public) 1st Floor Conference Room Citizen comments will not be heard during Work Session, but will be heard during the Regular Session under Citizens' Appearance. Mayor Wes Mays adjourned the Executive Session at 6:42 p.m. and convened into the Work Session at 6:45 p.m. A. Discussion regarding agenda items. B. Discussion regarding the selection of Mayor Pro Tem. C. Discussion regarding the Stream Bank Restoration Loan Program. D. Discussion regarding future median designs. E. Receive a legislative update. Presented in Work Session Regular Session Mayor Wes Mays adjourned the Work Session at 7:24 p.m. and reconvened into the Regular Session at 7:33 p.m. 4. Invocation 7:30 p.m. Beth Kellner with the First United Methodist Church gave the invocation. 5. Pledge of Allegiance Mayor Wes Mays led the audience in the Pledge of Allegiance. Proclamation 6. Consider approval of a Proclamation designating the month of April as “Christian Family Month;” and authorizing the Mayor to sign. Mayor Wes Mays read the proclamation into the record and presented the same to Carmen Prince and the Allies Interfaith members. A motion was made by Councilmember Don Carroll, seconded by Councilmember Brianna Hinojosa-Smith, that this Agenda Item be approved. The motion passed by an unanimous vote. 7. Citizens’ Appearance Mayor Wes Mays asked for those who signed up to speak: 1) Barbara Bailey, 232 Plantation Drive, spoke in regards to curbs and City of Coppell, Texas Page 2 City Council Minutes March 28, 2023 sidewalks. 8. Consent Agenda A. Consider approval of minutes: February 28, 2023. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, that Consent Agenda Items A through E through be approved. The motion passed by an unanimous vote. B. Consider approval to purchase Microsoft Enterprise Licensing from SHI, DIR contract # DIR TSO-4092 in the amount of $270,513.15 as budgeted; and authorizing the City Manager to sign any necessary documents. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, that Consent Agenda Items A through E through be approved. The motion passed by an unanimous vote. C. Consider approval to purchase Nutanix Cloud Infrastructure from Unique Digital, A Converge Company, DIR contract # DIR TSO-4315 in the amount of $603,956.36 and available in the Enterprise Solutions Replacement Fund; and authorizing the City Manager to sign any necessary documents. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, that Consent Agenda Items A through E through be approved. The motion passed by an unanimous vote. D. Consider approval to purchase one (1) Interceptor Utility Hybrid from Silsbee Ford through TIPS #210907; for replacement of existing vehicle; in the amount of $58,209.64; as provided for in the Capital Replacement Fund; and authorizing the City Manager to sign any necessary documents. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, that Consent Agenda Items A through E through be approved. The motion passed by an unanimous vote. E. Consider approval to purchase three (3) pickup trucks from Caldwell Country Chevrolet through BuyBoard Purchasing Cooperative #601-19; for replacement of existing vehicles; in the total amount of $207,854.60; as provided for in the Capital Replacement Fund; and authorizing the City Manager to sign any necessary documents. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, that Consent Agenda Items A through E through be approved. The motion passed by an unanimous vote. PUBLIC HEARING: Consider approval of PD-295R3-HC, Starbucks Restaurant, a zoning change request from PD-295-HC (Planned Development-295-Highway Commercial) to PD-295R3-HC (Planned Development-295 Revision 3-Highway Commercial, to approve a Detail Site Plan for a Starbucks sit down/drive-thru restaurant on 0.76 acres of property, located on the south side of SH 121, between Freeport Parkway and Northwestern Drive, just northeast of the proposed Popeyes, at the request of Archway 121 Coppell, LTD, being represented by Clay Cristy of Claymoore Engineering. The requester has asked to withdraw the zoning change request; therefore no action was taken on this item. 10. CONTINUED PUBLIC HEARING: Consider approval of PD-295R2-HC, Popeyes Chicken Restaurant, a zoning change request from PD-295-HC (Planned Development-295-Highway Commercial) to PD-295R2-HC (Planned Development-295 Revision 2-Highway Commercial), to approve a Detail Site Plan for a Popeyes Chicken sit down/drive-thru restaurant, on 0.97 acres of property, located on the south side of SH 121, between Freeport Parkway and Northwestern Drive, just southwest of the proposed Starbucks., at the request of Archway 121 Coppell, LTD, being represented by Clay Cristy of Claymoore Engineering. Senior Planner Mary Paron-Boswell informed City Council that the requester has asked for a continuation of the Public Hearing to the April 11, 2023, City Council Meeting. Mayor Wes Mays opened the Public Hearing and stated that no one had signed up to speak. A motion was made by Councilmember Kevin Nevels, seconded by Councilmember Don Carroll, to continue the Public Hearing to the April 11, 2023, City Council meeting. The motion passed by an unanimous vote. 11. City Manager Reports - Project Updates and Future Agendas City Manager Mike Land gave the following updates regarding ongoing and future projects: The ribbon-cutting ceremony for the cricket pitch by Wagon Wheel Field 6 is next Tuesday, April 4th at 11AM. The address is 1001 Northpoint Drive. The Moore Road Boardwalk construction project is making progress. The Moore Road Pond has been de-watered and all wildlife have been relocated. Contractors are continuing to pour concrete on S. Belt Line Road. Beginning this week there will be panel replacement work on E. Sandy Lake Road. City of Coppell, Texas Page 4 City Council Minutes March 28, 2023 12. Mayor and Council Reports Report by Mayor and City Council on recent and upcoming events. In April of each year, the City holds a Town Hall meeting for the public. Staff presents their current projects and major projects planned for the upcoming fiscal year. During the Town Hall, residents are encouraged to ask questions and provide feedback on things that they would like the City to include in the budget. Join us for the Budget Town Hall scheduled for April 6th in Council Chambers at 7 p.m. Are you ready to vote in the upcoming May 6th local election? Make sure you register to vote by April 6th. Public Service Announcements concerning items of community interest with no Council action or deliberation permitted. Mayor Wes Mays spoke of the recent swearing-in ceremony for an officer in the Coppell Police Department. 15. Necessary Action from Executive Session A motion was made by Councilmember Mark Hill, seconded by Mayor Pro Tem Biju Mathew, to approve a settlement agreement by and among the City of Allen, et al and Spectrum Gulf Coast LLC, Cause No. 2018-3835-4, pending USDC in the Western District of Texas, whereby the cities have alleged an unpaid franchise and PEG fees based on unreported increase; the City of Coppell shall receive a net franchise fee of $40,000 over a ten year period; and authorize the City Manager to sign the appropriate settlement documents. The motion passed by an unanimous vote.
