Urquia, City Clerk City Commission Meeting Minutes April 21, 2020 The City Commission Meeting will be held as a VIRTUAL MEETING with elected officials and City staff participating through video conferencing. This virtual meeting will be held on the Zoom platform used by the City Clerk for live remote comments. Members of the public may join the meeting via Zoom at (https://zoom.us/j/3054466800). In addition, a dedicated phone line will be available so that any individual who does not wish (or is unable) to use Zoom may listen to and participate in the meeting by dialing: (305) 461-6769 Meeting ID: 3054466800. In addition, the public may comment on an item on the agenda using the City’s already established e-comment function which may be found on the City’s website at: (www.coralgables.com\commissionmeetings) or by sending an email to cityclerk@coralgables.com prior to the start of the meeting. The meeting will also be broadcasted live for members of the public to view on the City’s website (www.coralgables.com\cgtv) as well as Channel 77 on Comcast. Please note that Governor DeSantis’ Executive Order Number 20-69 suspended the requirements of Section 112.286, Florida Statutes, the Florida Sunshine Law, that a quorum to be present in person, and that a local government body meet at a specific public place. The Executive Order also allows local government bodies to utilize communications media technology, such as telephonic and video conferencing for local government body meetings. CITY CLERK ITEMS None City Clerk Item No. 34 K. DISCUSSION ITEMS Vice Mayor Lago: Yes, thank you, Mayor. I have a few. First off, as always, I’d like to thank staff, all our first responders, the two hospitals in the City of Coral Gables, Coral Gables Hospital, which I have the pleasure of sitting on the board, and Doctors Hospital. All of the employees of the City, the work that you guys are doing is phenomenal. Thank you so much for your outreach to the residents, especially those in most need. I just want to make sure that you understand, and you remember that we're grateful for your commitment to the residents and to the business community. I wanted to also just put it on the table and see if my colleagues will consider this. I think that maybe in our next meeting -- I'm not sure if we have decided yet to do another Zoom meeting or not. I'm seeing that other communities, other cities are moving in the direction of going back to regularly programmed Commission meetings, obviously respecting social distancing, finding areas which have the sufficient size so that we could hold a meeting, maybe a ballroom of some sort. I'm looking forward to going back and having these meetings in person. I just wanted to put that out there for the City Manager and City Attorney, for the Mayor to consider there’s an opportunity to it safely. Safely is the key, and not jeopardize any of the residents or employees, along with my colleagues. I also wanted to bring up the fact that we have several pending items from previous Commission meetings that have been put on the backburner, obviously, as a result of the COVID-19 pandemic. But I think that we should start including them on the Commission agenda starting in our next Commission meeting. For example, this meeting is possibly going to end before 12 o’clock, so I think we could have handled some of those items in this Commission meeting. And I hope that my colleagues will support me on that. I also want to know from the City Manager, the County Mayor detailed a very robust City of Coral Gables Page 18 City Commission Meeting Minutes April 21, 2020 phasing plan to rollout and to open Miami-Dade County. Obviously, a lot of the City falls under the auspice of Miami-Dade County’s decisions, especially like what was mentioned, the opening of the marinas and the parks. I really want to understand from the City who protocols are we going to be taking. What are we going to be putting in place to make sure that the businesses and the residents are protected? Like the nice lady mentioned before, making sure that people use PPEs, making sure that they use masks. So, I want to make sure that we have a plan in place once these marinas and parks do open up and the County takes that decision. And the final point -- I don't know if Mark Trowbridge is still on the line -- but I was giving it some thought and I wanted to see what my colleagues thought about potentially putting together a taskforce, a COVID-19 taskforce where we could potentially, you know, delineate and put together a group of individuals and entities that could provide guidance to the County; for example, hospitals, the Chamber, the BID, University of Miami, City, maybe some residents, or it can just be, you know, a group of individuals that can come up with ideas that not only deal with the issues at hand today, but that could be potentially be brought in to address issues in the future. I got this idea as a result of speaking with the City Manager and Chief De La Rosa, where they brought up on multiple occasions how beneficial the Blue-Ribbon Committee that I called for after the hurricane. And it was an opportunity where they were able to learn from private sector individuals and that played a role in how they addressed this COVID-19 pandemic. So, if any of my colleagues have an interest in putting together a taskforce, you know, it’ll be just -- we could put together professionals. They could meet by Zoom if they don’t want to meet in person, just to see how we can do things better, and also, how, in the next few months, we can make the rollout and the opening of government as easy and seamless as possible. Mayor Valdes-Fauli: Vice Mayor, let me address one of the points you mentioned… Vice Mayor Lago: Of course. City of Coral Gables Page 19 City Commission Meeting Minutes April 21, 2020 Mayor Valdes-Fauli: Is the opening. And I’ve discussed with the City Manager on this and the City Attorney about our opening. And we are not going to take the County or any other mayor or anyone’s word on whether it is safe to open Coral Gables. We have a very particular city, as somebody mentioned. I think it was Commissioner Mena. Eight hundred thousand people passing through Coral Gables a day. We have Miracle Mile. We have Giralda. We have the university. And we will take our own decision on when to open and when not to open, based on expert testimony, based on consultations as to when it is safe for Coral Gables to open our facilities and not take -- unfortunately, many times in this year, in this election year, these things are politicized and we -- I’m not going to fall into doing what other jurisdictions do. With the City Manager and the City Commission, we will take our - - make our own decisions based on expert testimony. So, you know, we will -- that is the answer to when we are going to open or not. Of course, we’re not going to keep things closed unnecessarily, but -- and our effort is to open everything as soon as possible, as soon as it is safely possible, then we will open it. Vice Mayor Lago: And I agree with you. But we also have to be cognizant of the fact that the County is going to make decisions and they're going to start opening up facilities, and a lot of those facilities are either located in Coral Gables or adjacent to Coral Gables. And I think that we need to be prepared for that, like we always are. But I think we need to, you know, make sure we're having those discussions about what are our plans to make sure that everybody's as safe as possible. So… Mayor Valdes-Fauli: And we’re having discussions, yeah, right. Vice Mayor Lago: So, in reference to what I mentioned, pending items, for next Commission meeting, I’d love to see whatever’s in the backburner be brought up. We could have our next meeting if anybody -- in a more open space. I think Zoom is City of Coral Gables Page 20 City Commission Meeting Minutes April 21, 2020 appropriate, but obviously, I think we can conduct business together as things get better. And if anybody's interested in putting together a taskforce, you know, please speak to the Manager. Your ideas are welcome. We're looking forward to, you know, finding a solution, which will hopefully support our businesses as they come back online, especially after this hiatus, so thank you. Commissioner Fors: I think… Mayor Valdes-Fauli: (INAUDIBLE) you’re required to have person-to-person meetings as opposed to Zoom. Zoom is very inefficient, and the City Attorney has warned us about quasi-judicial hearings and how different that they would be. However, I see that we have 99 people on this call. Ninety-nine people at six-foot distance, we would need the Youth Center baseball field in order to meet. I share your concern and I share your desire to have in-person meetings. And we will do everything possible with consultation with you, of course, in having live meetings versus Zoom meetings, but we need to be careful as to when to have it and how to have them. But I agree with you that they would be desirable. And as to bringing forth items that have been deferred, I concur with you that we should try to do that with the difficulties involved in quasi-judicial hearings, but I concur with you, and thank you for that suggestion. Commissioner Fors: And the -- Mayor, I just want to say that I think the taskforce is a good idea too. As Vice Mayor Lago is saying, appointment of one person from each organization and maybe even an appointment from each person of the Commission and the City Manager, maybe that gets too big, I don't know. Vice Mayor Lago: Yeah, the more, the merrier. At the end of day, I mean, we're trying to get some ideas from the private sector. I mean, they’re the front lines. They're dealing with this on a day-to-day basis. We want to make it as easy as possible for them to come back online, so… City Attorney Ramos: We can draft a resolution… Mayor Valdes-Fauli: Commissioner Fors. City Attorney Ramos: For next meeting establishing some sort of committee. We just need some input on the types of people that you think should be on there, so maybe just send that to us directly. Vice Mayor Lago: I think the -- and I want my colleagues to give their input on this. But I -- it's the stakeholder. The stakeholders -- for example, University of Miami, the largest employer in the City, you know, someone from the BID, someone from the Chamber, maybe two people from the Chamber, two from the BID, two from -- the City management appoint two individuals that they view as appropriate that have a significant background in regards to our downtown and our central business district. So, I leave it up to my colleagues. I’d like to have this resolution at the next Commission meeting, or -- if not before. And then we can start hopefully assigning people to this taskforce, and in the next month, hopefully get some recommendations so we can roll this out as quickly as possible. City of Coral Gables Page 22 City Commission Meeting Minutes April 21, 2020 Commissioner Fors: No. The only other thing I'd say is maybe get a medical professional on there too. Vice Mayor Lago: Yes, yes. Mayor Valdes-Fauli: Commissioner Keon, comments. Commissioner Keon: I would like to -- I hope everyone remembers that today -- tomorrow is Earth Day and all the things that’s happening all around us. We forget. We lose track of time and we forget. These are the (INAUDIBLE). It is Earth Day and it’s nice to be able to go outside and enjoy it. I have the information on the people from Key Biscayne (INAUDIBLE) for their program and who they contacted with and what their progress is. The issue I'd like to follow up on Commissioner Lago’s item on the opening up. It's my understanding that the expectations on the golf course (INAUDIBLE) open by the end of this week. Do we have -- you know, those within our City, we have Deering Bay. We have two private clubs. We have Deering Bay and we have Riviera. We have the public golf courses, Biltmore and Granada. So (INAUDIBLE), you know, we’re -- we have input into that decision, but I think they're looking to open up in the next week. And the other thing that they're looking to open up are the boat ramps. And the boat ramp at Matheson is an extremely popular boat ramp. And you know, even in normal weekends, there are, you know, problems along Old Cutler related to the traffic. And I’m sure once it opens right away, there’s going to be people that want to try and go back out on the water, you know, with their families, take their children fishing, (INAUDIBLE) whatever. So, those are the ones that I see affecting us, you know, the most, most immediately. So, to the Mayor, what is -- do we have a response on it? Do -- you know, is that a decision you make within the City? Mayor Valdes-Fauli: We make a decision on our Coral Gables facilities. And of City of Coral Gables Page 23 City Commission Meeting Minutes April 21, 2020 course, we will take into account what the County says, but remember we have a very particular city. And people do come and play at the Biltmore, people from other places. Biltmore, at Granada, private clubs are different. And with our 800,000 people passing through Coral Gables every day and what used to be a very active downtown. We will make our own decision based on our own facts and our own health statistics. Commissioner Keon: Okay. No, but all I'm asking is because I know that they are anticipating opening and if we’re not going to follow the County that we would, you know, make that decision and let them know. Mayor Valdes-Fauli: Correct. Vice Mayor Lago: Commissioner, that’s why I asked when I was giving my public comment… Commissioner Keon: Yeah. Vice Mayor Lago: To have… Commissioner Keon: Right. Vice Mayor Lago: To have a response because the Mayor, Carlos Gimenez, came out yesterday saying that marinas, golf courses are going to be coming online. If we’re going to deviate from that, you have to understand, like Matheson Hammock, Red Fish Grill, which is about to open after a complete remodel… Commissioner Keon: Right. City of Coral Gables Page 24 City Commission Meeting Minutes April 21, 2020 Vice Mayor Lago: Is adjacent in the heart of the City of Coral Gables. Commissioner Keon: Right. Vice Mayor Lago: That’s a County-run piece of property. So, it goes back to what Commissioner Mena said, what Commissioner Fors said. We're basically -- we have 51,000 residents where 700,000 people drive through our city every single day, some number to that magnitude. We need to be careful because if we're going to deviate from the County plan -- which again, I don't have any issues, like the Mayor said, as long as it makes sense -- we're going to have people coming into our city. Commissioner Keon: Right. Vice Mayor Lago: So, we need to be prepared for that. And the moment that these marinas open up, people are going to want to go out and at least enjoy themselves a little bit. Commissioner Keon: Right. Vice Mayor Lago: And that’s a problem. Commissioner Keon: I think they are already thinking that this will happen, you know, by the end of the week. So, you know, based on the information I got from the Golf Task Force that they expect that it’ll open the end of the week. I thought also from the parks. They’re talking about the marinas. So, I want that, you know, we -- before they actually open, you know, that you make that… Commissioner Mena: Well, can we… City of Coral Gables Page 25 City Commission Meeting Minutes April 21, 2020 Commissioner Keon: I would (INAUDIBLE) that you start (INAUDIBLE). City Manager Iglesias: If I may state that… Commissioner Keon: (INAUDIBLE) open up and then close down. City Manager Iglesias: If I may say that Mayor Gimenez did not give a date yesterday as to when that was going to happen. But we’ll be -- but we are currently looking at that with our Parks Department and with Police. And we will make the recommendations to the Mayor (INAUDIBLE) what’s best for us. Mayor Valdes-Fauli: Commissioner Mena, your comments. Commissioner Keon: Thank you. Commissioner Mena: Yeah. I just -- you know, I want to be careful that we don’t sort of talk in platitudes here. I think it’s --- okay, so we know the Mayor has said the golf courses are going to reopen. He has not given a date, the County Mayor. Let's talk about. If he gives a date of Friday, if he gives a date of next Friday, we’re on together right now and we don’t have another meeting at least at the moment until May 12. So, what’s the idea? I understand the notion of we're going to do what’s right for us, and we're not necessarily going to follow directly what the County does (INAUDIBLE) things about that. One is we already have an idea of what they're going to do, so we can discuss it now. But number two is, I think what we have forecasted to our community so far is that up until now, most of the -- or (INAUDIBLE) we have entered preventing or precluding certain types of behavior or closing certain places has for the most part been in lockstep with the County, with a few exceptions. So, I think people's anticipation is that when the County says, okay, we're opening the golf course -- reopening golf courses, for example, just to use that City of Coral Gables Page 26 City Commission Meeting Minutes April 21, 2020 example, that we're going to do the same. Now, we don't have to, but let's talk about it and let's make a decision now because if we're not going to have a meeting until May 12 -- we don't have to pick a date now, but once the County gives the date, is it our anticipation that we will be doing the same or not? Mayor Valdes-Fauli: Our inclination when the County gives a date is that we will look at it, and if it is good for Coral Gables, we’ll open it following with the County. Commissioner Mena: What does that mean exactly? Vice Mayor Lago: Yeah, but the -- and also, besides what does that mean, when do we… Mayor Valdes-Fauli: Expert testimony. Mr. City… City Manager Iglesias: Commissioner, we have an executive committee that meet that consists of the two chiefs, the Assistant City Manager (INAUDIBLE) and the City Attorney. And we look at every one of these items on a case-by-case basis. And we will look at what’s -- and for instance, in something like parks, we will (INAUDIBLE) meet with our Parks director and any other director that's involved in these facilities and come up with a -- with what is good for what we feel is something that we can police, that we can do and make those recommendations to the Mayor. The fact that we went with the County means if the County closes something, we have to close it. But we can be more strict than the County, which means that if they open, we don't necessarily have to open at that time. So, we will look at each one of these orders individually and make a recommendation as we have done throughout this whole process. This whole process has been a peer review process. We’ve gone through our committee. We’ve discussed all the issues with each order, and we’ve recommended to the Mayor what we think is required. Mayor has made the City of Coral Gables Page 27 City Commission Meeting Minutes April 21, 2020 decision. So, we will continue with that process that's worked very well so far. City Attorney Ramos: I just want to clarify that it's not a work -- it's not an actual committee. It's just the management of the City that consults… Unidentified Speaker: Yeah. City Attorney Ramos: Depending on what (INAUDIBLE). City Manager Iglesias: Let me… Mayor Valdes-Fauli: (INAUDIBLE). City Manager Iglesias: (INAUDIBLE) I may have misspoke for the City Attorney, but it is kind of an executive group that we meet and discuss all these -- every one of the issues that the County has come up with has been thoroughly discussed and thoroughly vetted, and we will continue to do so. Commissioner Mena: Well, let me just say that, you know, my only note on that would be, Mr. Manager, is let -- we need to be quick and clear in our communication if the County takes certain action to open certain things and we're not going to do the same thing. So, again, I’ll keep -- not to beat a dead horse, but I’ll keep talking golf courses. If County says we're opening our golf courses and the City of Coral Gables decides we are not, I think we need to very quickly and clearly communicate that and explain our reasons why. I don't -- this idea of testimony, I'm not really sure what sort of facts you would be looking at, at that point on a decision like that, but I think we need to be very clear in our communication. I'm speaking for myself now. I can't speak for my colleagues. I want to be very careful that it's a fine balance between being responsible in how we reopen things, but also in not over-policing people. At City of Coral Gables Page 28 City Commission Meeting Minutes April 21, 2020 some point, people have the right to be out and about and do certain things. Mayor Valdes-Fauli: Commissioner Mena. Commissioner Mena: And we have -- if I could finish. And we have to have to, you know, have protocols in place for dealing with that and enforcing certain regulations. But I, for one, for example, just to use another example that was just mentioned, I don't have a problem with people going out on their boat and doing that type of activity right now. I think it's a perfectly healthy and safe thing to do. Yeah, sure. Do we want a Columbus Day regatta out on the water? No, but that can be policed by Marine Patrol. If a family wants to go out fishing with, you know, a couple parents and their kids, they should have every right to do that. So, now let's talk about how do we regulate the actual marina so that you respect social distancing and you do it in a responsible fashion. But I just want to be clear that, at some point, we're going to have to come up with a responsible fashion to open those things and allow some amount of activity in a responsible manner. And not just say, hey, we're just going to keep everything closed. So, those are the issues that I think we need to be talking about and making decisions on. And I'm only raising them right now because we don't have another Commission meeting until May 12 and I just want to put that out there so that it’s food for thought for those who will be having meetings in the interim on that. City Manager Iglesias: And those are -- and Commissioner, those are issues that we looked at. Where is that (INAUDIBLE) and we need to (INAUDIBLE) that balance. And we have been nimble. For instance, where we did the actual curfew, we knew what was happening in the City of Miami and we acted extremely -- very, very quickly. So, we have -- we are aware of the deadlines, and we will certainly meet any of the requirements we have as far as being ahead of the County in what we're going to do and also create that balance between safety and (INAUDIBLE), City of Coral Gables Page 29 City Commission Meeting Minutes April 21, 2020 which really is what we’re leaning at. Commissioner Keon: Well, (INAUDIBLE)… Mayor Valdes-Fauli: Commissioner… Vice Mayor Lago: They’re way ahead of… Mayor Valdes-Fauli: Commissioner Mena, we are not going to be arbitrary. If you implied that we would possibly be arbitrary, I think you’re wrong. We have taken our decisions based on the advice of our emergency coordinator and Chief De La Rosa, our Police Chief, our City Manager, the doctors that we have hired, advice from the University of Miami, and that's how we will continue making decisions. We're not going to be arbitrary. We’re going to weigh our options. And yes, our intent, our desire is to open everything as quickly as possible to get people out on the water responsibly, to open the golf courses responsibly. And by that, I mean maybe limiting carts to one person per cart. We’re going to… Commissioner Keon: Mayor, they have… Mayor Valdes-Fauli: Wait, wait. Don’t interrupt me. Don’t interrupt me. Let me finish. I’ve let you finish with one exception with Commissioner Mena. I’ve let you finish. I think that we have behaved responsibly, and we will continue behaving responsibly given the advice of our experts and the people we have appointed, including our Fire Chief, our City Manager, our Police Chief, and our doctors. We will behave responsibly and with the objective of opening everything as quickly as possible. Commissioner Keon: Okay. Could I comment now? City of Coral Gables Page 30 City Commission Meeting Minutes April 21, 2020 Mayor Valdes-Fauli: Yes, you can. Commissioner Keon: They have all of those guidelines that you’re talking about. They are all… Commissioner Mena: Right. Commissioner Keon: They have guidelines for the marinas. They have guidelines for golf. They have them all in writing. So, all I ask is that we would take a look at them and either you’re comfortable with them and let things open and let people go do things, or you're not comfortable with them and have that conversation with the County. I think the County, as far as (INAUDIBLE) going through, looking (INAUDIBLE) that they put in place for those particular things that they are talking about opening rather soon. So, just look at (INAUDIBLE). They’re in place, they're there. We don’t need (INAUDIBLE) unless you think that there’s a real problem with them. They have them. It says one person to a cart, and it is (INAUDIBLE) distancing and it is, you know, how you -- that you -- you know, you can't touch any of the things on the golf (INAUDIBLE). They're going to remove the ball washing thing. They have all of that in place. I think they really have done a very, very good job and a very thorough job with their taskforce in looking at those areas. So, we should just look at them so we can -- when it comes time -- because people have asked, once the County opens, the Mayor, you know, gives the -- gives them the ability to open, are they still subject, you know, to the city. And I said, yes, I think that the City -- those things in the City that belong to the City are under the regulation of the City, will also -- you know, you’ll need the City to also (INAUDIBLE). I'm asking you to just look at what they’ve done and -- so you're prepared to, you know, either add to it or allow them. Because I think people -- if we can, if they can be out, they need to be out and they (INAUDIBLE). And we need to do it in a very safe City of Coral Gables Page 31 City Commission Meeting Minutes April 21, 2020 manner. Mayor Valdes-Fauli: I agree with you that we should look at the County regulations and County studies and we will do so, and we have always done so. I want to remind you, however, that this is very -- the golf course is a very important issue for golfers, one. Two, our responsibility in Coral Gables is to our residents and making it safe for them. And three, this is an election year and some people, not us, but some people are running for office and maybe that colors some of their decisions. Commissioner Keon: Absolutely. Mayor Valdes-Fauli: And I'm not going to be persuaded by decisions that may be motivated by that. We will be responsible, very responsible. We have appointed the right people, our emergency manager, our City Manager, our Police Chief, our Fire Chief, who is our emergency manager. We also have another emergency manager, an ex-fire chief with experience. We have 40 years’ experience or more in our two - - in our current fire chief and our former fire chief. And we will look at taking into consideration the County’s decisions and the County’s, you know, decision-making process. We will look at the issue, and we’ll open as quickly as we can, and we think it’s safe. Commissioner Keon: Okay. Mayor Valdes-Fauli: I think we’ll open as quickly as we can. Alright, no other comments… Government Affairs Manager Levi-Garcia: Mr. Mayor, if I may. It’s Naomi. Real quick, I just watched the Mayor’s town hall yesterday. It did seem to me that the recommendations for passive parks, marinas, and golf courses were fully formed. Timeline was not discussed, but it seemed like it was imminent, opening was imminent. And I also just want to mention that the Mayor’s “Safer at Home” order is set to expire April 30. So, if we had to guess, you know, when the -- what the timeline would be, I would say it would probably be around that time that we might see those facilities reopening. And of course, the City needs to make its own decisions in the best interest of its own residents. And I know those conversations are happening daily, but I just wanted to put that on you guys’ radar and let you know that I took copious notes during that town hall, and I'll be sending it to the City Manager, who I'm sure will forward it to the Commission so you all can review what was discussed. Mayor Valdes-Fauli: Thank you, Naomi. Please be aware and be conscious that Commissioner Mena said we want to open things as quickly as possible. And there are things, like the ramps for boats and everything that are very healthy, and we would like to open everything as quickly as possible, but we will do it in a responsible manner.
