City of Coralville Board of Adjustment Meeting June 17, 2013 Staff: Jim Kessler, Building & Zoning Official Dee Marshek, Administrative Assistant Item #1: Meeting called to order 6:00 PM Item #2: Member present: Wells, Szczech, Rice, Nicola and Boucher. Others present: Mr. & Mrs. Steve King and Aaron Larmore Item #3: Approval of March 18, 2013 Minutes. Motion to approve by: Nicola 2nd by: Wells Motion carried: 5-0 Item #4: Public Hearing request by Steve King and Aaron Larmore for a Conditional Use Permit to allow off-site parking in accordance to Section 165.35 (16) Parking & Traffic Standards for a Fitness/Training Facility to be located at 770 Quarry Rd in Coralville. Public Hearing Opened: Steve King: States that a 10 year lease is a requirement of this Conditional Use Permit for off-site parking. The problem with that is the City hasn’t said when the City will want to do a buyout of the area. Dan Shannon is the owner of the property to the south; the location of the off-site parking. At Dan’s age, he doesn’t want to get tied into a 10 year lease. There may be issues, if and when his children take possession of the property. King also expresses that he isn’t in favor of signing a 10 years lease either, in case the City would choose to proceed with a buyout. Kessler: Explains that originally this area was zoned I-2. The City put an overlay on this and changed the land use to commercial. To have a fitness center in an I-2 zone, a Conditional Use permit is required. But, the City is in the process of re- zoning this area to C-2. This is a City sponsored re-zoning, which doesn’t affect any business operating there now. Kessler states that the fitness center doesn’t need a conditional use permit to be located there; he now needs the conditional use permit for off-site parking. King: Explains the diagram included in the packet, stating that he owns 770 and 800 quarry Rd. The requested parking is located on Dan Shannon’s property behind his buildings. Shannon will give us a 3 year lease, with yearly renewals. Nicola: This would be year by year, up to 10 years? King: Yes, as long as Dan and or his children agree, he doesn’t see a problem with that. We have a 3 year lease for sure, unless the City would buy us out sooner. Boucher: Asks about the possibility of a City buyout? Kessler: The long range plan is to redevelop this entire area. The City is in the process of purchasing more land, some of which has been sold to the University of Iowa. Kessler’s suggestion is to stay in compliance with the zoning code. The fitness center use has to be tied to the lease of off-site parking in addition to length of the fitness center use being tied into the length of the lease for parking. Kessler states, as long as you have a lease in effect, the fitness center is good. Members discuss the future leases and parking possibilities that the City could be comfortable with. Boucher: Questions if there would be a possibility of signing a 10 year lease with the City for parking across the street at the Marriot’s south parking lot. Kessler: Not now, but that may be something that the City might consider in the future. Kessler and Larmore discuss the location of parking and number of spaces needed for the fitness center. Members consider appropriate verbiages for this approval. Public Hearing Opened: a) Consider approval of the Conditional Use Permit. Motion to approve this Conditional Use Permit, contingent on viable lease for parking by: Nicola Motion 2nd by: Wells Motion carried: 5-0 Item #5: Public Hearing request for an Appeal of a violation of the Code of Ordinance has been deferred to a later date.
