CITY COUNCIL
REGULAR MEETING
TUESDAY, MAY 8, 2018
1. The meeting was called to order at 7:40 p.m., and was opened with the Pledge of Allegiance.
Councilmembers present were Mayor Karen Sheek, Mayor Pro-tem Orly Lucero, Sue Betts, Ty
Keel, Mike Lavey, and Gary Noyes. Councilmember Jill Carlson was absent. Staff members
present were Director of Planning and Building Sam Proffer, Director of Parks and Recreation Dean
Palmquist, Director of Finance Kathi Moss, Grants and Special Projects Chris Burkett, Chief of
Police Roy Lane, Airport Manager Russ Machen, Management Intern Peyton Heitzman, City Clerk
Linda Smith, City Manager Shane Hale, and City Attorney Mike Green. There were five people in
the audience.
2. The Consent Agenda items acted upon by Council were as follows:
a. Approval of the Worksession and Regular Meeting Minutes of April 24, 2018.
b. Approval of the payment of the Expenditure Vouchers of May 8, 2018.
c. Approval of a renewal Hotel and Restaurant Liquor License for Thai Cortez LLC, DBA Thai
Cortez, located at 1430 East Main Street, Suites 1, 2, and 3, Cortez.
d. Approval of a renewal 3.2% Beer Retail Liquor License for Maverik Inc., DBA Maverik #497,
located at 455 State Street, Cortez.
e. Approval of a Special Event Permit for the Cortez Area Chamber of Commerce to sponsor
“Business After Hours” on Thursday, May 10, 2018, from 4:00 p.m. to 7:00 p.m., at Major
Mortgage, located at 106 North Sligo Street, Cortez.
Mayor Pro-tem Lucero moved that Council approve the Consent Agenda with the additional
expenditure list totaling $16,905.13. Councilmember Keel seconded the motion, and the vote was
as follows:

3. PRESENTATIONS
a. National Health Care Week Proclamation. Haley Leonard-Saunders, Marketing Public Relations
Director at Southwest Health Systems introduced Interim CEO Tony Sudduth. She stated that the
hospital has over 450 employees and has many other operations that run under one roof. She
thanked the community for their support during the many building projects and thanked Council for
proclaiming National Health Care Week May 6-12, 2018. Mayor Sheek read the National Health
Care Week Proclamation urging residents to express their appreciation for the people, facilities, and
technologies that make trustworthy, reliable health care possible in our community. Ms. Leonard-

Saunders stated that an open house would be held soon for portions of the building that are being
completed.
b. Historic Preservation Day Proclamation. Linda Towle, Vice-Chairperson of the Historic
Preservation Board, stated that this is the 9th year that the City will be hosting a Historic
Preservation Day and she spoke of the three historic walking tours that will be held in Cortez on
May 19, 2018. She encouraged interested citizens to sign up at the Cortez Cultural Center if they
would like to attend one of the tours. Mayor Sheek read the proclamation which proclaimed May
19, 2018, as Historic Preservation Day.

7. NEW BUSINESS
a. Letter of Comment from Essential Air Service to USDOT. Airport Manager Machen stated that
airline service in Cortez is subsidized by the U.S. Department of Transportation (USDOT) through
the Essential Air Service (EAS) program. He stated that Boutique Air has a contract that terminates
September 30, 2018, and USDOT requested bids for the service to Cortez receiving only one bid.
He stated that Boutique Air is still offering three round trips daily to Denver and one round trip
daily to Phoenix. He stated that a public forum was held on Monday, May 7, 2018, to receive
comments from the public on the airline service. He stated that Shawn Simpson, CEO of Boutique
Air, was in attendance at the meeting and addressed concerns including reliability issues and ticket
prices. Mr. Simpson spoke about advertising the service to Cortez in outlying communities.
Airport Manager Machen stated that Boutique Air has increased fuel sales at the airport during their
tenure which is a benefit to both the Airport and Cortez Flying Service. He stated that the extra
flights to Phoenix, beyond the former schedule provided by Great Lakes, made up for the reduced
landing fees per flight for the lighter aircraft used by Boutique Air. In answer to a question from
Councilmember Keel, Airport Manager Machen stated there may be additional flights to Cortez in
the future. Airport Manager Machen spoke about the goal of reaching 10,000 boardings for the
year as it would entitle the Cortez Airport to a one million dollar grant from the Federal Aviation
Administration.
Mayor Pro-tem Lucero moved that Council authorize the Mayor to sign the letter of public
comment regarding Boutique Air to the US Department of Transportation (USDOT), for the
provision of Essential Air Service to Cortez. Councilmember Betts seconded the motion, and the
vote was as follows:

b. 2018 Park and Golf Course Equipment Bid. Director of Parks and Recreation Palmquist stated
that bids were solicited for a high-speed, deep-tine aerification unit. He stated that due to the price

discrepancy between the two bids, staff asked the two bidders to bring their units to Cortez for a
demonstration on each unit. He stated that Potestio Brothers Equipment, Inc., was the only
responder that confirmed they would be at the demonstration. He stated that the Wiedenmann Terra
Spike XF 6 aerator performed exceptionally well and travelled at a speed of 2.8 miles per hour,
placing 8-inch holes in the ground in a 5-inch square pattern. He noted that aerating the parks and
golf course could be completed in less than half the time of the current aerator. He stated that after
extensive research, the Wiedenmann Terra Spike XF 6 aerator is felt to be a better product and will
serve the needs of the golf and parks divisions. He stated that staff recommends that the aerator be
awarded to Potestio Brothers Equipment, Inc. at the bid amount of $37,892.00. In answer to a
question from Councilmember Noyes, Director of Parks and Recreation Palmquist stated that the
aerator that the City is currently using will continue to be used. Councilmember Betts asked about
the warranty of the aerator and Director of Parks and Recreation Palmquist stated that the company
(Potestio Brothers Equipment, Inc.) is based out of Parker, Colorado, and would take care of any
warranty issues should there be any.
Councilmember Noyes moved that Council awarded the 2018 Park and Golf Course Equipment Bid
to Potestio Brothers Equipment, Inc., at the bid amount of $37,892.00 for the Wiedenmann Terra
Spike XF 6 aerator to be used by the Park and Golf Course Maintenance Divisions.

c. Ordinance No. 1253, Series 2018. City Attorney Green stated that Ordinance No. 1253, Series
2018, authorizes the City of Cortez to certify delinquent charges, assessments, or taxes to the
County Treasurer for collection as taxes. He stated that the ordinance authorizes placement of a
first and prior lien for charges, assessments or taxes by filing same with the County Clerk and
Recorder. He stated that by being first and prior, the City becomes senior to everybody else and the
City could actually foreclosure on their own. He stated that the original ordinance did not include
the word ‘taxes’ for some unknown reason and this ordinance is correcting the language.
Councilmember Keel moved that Council approve on first reading Ordinance No. 1253, Series
2018, authorizing the City of Cortez to certify delinquent charges, assessments, or taxes to the
County Treasurer for collection as taxes, and set for public hearing on May 22, 2018. Mayor Pro-
tem Lucero seconded the motion, and the vote was as follows:

12. CITY MANAGER’S REPORT
a. Clean Up Week. City Manager Hale noted that Clean Up Week begins Saturday, May 12, 2018,
with a drop-off station set up at the BMX Track parking lot. He stated that people wanting to drop
off items can come between 8:00 a.m. and 3:00 p.m. on May 12, 2018. Also, citizens can leave
their items on the curb with their regular trash to be picked up on their regular pick-up day during
the week of May 14-18, 2018. City Manager Hale stated that May 19, 2018, will end the clean-up
week with citizens and staff meeting at Parque de Vida at 9:00 a.m. He stated that the volunteers
would be assigned a part of town to help clean-up trash.
b. Executive Session. City Manager Hale stated that an Executive Session would be held with City
Council on Tuesday, May 15, 2018, 6:00 p.m., to review the applicants for the City Manager
position and to prioritize the finalists.
13. CITY COUNCIL COMMITTEE REPORTS
a. Mayor’s Report on Workshop. Mayor Sheek stated that during the workshop, discussion was
held on City Hall solar and Council and various board members viewed the ‘Suggestions for
Success’ CIRSA video. She stated that City Manager Hale also gave an update on the Trail to Mesa
Verde.
b. Cortez Historic Preservation Board. Councilmember Betts stated that she attended the Cortez
Historic Preservation Board on May 2, 2018, and it was noted that Janet Weeth is resigning from
the Board. She stated that the board would like the Mayor to sign a letter thanking Ms. Weeth for
her service. She stated that Historic Preservation Day will be held on May 19, 2018, with three
tours scheduled of historic places in Cortez.
c. Golf Course Advisory Board. Councilmember Keel stated that discussion at the April 25, 2018,
meeting included upcoming golf tournaments and it was noted that revenue is down from last year.
He stated that maintenance staffing for the golf course is being finalized and discussion was held on
the youth golf programs.
d. Goodbye Barbeque for City Manager Shane Hale. City Clerk Smith stated that a barbeque
honoring City Manager Hale would be held at the City Hall parking lot on Friday, May 18, 2018,
from 11:30 a.m. to 1:00 p.m. She invited the public and City Councilmembers to attend. It was
noted that City Manager Hale’s last day would be Tuesday, May 22, 2018.
The regular meeting was adjourned at 8:20 p.m.
