The following ZBA members were recorded present: Kyle Davis Thomas Larson Ray Parker Teddy Phillips The following board member was recorded absent: Brett Barnes VARIANCE APPLICATIONS Record of Decision 2024.06.03 - 01 Historic Commission Appeal | 14 Clayton Ave. A public hearing on the appeal was opened at 5:35 p.m. The YWCA seeks to add a steel canopy to the existing fire escape as required by the state regulatory agency governing childcare. The YWCA’s modification application was denied by the Historic Commission due to the canopy material’s non-conformity to historical district design standards. The YWCA is appealing the Historic Commission’s decision. Mr. Sullivan is purchasing the property and is agreement with the applicant, Lois Pierce in seeing a variance for pre-existing nonconformities for the purpose of placing a 12’x24’ shed in the back yard within 2’ of the property line. The City Corporation Counsel, A.J. Meldrim provided the ZBA an opinion of counsel letter as to any question of potential conflict of interest – being that Mr. Jewett is the City Clerk and serves as secretary to the Zoning Board of Appeals. Mr. Meldrim stated in his letter: “It is my opinion that no conflict of interest exists. Accordingly, Mr. Jewett’s application should be reviewed and decided upon by the Board. His role as secretary to the Board provides no authority relative to decision making.
