Approve and Adopt Resolution No. PC2022-11, A resolution of the Planning Commission of the City of Crescent City Authorizing the use of Teleconferencing Provision under AB 361. VII. PC2022-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CRESCENT CITY AUTHORIZING THE USE OF REMOTE TELECONFERENCING (AB 361) WHEREAS, the Planning Commission of the City of Crescent City (“Planning Commission”) is committed to open and transparent government, and full compliance with the Ralph M. Brown Act (“Brown Act”); and WHEREAS, the Brown Act generally requires that a public agency take certain actions in order to use teleconferencing to attend a public meeting virtually; and WHEREAS, the Planning Commission recognizes that a local emergency persists due to the worldwide COVID-19 pandemic; and WHEREAS, the California Legislature has recognized the ongoing state of emergency due to the COVID-19 pandemic and has responded by creating an additional means for public meetings to be held via teleconference (inclusive of internet-based virtual meetings); and WHEREAS, on September 16, 2021, the California legislature passed Assembly Bill (“AB”) 361, which amends Government Code, section 54953 and permits a local agency to use teleconferencing to conduct its meetings in any of the following circumstances: (A) the legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing; (B) the legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) the legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; and WHEREAS, in order for the Planning Commission to use teleconferencing as allowed by AB 361, it must first adopt findings in a resolution, allowing the Planning Commission to conduct teleconferenced meetings for a period of thirty (30) days; and WHEREAS, Governor Gavin Newsom declared a state of emergency for the State of California due to the COVID-19 pandemic in his order entitled “Proclamation of a State of Emergency,” signed March 4, 2020; and WHEREAS, the County of Del Norte continues to recommend certain physical distancing requirements of people within Del Norte County, as described in detail in the Order of the Health Officer of the County of Del Norte dated 11/22/2021, and WHEREAS, the Planning Commission desires to conduct its meetings through the use of telephonic and internet-based services so that members of the public may observe and participate in meetings and offer public comment in the safest environment possible. Resolution No. PC2022-11 Page | 1 NOW THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Crescent City that: 1. The recitals set forth above are true and correct and fully incorporated into this Resolution by reference. 2. The Planning Commission is conducting meetings during a state of emergency and state or local officials have imposed or recommended measures to promote social distancing. 3. The Planning Commission authorizes City staff to take all actions necessary to conduct Planning Commission meetings in accordance with Government Code section 54953(e) and all other applicable provisions of the Brown Act, using teleconferencing for a period of thirty (30) days from the adoption of this Resolution, after which the Planning Commission will reconsider the circumstances of the state of emergency. This planning permit schedule is generalized and is subject to change based on the depth and scope of the proposed project. APPLCIATION REVIEW -4 Weeks 2 Once an application is received, it is reviewed by staff to ensure all required information is submitted, according to the permit ordinance(s). Omitted or incorrect information may result in a delay scheduling the project review or the application and drawing(s) may be returned to the applicant for additional information. When an application is deemed complete, the applicant will be notified of the complete application, meeting date, time, and location in which the project will be presented to the Planning Commission (within 45-days). If the project is not exempt from the CEQA, an Environmental Initial Study will be required and sent to the State Clearinghouse for a mandatory 30-day review, prior to the Planning Commission review. PLANNING REFERRALS -3 Weeks -2 Weeks 3 An application summary is drafted and sent, with application submittals, to other City departments for review and comments, which are incorporated into the Staff Report and Conditions of Approval. PUBLIC NOTICE -2 Weeks 4 A public notice is drafted and is posted for public circulation (10-days prior to public hearing). STAFF REPORT -3 Weeks -2 Weeks -1 Week 5 A staff report is drafted for consistency with the City’s General Plan, Zoning Ordinances, Permit Requirements, and Environmental Review which will be presented during the Planning Commission meeting. AGENDA -1 Week 6 The Planning Commission agenda is drafted with completed planning permit items, subject to review by the Planning Commission. The agenda, once finalized, is sent to the Commissioners, and is posted on the City’s website. MEETING Meeting 7 The Planning Commission reviews the presented materials for determination/findings. The applicant’s attendance at the planning permit(s) review meeting is advised as the project may be continued to the next meeting if additional information request(s) are unaddressed. APPROVAL LETTER +11 days 8 An approval letter is sent to the applicant after the appeal period ends, which is 10-days after a determination is made. If an appeal is received, in writing, the determination is sent to the City Council for review. NOTICE OF EXEMPTION +11 days 9 If the project is exempt from the California Environmental Quality Act (CEQA), the Notice of Exemption (NOE) may be posted to the City’s website, County’s Courthouse & website, and State Clearinghouse for a mandatory 35-day review.
