Roll Call Present 5 - Council Member Pete Souza, Council Member Jesse Kerley, Mayor James Mayberry, Mayor Pro-tem Pamala Harris, and Council Member Danny Wyatt Others present were City Attorney Will Ridley, City Clerk Sally Oglesby, Andy Vaughn, and Jim Young. Mayor James Mayberry was present and presiding. He called the meeting to order at 5:00 p.m. 1) Consent Agenda ORDINANCES ON THIRD READING Approval of the Consent Agenda A motion was made by Mayor Pro-tem Pamala Harris , seconded by Council Member Pete Souza, to approve the Consent Agenda, items "a, b, d, and f". The motion carried by the following vote: Aye: 5- Council Member Pete Souza, Council Member Jesse Kerley, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt a. Ordinance authorizing a Local Litigation Tax and Continuance Fee This Ordinance was adopted on third reading. b. Ordinance amending the 2014-15 budget for waterlines (J.R. Wauford & Company) This Ordinance was adopted on third reading. c. Ordinance amending the 2014-15 budget for waterlines (ECE Services) Councilmember Souze expressed concerns about the contract with ECE, specifically regarding only one meeting required. Mayor Pro-Tem Harris explained that, from her past experience with the firm, they will charge for additional meetings. It was pointed out that the contract had already been approved by Council and this item was the City of Crossville Page 1 Call for Special Meeting Minutes April 20, 2015 budget amendment. A motion was made by Council Member Pete Souza, seconded by Council Member Jesse Kerley, that this Ordinance be adopted on third reading. The motion carried by the following vote: Aye: 5- Council Member Pete Souza, Council Member Jesse Kerley, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt ORDINANCES ON SECOND READING d. Ordinance adding § 12-1100 to the Crossville Municipal Code pertaining to Administrative Hearing Officer Program and filling two positions This Ordinance was approved on second reading. e. Ordinance revising § 8-201 et seq. of the Crossville Municipal Code regarding beer A motion was made by Mayor James Mayberry, seconded by Council Member Jesse Kerley, that this Ordinance be approved on second reading. The motion carried by the following vote: Aye: 4- Council Member Jesse Kerley, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt Abstain: 1- Council Member Pete Souza f. Ordinance annexing 0.33 acres on McKinley Lane (Property Bros. Mgmt) This Ordinance was approved on second reading. ADDITIONAL CONSENT ITEMS g. Approval of grant application to the Department of Justice for grant money to purchase police vests The Department of Justice provides a grant program to pay 50% of the costs for the purchase of vests for the police officers. Applications are due by May 13, 2015. The grant application for police vests was approved as recommended. 2) OTHER BUSINESS a. Ordinance amending § 8-105 of the Crossville Municipal Code regarding signage for alcoholic beverage establishments The proposed ordinance will change the language regarding advertisements to match the language in the re-write of the beer ordinance. A motion was made by Council Member Jesse Kerley, seconded by Mayor Pro-tem Pamala Harris, that this Ordinance be approved on first reading. Ordinance amending sections of § 8-300 of the Crossville Municipal Code regarding intoxicating liquors The proposed ordinance makes the following changes: · 8-303 (2) removes language regarding the first applications after the effective date of the original ordinance when retail liquor stores became legal and reduces the number of copies of plans that are required · 8-304 removes the 500’ distance requirement to be compatible with the re-write of the beer ordinance · 8-308 changes the signage requirements to be identical with the beer requirements A motion was made by Council Member Jesse Kerley, seconded by Council Member Pete Souza, that this Ordinance be approved on first reading. The motion carried by the following vote: Aye: 5- Council Member Pete Souza, Council Member Jesse Kerley, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt c. Ordinance amending §1-101 of the Crossville Municipal Code regarding change in City Council meeting time A request has been received to change the City Council’s regular meetings to the second Thursday of each month and the regular work session to the first Thursday of each month. To change the regular meeting, an ordinance is required. No ordinance is required to change the work session. To allow proper public notification, the change would be effect in June, assuming passage by mid-May. Councilmember Souza expressed his support so that the Council can have maximum participation by its members. Councilmember Wyatt stated that he will have to re-arrange his schedules to make Thursday night meetings, but that he would do the best he could. He also had concerns on the hardships that the change will cause for a number of people outside the Councilmembers. Councilmember Kerley expressed his thanks for support of the change. A motion was made by Council Member Pete Souza, seconded by Mayor Pro-tem Pamala Harris, that this Ordinance be approved on first reading.
