Rollcall Present 4 - Council Member Pete Souza, Mayor James Mayberry, Mayor Pro-tem Pamala Harris, and Council Member Danny Wyatt Absent 1 - Council Member Jesse Kerley Others present were City Manager David Rutherford, City Attorney Will Ridley, City Clerk Sally Oglesby, Fred Houston, Clark Annis, John Conrad, Randy Graham, Rodney Shoap, Brian Eckleson, Andy Vaughn, John Turner, Jim Young, Marlene Potter, Charles Loveday, and Levonn Hubbard. Mayor Mayberry called the meeting to order at 5:00 p.m. ORDINANCES ON SECOND READING 1. Ordinance amending § 20-101 regarding Meadow Park Lake operations A motion was made by Mayor James Mayberry, seconded by Mayor Pro-tem Pamala Harris, that this Ordinance be approved on second reading. The motion carried by the following vote: Aye: 4- Council Member Pete Souza, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt BIDS / PURCHASES 2. Ordinance amending the FY2015-16 budget for UV System Flood Damage repairs Clark Annis reported that during the end of June and first of July, the City received approximately 9" of rain. On July, 2-3, Crossville got just under 5 inches of rainfall. Water entered the wastewater plant in the area where the UV system is located. This area flooded, doing major damage to the UV system. A quote was received from ENAQUA in the amount of $50,225.82 for the needed repairs. Park of the unit had to be shipped back to the manufacturers for parts to be re-installed. Insurance has covered the cost except for the $5,000 deductible. A bigger drain is being installed to alleviate future problems. A motion was made by Mayor James Mayberry, seconded by Council Member Pete Souza, that the repairs to the UV facility be authorized and a budget amendment approved on first reading. Super Cab 4 x 4 Trucks (2) Council approved a budget for one, four door ½ ton, 4-wheel drive truck. In reviewing the options available, Ford of Murfreesboro can provide two (2) 2014 Ford F-150 trucks under the state bid price for the price originally approved for the one (1) ½ ton truck. Price quoted per truck is $25,000 for a total of $50,000, the amount available in the budget. The Street Department Supervisor has reviewed the options available and recommends purchasing the two trucks for a total of $50,000. A motion was made by Council Member Pete Souza, seconded by Mayor Pro-tem Pamala Harris, that the purchases be approved as recommended. The motion carried by the following vote: Aye: 4- Council Member Pete Souza, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt OTHER BUSINESS 4. Resolution annexing 1.18 acres on Hwy. 127S (Rutledge) David Rutledge has requested his property located at 4341 Hwy. 127S to be annexed into the City so that he can connect to city sewer. The sewer line is located in front of his property. The Planning Commission has reviewed the request and recommended annexation. A motion was made by Council Member Danny Wyatt, seconded by Council Member Pete Souza, that this annexation be approved as recommended. The motion carried by the following vote: Aye: 4- Council Member Pete Souza, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt 5. Resolution approving a Plan of Services for annexation on Hwy. 127S (Rutledge) The proposed Plan of Services was reviewed by staff and recommended for approval by the Planning Commission. A motion was made by Mayor Pro-tem Pamala Harris, seconded by Mayor James Mayberry, that the Plan of Services be approved as recommended. The motion carried by the following vote: Aye: 4- Council Member Pete Souza, Mayor James Mayberry, Mayor Pro-tem Pamala Harris and Council Member Danny Wyatt 6. Approval of connection of 4341 Hwy. 127S to City sewer at outside-City rates. This Resolution was removed from the agenda since the annexation was approved. 7. Discussion and action on County building inspections At the July 9th meeting, a motion was made and passed to offer to the County that the City continue building inspections for the County, including commercial inspections. However, that item was not on the agenda for the work session nor was City of Crossville Page 2 Call for Special Meeting Minutes July 23, 2015 it on the agenda for the meeting. City Attorney Ridley has opined that proper notice was not given to the Council or to the public as required by the Standing Rules and that the new motion was in conflict with the previous action taken. The proper procedure is to repeal the prior action and move to adopt the new action. City Manager Rutherford also reported that the City Council will be asked to adopt the 2012 codes in August. Councilmember Wyatt asked that the matter be deferred until a full Council present. Councilmember Souza pointed out that other items have been passed without a full Council present. A motion was made by Council Member Pete Souza, seconded by Mayor Pro-tem Pamala Harris, that this action be tabled.
