Main Crossville, TN 38555 Minutes Thursday, December 13, 2018 3:30 PM Conference Room 317 Call for Special Meeting Call for Special Meeting Minutes December 13, 2018 Executive Closed Meeting-3:15 p.m. Call to Order The City Council for the City of Crossville met in special session on Thursday, December 13, 2018, at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 3:44 p.m. Rollcall Present 5 - Council Member J. H. Graham, Council Member Scot Shanks, Mayor Pro-tem Art Gernt, Council Member Rob Harrison, and Mayor James Mayberry Others present were City Manager Greg Wood, City Attorney Will Ridley, City Clerk Valerie Hale, Assistant City Clerk Malena Fisher, Jim Young, Heather Mullinix, Jessie Brooks, Mike Turner, Richard Dickenson, Melissa Coudriet, and Tim Begley. 1. Consent Agenda Ordinances on Third Reading a. Ordinance amending FY18-19 budget for Pickleball Courts at Centennial Park Due to the popularity of pickle ball, there is a need to convert the tennis courts at Centennial Park to pickle ball courts. Costs are estimated at $40,000. A budget amendment is required. 110-44400-930-004 Debit Pickleball Courts 110-27100 Credit Net Position The council members discussed that they have received very few phone calls from constituents wanting to keep the tennis courts. The estimated cost for renovations is $40,000. Mayor Pro Tem Gernt discussed access at other tennis courts in the county. This Ordinance was adopted on third reading. b. Ordinance amending Crossville Municipal Code Title 7, Chapter 6 City of Crossville Page 1 Call for Special Meeting Minutes December 13, 2018 regarding Open Burning An ordinance revision regarding Open Burning is proposed to be more specific regarding the definition of open burning, specify permissible items, time frames, and permitting. This Ordinance was adopted on third reading. 2. Other Business a. Discussion and action on contract regarding Airfield Pavement Rehabilitation at Crossville Memorial Airport City Attorney Ridley discussed the contract between the City of Crossville and Cantrell Construction for the airfield pavement rehabilitation project, which is a grant project with TDOT Aeronautics (95/5%). Based upon the inspection and recommendation of Atkins Engineering, it has been determined that Cantrell Construction is in default of the contract. National American Insurance Company, the surety company, has also inspected and found that there are adequate reasons for the City to terminate the contract and find Cantrell Construction in default of contract. Based upon recommendation of Atkins Engineering & National American Insurance Company, the City Attorney recommends to terminate the contract with Cantrell Construction. A motion was made by Council Member J. H. Graham, seconded by Mayor Pro-tem Art Gernt to terminate the contract with Cantrell Construction based upon recommendation of Atkins Engineering, National American Insurance Company, and the City Attorney Will Ridley. The motion carried by the following vote: Aye: 5- Council Member J. H. Graham, Council Member Scot Shanks, Mayor Pro-tem Art Gernt, Council Member Rob Harrison and Mayor James Mayberry Rebidding the contract for the airfield pavement rehabilitation project is required to move forward with the project since the contract with Cantrell Construction has been terminated. The City Attorney asked the Council to rebid the project and amend Atkins Engineering's contract for additional work involved for rebidding the project. The total contract amendment requested is $20,637: $4,000 revision of plans $4,637 rebidding project $12,000 construction administration A motion was made by Council Member J. H. Graham, seconded by Mayor Pro-tem Art Gernt to rebid the airfield pavement rehabilitation project and amend Atkins Engineering's contract for additional work involved for rebidding the project in the amount of $20,637. The motion carried by the following vote: Aye: 5- Council Member J. H. Graham, Council Member Scot Shanks, Mayor Pro-tem Art Gernt, Council Member Rob Harrison and Mayor James Mayberry City of Crossville Page 2 Call for Special Meeting Minutes December 13, 2018 City Attorney Will Ridley reported that National American Insurance Company has offered to settle with the City. He recommended to the Council not to accept or reject the settlement, but to notify the surety company that a decision will be made once a cost has been determined based upon new bid.
