Crawford Council Member Scot Shanks Council Member Rob Harrison Council Member Art Gernt City Manager Greg Wood City Clerk Valerie Hale Call for Special Meeting Minutes August 16, 2022 Call to Order The Crossville City Council met in special session on Tuesday, August 16, 2022 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 1:30 p.m. Roll Call Present 5 - Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford, and Mayor James Mayberry Others present were City Clerk Valerie Hale, City Attorney Will Ridley, Tim Begley, Leah Crockett, Tony Perry, Steve Threet, Nathan Clouse, Rusty Graham, Steve Powell, Billy Poore, Lee Lawson, Joe Kerley, Fred Houston, Kevin Music, Burt Allaire, Mike Turner, Rick Myers, Heather Mullinix, Jessie Brooks, and Levonn Hubbard. 1. Consent Agenda A motion was made by Council Member Rob Harrison, seconded by Council Member Art Gernt, to approve the Items 1A-D on the consent agenda. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry a. Approval of TDOT contract amendment for Lantana & Main traffic signal (PIN 125617.00) The City Clerk requested a time extension for the Lantana & Main traffic signal funded through a Surface Transportation Block Grant (STBG), which prompted a contract amendment. The time extension is necessary because of the delays for additional reviews and approvals requested by TDOT. Staff and the Engineers were trying to coordinate the projects to minimize construction activities and inconveniences; therefore, the project has been delayed. The amendment extends the contract until August 31, 2023. The bid for the traffic signal has been received and approved by TDOT; however, it is over the consulting engineer’s estimate so an amendment on Exhibit A is also necessary. This amendment also obligates more Federal funding for the project. This is a 100% grant. This Contract was approved as recommended b. Approval to award bid for Lantana Road & Main Street traffic signal project (PIN 125617.00) Bids were received on June 21, 2022 for the replacement of the traffic signalization at Lantana Rd. and Main St. One bid was received from Stansell Electric Co., Inc. in the amount of $458,797. Staff recommends approval of the bid. The bid for the traffic signal has been approved by TDOT; however, it is over the consulting engineer’s estimate due to the significant increase in construction costs since the original estimate was submitted. Surface Transportation Funds (100%) will be used to fund the City of Crossville Page 1 Call for Special Meeting Minutes August 16, 2022 project. This Contract was approved as recommended. Ordinances on Third Reading c. Ordinance amending FY21-22 budget for year-end adjustments Finance department requests a budget amendment for expenses that have gone over budget for FY21-22. This Ordinance was adopted on third reading. d. Ordinance amending FY22-23 Budget regarding Independent Investigation-Village Inn A budget amendment is necessary to pay for the independent investigation regarding events surrounding the Village Inn closure. This Ordinance was adopted on third reading. 2. Other Business a. Approval of contract for sanitation services City Council awarded the bid for sanitation services to Cumberland Waste Disposal - A Waste Connections of Tennessee, Inc. company. They have requested to add a document they submitted with their bid entitled, “Exceptions to RFP”, to the contract. Staff requests approval of the exceptions. A motion was made by Council Member Rob Harrison, seconded by Mayor Pro-tem R.J. Crawford, to approve the exceptions/contract. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry b. Discussion and action regarding City Manager resignation Council Member Rob Harrison stated the preliminary report from the Village Inn investigation was received at 8:30 p.m. the night prior and that he would like more time to read the report before making a decision about the City Manager's resignation. Council Member Harrison expressed that he would prefer to table any further action regarding the City Manager and made a motion to table the discussion, which was seconded by Council Member Shanks. Mayor Mayberry read the letter of resignation from City Manager Greg Wood requesting compensation for accrued vacation and sick time. Mayor Pro-tem Crawford stated he felt the City Council was delaying the inevitable by tabling the discussion since a letter of resignation had been submitted. City Attorney Will Ridley stated that from brief discussion with Mr. Wood that he was not coming back. Mr. Ridley continued to say Mr. Wood had made his request and could be given his vacation and sick leave in the form of separation pay. City of Crossville Page 2 Call for Special Meeting Minutes August 16, 2022 Mayor Mayberry stated that the motion would delay selecting a new City Manager, along with trying to select a new City Attorney. Council Member Scot Shanks asked if they could discuss the investigative report they had received. Mr. Ridley explained that the reports are attorney-client privilege and if they choose to discuss them, there will no longer be attorney-client privilege. Council Member Art Gernt asked if Mr. Wood would be leaving regardless of a decision being made. Mr. Ridley explained that he felt Mr. Wood would not be returning considering he was packing up his office and had told Mr. Ridley in previous conversation that he would be moving from the City of Crossville. It was then asked when the final report would be in for review. Council Member Shanks said he felt like the report they received would be close to the final report. Mayor Mayberry then said there is a lot more he would like to see in the final report. Mayor Pro-tem Crawford brought up the resignation letter again stating he felt that the letter was Mr. Wood saying he would not be back. Mayor Pro-tem Crawford then asked if other City Council Members were aware of something he was not and asked if they felt Mr. Wood may still return to his position. Council Member Harrison and Council Member Gernt agreed they thought Mr. Wood would like to return to his position. Mayor Pro-tem Crawford asked why he would turn the resignation letter in if he may want to keep his job. Council Member Shanks stated that the motion at hand was to only table the discussion until after the final report had been reviewed. Mayor Pro-tem Crawford then followed by stating City Council may not have voted to have the investigation done in the first place if the resignation letter had came a day earlier. Council Member Shanks agreed. Mayor Mayberry asked City Clerk to repeat the motion and then called for a roll call vote. A motion was made by Council Member Rob Harrison, seconded by Council Member Scot Shanks, to table discussion until the final report has been received. The motion carried by the following vote: Aye: 3- Council Member Scot Shanks, Council Member Rob Harrison and Council Member Art Gernt Nay: 2- Mayor Pro-tem R.J.
