Annexation Progress Report Mayor Mayberry was present and presiding. He called the meeting to order at 5:50 p.m. A public hearing is required to provide an update on the annexation and plan of services for: • 1.07 acres, Tax Map 126, Parcel 36.01-Wilson Lane All services have been provided as outlined or requested by the owner/developer. No one was present to make comment. The public hearing was adjourned at 5:51 p.m. This Public Hearing was received and filed. REGULAR MEETING - 6:00 p.m. Call to Order The City Council for the City of Crossville met in regular session on Tuesday, October 8, 2019 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 6:00 p.m. Council member Scot Shanks provided the invocation. The Young Marines presented the colors and led the Pledge of Allegiance. Roll Call Present: 5 - Council Member J. H. Crawford with a proclamation for October as National Chiropractic Health Month. 2. Public Comment There were no public comments. 3. Appointments-None 4. Consent Agenda A motion was made by Council Member J. H. Graham, seconded by Council Member Scot Shanks, to approve the Consent Agenda, Items A-O. Approval of minutes (09/10) The Minutes were approved. Ordinances on Second Reading b. Ordinance amending §15-125 in the Crossville Municipal Code regarding Rules of the Road The Crossville Police Department is requesting to adopt the State Traffic Statute 55-3-102-Driving or moving unregistered vehicle upon highway a misdemeanor Exception. This statute is necessary to enable the police department to cite into City court for suspended registrations This Ordinance was approved on second reading. c. Ordinance amending FY19-20 budget Airport Maintenance Building Repairs The maintenance building is leaking, much of the insulation is missing, the lighting is substandard and several other repairs are required on the building. The City Council previously approved a grant application for $100,000. The new estimated construction cost is $175,235.50. TDOT Aeronautics is dividing this project into a design grant and a construction grant. Approval has been granted by the Council to submit a grant application for this project for the construction work in an amount of $180,000. A budget amendment is required for the increase in total cost of the project at an additional $100,000. This project will be funded 95% by TDOT Aeronautics with a 5% match by the City at an amount of $10,000. This Ordinance was approved on second reading. Approval of Water Line Extension on Beehive Lane The owner of the parcel at the end of Beehive lane, Tax Map 88 parcel 003.00 has requested a 2 inch water line be extended to their property. This property is located outside the City of Crossville, so the owner would be responsible for 100% of the cost, labor and materials. The property is approximately 680 feet from the end of the City’s existing 2 inch water line. Planning Commission met September 19 and recommended the approval of the extension upon payment of the estimated cost or provision of a proper financial guarantee in the amount of the estimate This water line extension was approved as recommended. e. Approval of retirement/decommissioning of Canine Mojo Due to age, Chief Brooks is recommending that Canine Mojo retire. He also recommends giving Canine Mojo to his handler, Lt. Dustin Lester, who is willing to keep and maintain him at his own expense as his personal canine and pet. This item was approved as recommended. f. Approval of disposal of surplus equipment-Water Resources Department Approval is requested to declare a 2004 Chevy Silverado with 4,450 hours and 36,170 miles to be surplus and sold at www.govdeals.com. The estimated current value for truck is $4,500. This disposal was approved as recommended. g. Approval to request refund for LGIP funds deposited for SR-28/US 127 Homesteads Project The City deposited $1,137,597.50 into the Local Government Investment Pool for the SR-28/US 127 Homesteads Project. The balance of the deposit is $1,199,444.72 (includes interest). The project was to relocate utility lines from south of Sawmill Road to Cleveland Street for the road to be widened. In order to receive reimbursement of these funds deposited in 2010 for the project, a formal request needs to be made. The road has recently been paved so it is evident that the road widening project is on hold for at least 15 years until the next paving cycle. This item was approved. h. Approval of temporary street closings for Stone Memorial High School Panther Dash (Cook Road from SMHS to I-40/Cook Rd.) Stone Memorial High School will be holding their 8th annual Panther Dash on Saturday, November 2. The event includes a 5K run and 1-mile fun run/walk. The run will begin at 8:30 and conclude at approximately 9:30 a.m. They will be using the approved route on Cook Road. This Permit was approved. i. Approval of temporary street closings for Christmas Festival City of Crossville Page 3 City Council Minutes October 8, 2019 Cumberland Fellowship is sponsoring a Christmas Festival on December 6, at their church located at 1640 West Ave. Due to limited parking, they have partnered with Rural King to allow use of their parking lot during the festival, which will be from 5:00-8:00 p.m. To address safety concerns, they request that a lane of West Ave. be closed between the entrance to Rural King and the entrance of their office, which is approximately 100 yards. This Permit was approved. j. Approval of temporary road closures for Veterans’ Day The Veterans’ Service Office is requesting a temporary road closure on Monday, November 11, 2019 from 9:30 a.m. to 12:30 p.m. to provide handicap parking around Memorial Park for the Veterans’ Day ceremony. This Permit was approved. k. Approval of temporary street closing of Taylor Avenue between Main Street and Thurman Avenue, for the Class of 1994 25th reunion on October 19 from 5:00 p.m. to 9:00 p.m. The Cumberland County High School Class of 1994 is requesting temporary street closure for their 25th class reunion This Permit was approved. l. Approval of contract for assignment of license agreement The City currently has a License Agreement for Ingress, Egress, and Access with Forbus Investments, LLC, which Property is a part of parcel 030.03, Map 73. A request is being made to assign the agreement to Swayze Properties, LLC. This Contract was approved. m. Approval of grant contract with TDOT for Airport Layout Plan Grants have been awarded by the Tennessee Department of Transportation-Aeronautics Division for the Airport Layout Plan (95/5%) in the amount of $200,000 with a local match of $10,000 This Contract was approved. Bids/Purchases n. Approval to purchase HOMA replacement pump for Waste Water Treatment Plant Veolia requests to purchase a replacement pump. Bids were solicited and staff recommends the low bidder, Shane Smith. The amount of the pump is $8,980. This Bid was approved. o. Approval to purchase fencing for Garrison Park City of Crossville Page 4 City Council Minutes October 8, 2019 Five bids for the Garrison Park fence project were received. A bid tabulation is attached. The bids are unit price bids. The Engineering Department recommends the low bid from Ace Fence Co. in the amount of $11,677.60. This Bid was approved. 5. Other Business a. Discussion and action on Habitat Conservation Plan Council Member Graham expressed that the City can still participate at a later time if the HCP for City of Crossville was resurrected. Council Member Harrison stated the plan was rejected by the County, leaving only 205 acres that would be eligible for any benefits of the plan and not feasible at this time. A motion was made by Mayor James Mayberry, seconded by Council Member Scot Shanks, to rescind the original resolution regarding the Habitat Conservation Plan that was passed on March 13, 2007 and to cease all expenditures on the Habitat Conservation Plan. Approval of contract amendment #3 for engineering services for Meadow Park Lake Expansion Project-Permits and ordinance amending FY19-20 budget Greg Davenport, J.R. Wauford & Company, gave a presentation on the Raw Water Capacity Master Plan at the most recent work session. The presentation gave an overview of the work the firm has been doing to discuss a path forward including raising the Meadow Park Lake Dam. With a moderate growth forecast, the total raw water demand for 2037 will be 8.06 MGD and 10.98 MGD in 2067. With a high growth forecast, the total raw water demand for 2037 will be 9.19 MGD and 12.05 MGD in 2067. The firm has suggested the following improvements: Phase 1 Raise Meadow Park Lake Dam Relocate Meadow Park Lake Raw Water Intake Phase 2 Expand Meadow Park Lake WTP to 7.0 MGD Phase 3 Alt 1 Expand Meadow Park Lake WTP to 12.25 MGD Holiday Hill Lake Raw Water Intake Improvements New Treated Water Distribution Line Demolition of Holiday Hills WTP Phase 3 Alt 2 Construct New 5.5 MGD Holiday Hills WTP Regardless of the path chosen, the dam permitting process is necessary. The estimated cost is $75,000 and J.R. Wauford & Company has presented an City of Crossville Page 5 City Council Minutes October 8, 2019 amendment (#3) to the current contract to complete this work. This will require a budget amendment. A budget amendment is also required for amendment #2 approved March 12, 2019, which was to examine alternatives in order to recommend a road map to the Council for project implementation. The amendment requested is in the amount of $45,000. A motion was made by Council Member J. H. Graham, seconded by Council Member Rob Harrison, to approve contract amendment #3 and first reading of budget amendment for Contract Amendments 2 & 3.. City Attorney's Report a. City Attorney’s Report-October City Attorney Will Ridley reported that there have not been any new lawsuits since last Council meeting. Mr. Ridley reported that he has sent notification to the renter at the airport that is delinquent on t-hangar rent and placed a lien on the aircraft. If the issue isn't resolved, the aircraft will be sold on November 26. Mr. Ridley reported that the property located at 250 Old Mail Road sold for $10,000. 7. City Manager's Report a. City Manager's Report - October City Manager Greg Wood gave the monthly revenue reports for sales tax, whole beer, retail liquor, and hotel occupancy tax. He also presented reports on monthly police and fire statistics, water loss, building permits, special projects, bonded debt, and grants. He announced that the Crossville Memorial Airport Fly-in and Open House was a huge success and well attended. He recognized the sponsors.
