Annexation Progress Report Mayor James Mayberry was present and presiding. He called the meeting to order at 5:50 p.m. The public hearing is required to provide an update on the annexation and plan of services for: Tax Map 113H, Group E, Parcel 29 on Sweetgum Circle (0.59 ac) All services have been provided as requested by the owner/developer. There were not any comments received from the public. REGULAR MEETING - 6:00 p.m. Call to Order The City Council for the City of Crossville met for its monthly session on Tuesday, March 10, 2020 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 6:00 p.m. Tim Chesson of Faith Worship Center provided the invocation. The Young Marines pesented the colors and led the Pledge of Allegiance. Roll Call Present: 5 - Council Member J. H. Public Comment There were no public comments received. 3. Appointments a. Cumberland County Board of Equalization T.C.A. provides that the City of Crossville is entitled to make an appointment to the Board. Jim Inman is no longer eligible to serve on the Board. A motion was made by Council Member Rob Harrison, seconded by Council Member Scot Shanks, to appoint Levonn Hubbard to the Cumberland County Board of Equalization. Consent Agenda A motion was made by Council Member J. H. Graham, seconded by Council Member Rob Harrison, to approve Items 4 A-M of the Consent Agenda. Approval of minutes (02/11) The Minutes were approved. Ordinances on Second Reading b. Ordinance Amending FY19-20 Budget Centennial Park Concession Stand Coolers The Leisure Services Department requests purchase of 6 Beverage Coolers (5 double, 1 single) for a cost of $8486.14 from US Foods. This Price reflects NJPA discounts. These coolers will replace those removed by Coca Cola at the end of the contract. This will require a budget amendment. This Ordinance was approved on second reading. c. Ordinance amending Title 14, Chapter 3, Section 303 (B) regarding Municipal Flood Damage Prevention Due to several annexations since 2007, an update to the ordinance dealing with City of Crossville Page 2 City Council Minutes March 10, 2020 Municipal Flood Damage Prevention is needed. The City and County are divided into “flood panels”. In the ordinance, the panels within the City limits are listed. The additional panels that need to be included in the ordinance are: 47035C0318, 47035C319, and 47035C340. These panels include the back portion of Homestead Place, Valley Lane, a large parcel east of Hwy 127 S, and the majority of Cumberland Mountain State Park. This Ordinance was approved on second reading. d. Ordinance Amending FY 19-20 Budget 2018 CDBG Change Order Approval of change order #2 was approved to close out the project in the amount of $18,901.30. This is not included in the budget and will require a budget amendment. This Ordinance was approved on second reading. e. Ordinance amending FY19-20 budget for the purchase of a Self-Serve Fueling Terminal Support for the current fueling terminal will end as of June 30. The City Council approved the purchase of QTPod M4000 in the amount of $20,815.24. This item will be purchased from a sole source provider. A budget amendment is required. This Ordinance was approved on second reading. Additional Consent Items f. Approval of initial resolution authorizing the issuance of water and sewer revenue and tax bonds in a par amount not to exceed $890,000 to finance water and sewer system improvements and extensions and related costs City Council previously approved an application on June 11, 2015 to USDA-Rural Development for funding of the Hwy. 127N water tank for the Catoosa Department. This application has now been approved in the form of an $890,000 loan and $160,500 grant. This loan will be for 40 years with an interest rate of approximately 2.25%. Approval was granted June 9, 2016 for the Administrative Services Agreement with Community Development Partners, who prepared the grant/loan application. Bond Counsel was also contracted with Bass Berry & Sims because they have been involved in all recent USDA grant/loans for the City. Their fee is $6,000. The Engineering Services agreement with Stigall Engineering Associates was approved by Council in May 2015. Property acquisition was completed September 12, 2019. This Resolution was approved. g. Approval of resolution authorizing the issuance, sale, and payment of $890,000 of bonds by the City of Crossville, Tennessee; authorizing the issuance of bond anticipation notes prior to the issuance of the bonds; and authorizing the pledge of revenues of the water and sewer system and the levy of taxes to pay the bonds and notes City of Crossville Page 3 City Council Minutes March 10, 2020 This Resolution was approved. h. Approval of temporary street closings for Run to Read 5K and 1-Mile Walk The Cumberland County Imagination Library and Cumberland County School’s Coordinated School Health Program are planning their annual “Run to Read” 5K and 1-Mile Walk on Saturday, April 18, 2020. They will use the route starting at Stone Memorial High School and Cook Road and begin at 7:30 a.m. They should be completed by 9:40 a.m. This Permit was approved. i. Approval of Certificate of Compliance for Peavine Wine & Spirits The Certificate of Compliance for Peavine Wine & Spirits was requested by Fenil Parikh and approved on February 11, 2020. This Certificate affirms that this business meets all requirements of the City of Crossville. Raxit Patel requests to have his name added to the Certificate of Compliance. Mr. Patel does not meet the residency requirement; however, according to a recent ruling by the U.S. Supreme Court, this requirement is not enforceable. This Permit was approved. j. Approval of contract amendment for engineering services for Meadow Park Water and Sewer Improvements The City Council voted to pursue an SRF loan for the funding source of this project. Additional documents must be developed by the Engineer for the SRF approval process. An amendment to the existing contract with JR Wauford and Company for these services is attached which equates to an additional $27,000 for these services. The Director of Engineering recommends the approval of the amendment. This Contract was approved. Bids/Purchases k. Approval of extension of phone/Internet/video contract with Ben Lomand The contract for communication services from Ben Lomand will expire in March. The contract allowed for a three-year extension. The IT Department recommends the extension. This Contract was approved. l. Approval of bid award-Miller Avenue Force Main project Bids for the Miller Avenue Force Main Project were received February 18, 2020. A recommendation, by the Engineer, to award the Contract to Ironwood Construction & Engineering LLC in the amount of $669,765.00 is attached. The Director of Engineering concurs with the recommendation. This Bid was approved. City of Crossville Page 4 City Council Minutes March 10, 2020 m. Approval to purchase Extended Preventive Routine Maintenance Plan Veolia staff requests to purchase an Extended Preventive Routine Maintenance Plan for two turbo blowers. The cost of the maintenance plan is $6,590. The plan would help prevent any unnecessary down time and extend the life of the blowers. This Purchase was approved. 5. Other Business a. Discussion and action regarding Independent Contractor Agreement for Medical Director Services At the January meeting, City Council approved drafting an amended Medical Director’s Independent Contractor agreement to facilitate the position of Medical Director and then deferred the item at the February meeting to allow for time to receive quotes on insurance. The quote has been received in the amount of $1,858 for 03/11/20-03/11/21 with $1,000,000 each incident/$3,000,000 aggregate. Mayor Mayberry requested that his activities be included with the monthly Fire Department report. A motion was made by Council Member Rob Harrison, seconded by Council Member Scot Shanks, to pay premium for malpractice insurance and approve contract as presented and that the Medical Director's activities be included with the monthly Fire Department report. City Attorney's Report a. City Attorney’s Report-March City Attorney Ridley reported that there have not been any lawsuits filed against the City within the last thirty days. This Report was received and filed. 7. City Manager's Report a. City Manager's Report - March City Manager Greg Wood gave the monthly revenue reports for sales tax, wholesale beer, retail liquor, and hotel occupancy tax. He also presented the monthly police and fire statistics, water loss, building permits, special projects, bonded debt, and grants. Mr. Wood recognized and thanked the Police & Fire departments for their efforts following the recent tornado in Putnam County. The City has the only technical rescue squad in the Upper Cumberland. He also commended the Maintenance Department for their assistance with getting vehicles prepared. City of Crossville Page 5 City Council Minutes March 10, 2020 This Report was received and filed.
