Main Crossville, TN 38555 Minutes Tuesday, November 10, 2020 6:00 PM Council Chambers City Council City Council Minutes November 10, 2020 BEER BOARD - 5:45 p.m. The Crossville Beer Board met on Tuesday, November 10, 2020 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 5:45 p.m. Present: 4 - Council Member J. H. Graham, Council Member Rob Harrison, Council Member Scot Shanks and Mayor James Mayberry Absent: 1 - Mayor Pro-tem Art Gernt 1. AM Express An application has been received from Anil Kumar Patel for an off-premises beer permit for AM Express located at 1931 N. Main St. Chief Jessie Brooks reported a clear-records report and recommended approval for an off premises beer permit for AM Express. A motion was made by Council Member J. H. Graham, seconded by Council Member Scot Shanks, to approve an off-premises beer permit. The motion carried by the following vote: Aye: 4- Council Member J. H. Graham, Council Member Rob Harrison, Council Member Scot Shanks and Mayor James Mayberry Absent: 1- Mayor Pro-tem Art Gernt REGULAR MEETING - 6:00 p.m. Call to Order The City Council for the City of Crossville met in regular session on Tuesday, November 10, 2020 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 6:00 p.m. The Crossville Police Department presented the colors and led the Pledge of Allegiance. Tim Chesson of Faith Worship Center provided the invocation. Roll Call Present: 4 - Council Member J. H. Graham, Council Member Rob Harrison, Council Member Scot Shanks and Mayor James Mayberry Absent: 1 - Mayor Pro-tem Art Gernt Others present were City Manager Greg Wood, City Attorney Will Ridley, City Clerk Valerie Hale, Assistant City Clerk Malena Fisher, Lee Lawson, Kevin Music, Tim Begley, Jessie Brooks, Heather Mullinix, Scott Humphrey, Tim Chesson, Ronnie Webb, Cliff Wightman, Christine Stinson, Larry Wyatt, Lou Wyatt, Brian Wyatt, Brooke Wyatt, Brylee Wyatt, Bryce Wyatt, Jonathan O'Neal, Josh Mangus, and Levonn Hubbard. City of Crossville Page 1 City Council Minutes November 10, 2020 1. Proclamations/Presentations a. Student of the Month-Brylee Wyatt Mayor Mayberry presented the Student of the Month Award to Brylee Wyatt for her good manners. She was nominated by her teacher, Melissa Buffkin. This Presentation was announced. 2. Public Comment Christine Stinson spoke to the Council about the current bond sale and the lack of information and communication that the residents have received about the process of buying bonds. Ronnie Webb spoke to the Council about his opinion that property maintenance regulations are getting too stringent. 3. Consent Agenda A motion was made by Council Member J. H. Graham, seconded by Council Member Rob Harrison, to approve all items on the Consent Agenda as recommended by City Manager and Staff. The motion carried by an unanimous vote. Ordinances on Third Reading a. Ordinance closing Right Of Way on Church Street This item covers the complete closure of Church Street from the intersection of Burnett Street to the intersection of Cother Street. A portion of this section of Church Street was closed in the 80s behind the bank, which is now City Hall. The City Council at that time required a legal description for the closure. The closure was never added to the tax roll, but was recorded in the Register of Deeds office. Mr. Flynn requested that the remainder of the ROW be closed and turned over to him. This Ordinance was adopted on third reading. b. Ordinance amending FY20-21 budget for Meadow Park Lake Master Meter Equipment and Installation City Council approved bids for master meters installation and equipment and a budget amendment is necessary. Ordinance amending FY 20-21 CARES Act Funding The City has received a grant in the amount of $173,310 from the State of Tennessee for expenses related to COVID-19. A budget amendment is necessary. This Ordinance was approved on first reading. Additional Consent Items d. Approval of minutes (10/13,10/22) The Minutes were approved. e. Approval of Point Road Water Line Acceptance There is a private existing 2-inch water line approximately 1,600 feet in length along Point Road, which is located off Eldridge Loop, off Genesis Road in the Catoosa Utility area. The property owners along the line and owner of the line are requesting the City take over ownership of the line. It would allow other properties on Point Road to tie on and receive water. City staff has evaluated the line, and all materials used match existing water line standards and several spot digs on the line found the line to be installed properly. The existing line is currently metered and appears to be a sound line with no leaks. There are some minor improvements that would need to be made before the City could take over the line. The total cost of the improvements, which include a 2-inch tap fee, TDEC review, and all labor and materials, equals $3,465.00. This cost would be paid by the property owners requesting the water line take-over. Any future water taps would be at full price. Planning Commission met October 15 and recommends the acceptance of the water line by City Council. This Resolution was approved. f. Approval of application to purchase surplus property through the State The City’s account with the Tennessee Department of General Services to purchase surplus state and federal property expires on November 27, 2020. While purchases through this department are rare, it is good to have an active account should the need arise. This Contract was approved. g. Approval of contracts with TDOT on utility relocations for SR-1, Bridge Over Obed River TDOT will reimburse the costs for the relocation of lines that are located on private utility easements, engineering, and inspection. One hundred percent of the sewer lines are on private property and 68% of the water lines are on private property. There is not a local match required. The Contracts were approved. Approval of TDOT contract amendment for Northwest Connector 2 The City has received Surface Transportation Block Grant funding allocation for section 2 of the Northwest Connector project; however, the project is expected to exceed the contracted amount of $274,925 and an amendment was requested to receive additional STBG funding for the reimbursement of Right of Way costs. The amendment increases the amount of the ROW phase to $573,310.00 with the local match being 20%. This Contract was approved. Bids/Purchases i. Approval to purchase of Reelmaster 3100D Sidewinder (reel mower) The Parks Department requests to purchase a Torro Reelmaster 3100D Sidewinder mower at a State Contract price of $36,289.21 to replace unit 725, 3100D purchased 5/17/2002. Unit 725 will be sold to recoup some of the cost. This Purchase was approved. j. Approval to purchase Water Resources Tank Valves and Actuators Two bids were received for valves and actuators to replace the current altitude valves. This will allow for manual or automated control of tank levels and better utilize tank capacity. Staff recommends acceptance of the low bid from Consolidated Pipe & Supply Co. This is a budgeted item. This Bid was approved. 4. Other Business a. Ordinance amending FY20-21 budget and approval to purchase Schwarze A4 Storm Street Sweeper The Street Department manager has received a quote from CMI Equipment Sales, Inc. for a Schwarze A4 Storm Street Sweeper. The current street sweeper is having ongoing breakdowns and repairs. Even with all the repairs made to the current sweeper, it is not performing as well as it once did. CMI Equipment Sales, Inc. has a contract with the State of Tennessee, Central Procurement Office. State bid price for the street sweeper is $162,288.00. The Street Department manager has reviewed the quote and recommends purchasing the street sweeper. This is not a budgeted item. A motion was made by Mayor James Mayberry, seconded by Council Member J. H. Graham, to approve the purchase of a Schwarze A4 Storm Street Sweeper and first reading of ordinance. City Attorney's Report a. City Attorney’s Report-November 2020 City Attorney Will Ridley reported that there haven't been any new lawsuits filed against the City within the last sixty days. There are currently 5 lawsuits pending, four out of five are condemnation suits and the other is the lawsuit against Cantrell Construction, which is currently on hold due to COVID restrictions. This Report was received and filed. 6. City Manager's Report a. City Manager's Report - November 2020 City Manager Greg Wood gave the monthly revenue reports for sales tax, wholesale beer, retail liquor, and hotel occupancy tax. He also presented reports on monthly police and fire statistics, water loss, building permits, special projects, bonded debt, and grants. This Report was received and filed.
