Harrison Council Member Scot Shanks Council Member Art Gernt City Manager Greg Wood City Clerk Valerie Hale City Council Minutes March 9, 2021 BEER BOARD - 5:45 p.m. The Crossville Beer Board met on March 9, 2021 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 5:45 p.m. Present: 5 - Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry 1. Vegas Steakhouse An application has been received from Nicholas Canelles for an on-premises beer permit for Vegas Steakhouse located at 3152 North Main St. This request is due to a change in the corporation. Chief Jessie Brooks reported a clear-records report and recommended approval for Vegas Steakhouse. A motion was made by Council Member Art Gernt, seconded by Council Member Scot Shanks, to approve on-premises permit for Vegas Steakhouse. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry PUBLIC HEARING - 5:50 p.m. 1. Annexation and Plan of Services for 6.75 acres on Lantana Road Eldridge Properties, TGP has requested that their properties at 1997 Lantana Road be annexed into the City. Eldridge Properties is interested in City services in order to develop the tracts into residential housing. Crossville Regional Planning Commission met February 18 and recommends the annexation and approval of Plan of Services. There were not any comments received from the public. This Public Hearing was received and filed. 2. Annexation Progress Report A public hearing is required to provide an update on the annexation and plan of services for: · Tax Map 112, Parcel 15.02-Spruce Loop · The Gardens, Phase VIII, Plat III All services have been provided as requested by the owner/developer. City of Crossville Page 1 City Council Minutes March 9, 2021 REGULAR MEETING - 6:00 p.m. Call to Order The City Council for the City of Crossville met for its monthly meeting on Tuesday, March 9, 2021. Mayor James Mayberry was present and presiding. He called the meeting to order at 6:02 p.m. Steve Pickard, Faith Assembly of God, provided the invocation and the Young Marines presented the colors. Roll Call Present: 5 - Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry Others present: City Manager Greg Wood, City Attorney Will Ridley, City Clerk Valerie Hale, Assistant City Clerk Malena Fisher, Lee Lawson, Rodgers Spencer, Ethan Medley, Jessie Brooks, Fred Houston, Heather Mullinix, Scott Humphrey, Darian Dykes, Levonn Hubbard, Friends and Family of Young Marines and Student of the Month, Edwin Elser, and Steve Pickard. 1. Proclamations/Presentations a. Presentations/Proclamations March 2021 Marlie Reece was announced as the March Student of the Month for “Fairness”. Marlie was nominated by her 6th grade teacher, Ms. Tina Niles. This Proclamation was presented. 2. Public Comment There were not any public comments received. 3. Appointments a. CCCSEC (Sports Council) CCCSEC has recommended the following appointments: Reappoint Brock Hill (12/31/2023) Reappoint Whitney Cole (12/31/2023) Reappoint Casey Scarlett (12/31/2023) Appoint Chris Peterson to vacant position (12/31/2021) Appoint Jim Goodrich to replace Rusty Mellette (12/31/2022) A motion was made by Council Member Scot Shanks, seconded by Council Member Art Gernt, to appoint members as recommended by CCCSEC. Crawford and Mayor James Mayberry b. Stormwater Board of Appeals The Stormwater Board of Appeals requires one member from the City Council. Scot Shanks currently serves in this role and the term expires 03/10/2021. A motion was made by Mayor James Mayberry, seconded by Council Member Rob Harrison, to re-appoint Council member Shanks. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry 4. Consent Agenda Approval of the Consent Agenda A motion was made by Council Member Scot Shanks, seconded by Council Member Rob Harrison, to approve the Consent Agenda Items 4A-N, excluding Item 4H. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry a. Approval of minutes (02/09) The Minutes were approved as recommended. Ordinances on Second Reading b. Ordinance amending Table 1, Title 18: Water and Sewers The Wastewater Department has requested an amendment to the pH level on Table 1 of the Limitations on Discharge Strength; changing it from 6.0-9.0 to 5.5--9.5; therefore, requiring an ordinance amendment. TDEC approves the modification. This Ordinance was approved on second reading. c. Ordinance amending §1-102 pertaining to Order of Business It has been suggested that the Chamber Director provide a report to the Council during its monthly meeting. An ordinance is required to add this item to the Order of Business, which was previously removed by ordinance on 3rd reading 11/7/2017. This Ordinance was approved on second reading. Ordinance updating §4-300 regarding Occupational Safety and Health Program The State of TN requires our Occupational Safety and Health Program to be updated every seven (7) years. This update includes reporting procedures for OSHA/TOSHA. This Ordinance was approved on second reading. Additional Consent Items e. Approval of Eagle Scout Project and permission to apply for grant funds Edwin Elser proposes a project to complete his Eagle Scout award. He has been working with Leisure Services Director Ethan Medley to add a total of (4) benches to playground area and the splash pad at Garrison Park. He proposes to purchase and install the same style of benches already installed. Mr. Elser is trying to raise money through grants from VEC and Walmart. These grants will come directly to the City and he requested permission to apply for the grants under the supervision of the City staff. The approximate cost of each bench is $545 each, plus shipping which is approximately $315.00. Mr. Medley has instructed him on where to place the benches on the existing concrete. Benches will be installed so that they cannot be moved. This Resolution was approved as recommended. g. Approval of Amendment of Contract in Lieu of Performance Bond for Crossville Sanitary Landfill The City closed the landfill in 1995 and was required to provide 30 years of post-closure care. At that time, the cumulative inflation adjusted total of this care was $1,222,912. As each year passes, the amount of financial assurance is reduced. In 2019, the amount was $382,404.21. For 2020, this is allowed to reduce to $324,406.23. This contract is in lieu of providing a performance bond in this amount to guarantee the financial responsibility. This Contract was approved as recommended. h. Approval of Lien Release 113 Old Watkins Road The property located at 113 Old Watkins Road is in the process of being sold by the heirs of the property, some of which are under the age of 18. The property has a lien City of Crossville Page 4 City Council Minutes March 9, 2021 on it by the City in the amount of $458.96 for previous codes violations. The buyer has requested that the City release the lien. The buyer plans to tear down the house on the property and build apartments. A motion was made by Mayor James Mayberry, seconded by Council Member Scot Shanks, to approve lien release upon successful completion of demolition as approved by Codes Director and authorizing City Manager to sign release. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry i. Approval of grant contract in the amount of $15,000 for Avigation Easement Appraisals The contract with the State of Tennessee Aeronautics Division for grant funds in the amount of $15,000 for Avigation Easement Appraisals has been received. This is a 100% grant. This Contract was approved as recommended. j. Approval of loan agreement for Air Force jet The Air Force jet located next to the CCHS football field (Miss Nettie) is on loan to the City of Crossville from the Air Force. This loan is on a yearly basis and requires approval each year of the loan agreement. CCHS has always taken responsibility for maintenance of the jet. This Contract was approved as recommended. k. Approval of contract amendment with CT Consultants for the redesign of the Downtown Improvements Street Lighting An amendment to CT Consultants contract for the redesign of the street lights for the Downtown Improvement Project with hourly services not exceed $25,500 was presented. It was anticipated that the previously TDOT approved lighting plans would be utilized for the installation of the new street lighting. However, due to recent TDOT review comments, the lighting design will need to be revised to address current TDOT requirements and design comments. The City also had other options with VEC that could have provided some of the design work through TVA and those options are not available at this time. The City plans to purchase the poles and fixtures through VEC. The lighting portion of this project does not qualify for the TDOT TAP grant funds. The Director of Engineering recommends the approval of the amendment. This Contract was approved as recommended. Bids/Purchases l. Approval to purchase Headworks side gates for Waste Water Treatment Plant Veolia requests to purchase and install headworks side gates. Bids were solicited and staff recommends the low bidder, R-W Contractors. The amount of the bid is $27,638.80. City of Crossville Page 5 City Council Minutes March 9, 2021 This Bid was approved as recommended. m. Approval to upgrade Gardens lift station for Waste Water Treatment Plant Veolia requests to upgrade the Gardens lift stations. Bids were solicited and staff recommends the low bidder, Pro Electric. The amount of the pump is $23,868. This Bid was approved as recommended. n. Approval of Request for Proposal for Avigation Easement Appraisals Requests for Proposals were solicited from TDOT approved appraisers to provide appraisal reports in relation to the Obstruction Clearing project for the airport. Staff has reviewed the proposals and recommends approving proposals received from JLL Valuation Advisory for formal appraisals and The Miller Company for review appraisals. The appraisals will be paid for by a grant from TDOT Aeronautics. This Proposal was approved as recommended. 5. Other Business a. Ordinance amending FY 20-21 budget 2021 Ford F-750 Regular Cab Dump The Street Department Manager obtained a quote from Ford of Murfreesboro for a new 2021 Ford F-750 Regular Cab Dump with a 12’ bed. Total cost for this vehicle is $84,595.00 without salt equipment and $114,070 with salt equipment. This truck is requested to replace one that was given to Veolia, which was involved in an accident. Insurance proceeds are expected to be $36,000. Ford of Murfreesboro has a contract with the State of Tennessee Central Procurement Office for vehicles. A budget amendment will be required. A motion was made by Council Member Rob Harrison, seconded by Council Member Art Gernt, to approve first reading of budget amendment in the amount of $114,070. City Attorney's Report a. City Attorney’s Report-March 2021 City Attorney Will Ridley reported that there have not been any new law suits filed within the last 30 days. He also reported that he delivered a check from the Brewer Family Trust for property on Interchange Dr. (A portion of Tax Map 73, Parcel 30.03). The funds were being held in escrow as a result of an agreement between Maverick Oils, LLC and the City of Crossville. The amount of the check was $136,133.96. This Report was received and filed. City Manager's Report - March 2021 City Manager Greg Wood gave the monthly reports for sales tax, wholesale beer, retail liquor, and hotel occupancy tax. He also presented reports on monthly police and fire statistics, water loss, building permits, special projects, utility maintenance, bonded debt, and grants.
