Proposed budget and tax rate for FY2022-23 The Crossville City Council held a public hearing to receive comments from the public regarding the FY 22-23 budget and tax rate. Alicia Arehart, Fair Park Senior Center, addressed the Council to thank them for past support and to provide information about the services that Fair Park Senior Center offers. Holly Hanson, Roane State Community College, also addressed the Council about its $150,000 request for a construction project at the Crossville campus for its nursing program. This Public Hearing was received and filed. BEER BOARD - 5:45 p.m. The Crossville Beer Board met on June 14, 2022 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 5:45 p.m. Present: 5 - Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry 1. Buc-ee’s Tennessee, LLC An application has been received for an off-premises beer permit from Buc-ee’s Tennessee, LLC located at 2045 Genesis Rd. Chief Jessie Brooks reported there were not any issues with the application and recommended approval. This Permit was approved. REGULAR MEETING - 6:00 p.m. Call to Order The Crossville City Council met for its monthly meeting on Tuesday, June 14, 2022 at Crossville City Hall. Mayor James Mayberry was present and presiding. He called the meeting to order at 6:00 p.m. Council member Scot Shanks provided the invocation and the Young Marines presented the Colors and led the Pledge of Allegiance. City of Crossville Page 1 City Council Minutes June 14, 2022 1. Proclamations/Presentations a. Presentations/Proclamations - June 2022 Mayor Mayberry presented a proclamation to local amateur radio operators designating June 25-26 as Amateur Radio Field Days. Amateur Radio operators are celebrating over a century of the miracle of the human voice broadcast over the airwaves and have continued to provide a bridge between peoples, societies and countries by creating friendships and the sharing of ideas through providing countless hours of community services through these decades, which are provided wholly uncompensated. The City of Crossville recognizes the services Amateur Radio’s people provide to our many Emergency Response organizations and appreciates the diligence of these “hams” who also serve as weather spotters in the Skywarn program of the US Government Weather Bureau. These same individuals have further demonstrated their value in public assistance by providing free radio communications for local parades and other charitable public events; and The ARRL Amateur Radio Field Day exercise will take place on June 25-26, 2022 and is a 24-hour emergency encampment exercise and demonstration of the Radio Amateurs’ skills and readiness to provide self-supporting communications even in fields without further infrastructure. This Proclamation was presented. 2. Public Comment Randall Kidwell addressed the City Council about the sponsorship of golf tournaments by the City of Crossville. He expressed that he disagreed with the City sponsoring the events. 3. Appointments a. Health and Educational Facilities Board The terms of Howard Mercer, Jr. and Pat Whittenburg are expiring June 14, 2022. This Board only meets as necessary in regards to the issuance of bonds for health-care providers. This Appointment was deferred. b. Tree Board Appointments Mayor Mayberry re-appointed Clarence Coffey and Karl Kilmer to Tree Board positions. Their terms will expire 05/2025. Mayor Mayberry also appointed Mike Stump to the position vacated by Merry Anderson’s resignation. His term will expire 05/2024. This Appointment was approved. City of Crossville Page 2 City Council Minutes June 14, 2022 4. Chamber of Commerce Report Ethan Hadley, President/CEO of Crossville-Cumberland County Chamber. He gave monthly report on activities at the Chamber and upcoming events. a) The Chamber recently hosted WATE for a segment featuring Cumberland County called, "Living in East Tennessee" b) Grand opening for Buc-ee's will be held June 27 at 11:00 a.m. c) Business After Hours to be held June 23 at the Crossville Depot. 5. Consent Agenda Approval of the Consent Agenda Council member Harrison emphasized that the items on the Consent Agenda have been discussed thoroughly at the recent work session and have been recommended for approval by City staff and City Manager. A motion was made by Council Member Rob Harrison, seconded by Council Member Scot Shanks, to approve all items on the Consent Agenda. Approval of minutes (05/10, 05/17, 05/26, 06/07) The Minutes were approved as recommended. Ordinances on Third Reading b. Ordinance adopting the FY2022-23 tax rate The ordinance setting a tax rate for FY2022-23 needs to be passed on 3 readings by June 30. With the reappraisal, the new certified tax rate is $0.6059. This Ordinance was adopted on third reading. c. Ordinance amending Title 8, Chapter 2 regarding beer permits Since the City Council voted to allow alcohol on City-owned properties, a revision to the beer ordinance is necessary to issue permits. This Ordinance was adopted on third reading. Ordinances on Second Reading d. Ordinance amending Title 14, Chapter 5 of the Crossville Municipal Code regarding Business and Outdoor Advertising City of Crossville Page 3 City Council Minutes June 14, 2022 A rough draft of the sign ordinance revision was presented for review. This Ordinance was approved on second reading. e. Ordinance enacting and adopting a 2021-S8 supplement to the Code of Ordinances The 2021-S8 supplement codifies ordinances passed by City Council since the 2019-S7 supplement was added. This Ordinance was approved on second reading. f. Ordinance amending Title 15, Chapter 3 regarding speed limits An ordinance amendment is required to change the speed limit in Crossroads Villages as approved by City Council in 2021. This Ordinance was approved on second reading. Ordinances on First Reading g. Ordinance amending FY21-22 budget-DUI Police Trailer The Tennessee Highway Patrol has received a grant on the City’s behalf to purchase a DUI trailer. This grant is for $25,500 and will be reimbursed to the City. The City currently has a DUI trailer purchased through the same process in 2004. The old one will be returned to the granting agency. This Ordinance was approved on first reading. Additional Consent Items h. Approval of Debt Policy The City Debt Policy needs to be reviewed and accepted each year. This Policy was approved as recommended. i. Approval of temporary street closing for Pro Troop Rally on July 4 Debbie Towns has requested that Main Street in front of the Courthouse be closed on Monday, July 4, from 10 a.m. to 12:00 p.m. for the annual Pro-Troop Rally. This Permit was approved as recommended. j. Approval of temporary street closing for Fourth of July Children’s Parade The DAR is sponsoring the annual Fourth of July Children’s Parade on Monday, July 4. The parade lineup will begin at 9:30 a.m. at the Palace Theatre, ending at the Crossville Depot. They request Main Street to be closed from 9:30 a.m. to 11:30 a.m. This Permit was approved as recommended. City of Crossville Page 4 City Council Minutes June 14, 2022 k. Approval of temporary street closing for CCHS Homecoming Parade Approval has been requested for temporary street closings for the CCHS Homecoming Parade on Friday, September 23, 2022. The parade will start at the CCHS stadium at 1:30 p.m. This Permit was approved as recommended. l. Approval of contract with Upland Design Group for Architectural Services A contract for approval was presented. The amount of the contract is 8% of the total project and excludes services provided by Ballard & King and consultant travel. This Contract was approved as recommended. m. Approval of lease regarding City-owned property at 127 Livingston Rd. The property owner that sold the property to the City located at 127 Livingston Rd. (Indoor Rec Facility property) has sold the business and the new owner (Kari Galyon) is requesting an extension of the August 31 deadline to vacate the property. A lease agreement was presented for review. This Contract was approved as recommended. n. Approval of Off-Airport Land Lease with Federal Aviation Administration The FAA is requesting renewal of a 20-year contract for land that serves as an outer marker for the FAA, which is located on Fox Creek Road and Old Stagecoach Place. This is a “No Cost” lease which is expiring at the end of July. This Contract was approved as recommended. Bids/Purchases o. Approval of bid award for HVAC Replacement-Fire Station 1 Crossville Fire Department solicited RFPs for HVAC replacement of Fire Station #1 and recommends accepting the low bid from Lee Company in the amount of $18,672.00. The funds are budgeted in the current fiscal year. This Bids/Purchases was approved as recommended. p. Approval to replace cushion check valves Veolia requests approval of expenditure for the replacement of cushion check valves at the Old Landfill Lift Station. The total cost of the repair is $6,653.61. A budget amendment is not necessary. This Bids/Purchases was approved as recommended. q. Approval of bid award for Kayak Launch at Meadow Park Lake RFPs were solicited for a kayak launch and the Engineering Department recommends accepting the low bid from Southern Services, LLC in the amount of $8,070.00. The funds are budgeted in the current fiscal year. City of Crossville Page 5 City Council Minutes June 14, 2022 This Bids/Purchases was approved as recommended. 6. Other Business a. Ordinance approving FY22-23 Budget The City Council discussed income from hotel occupancy tax, golf tournament sponsorship, donation to Roane State Community College, and sales tax generated from the opening of Buc-ee's. Mayor Pro Tem RJ Crawford made a motion to approve 3rd reading of the budget with 3 edits: lower sponsorship of Tennessee Women's Open to $5,000, lower sponsorship of Tennessee Senior Men's Open to $5,000 and one time to donation to Roane State be lowered to $50,000. The motion failed for lack of a second. A motion was made by Council Member Rob Harrison, seconded by Mayor Pro-tem R.J. Crawford, to leave golf sponsorships at $10,000 each and lower Roane State donation to $100,000. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry b. Discussion and action regarding Part-Time and Seasonal Hourly Increase The Human Resources office is recommending the hourly rate for part-time and seasonal staff be increased. Part-time staff, who work year-round and do not exceed 28 hours per week, are currently at $10.61 per hour. This rate has been fixed and in place since 2015. It is recommended that the rate be increased to $11.11, or greater. There are currently 7 part-time staff members. Seasonal staff are currently at $9.50 per hour. This rate has been fixed and in place since 2019. It is recommended that the hourly rate be increased to $10.00, or greater. A motion was made by Mayor Pro-tem R.J. Crawford, seconded by Mayor James Mayberry, to increase hourly rater for part-time employment to $13.50 and $12.00 for seasonal employment. City Attorney's Report a. City Attorney’s Report-June 2022 City Attorney Will Ridley reported that there have not been any new lawsuits within the last 30 days. Mr. Ridley also reported about an airplane being stored at the airport without a lease, and the owner is not paying for storage. The airplane is disassembled and taking up space that could be rented. The lease with the FBO operator, Azure City of Crossville Page 6 City Council Minutes June 14, 2022 Flight Support, is not clear as to who is in charge of eviction as the space is technically occupied by Azure. Azure's attorney advised that it would be the City of Crossville responsibility and Mr. Ridley advised that it would be Azure's responsibility. The City Manager suggested the situation be resolved and proceed with eviction. The City Attorney stated he has a conflict of interest as he is currently serving as General Sessions Judge. He also explained that since the City Manager does not have the authority to enter into an agreement with an attorney or to authorize a lawsuit, he recommended that the City Council approve a letter of engagement with local attorney, Nathan Clouse, for a fee of $750 to handle the case. A motion was made by Council Member Scot Shanks, seconded by Mayor Pro-tem R.J. Crawford, to approve engagement letter with Nathan Clouse. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry Mr. Ridley informed the City Council that MTAS had been consulted regarding the employment of a Medical Director. They issued an opinion that the City of Crossville nor any municipality has the authority to hire or contract with a medical director unless legislation is passed that would allow it; therefore, the City's contract with Dr. Mark Fox is null and void. He indicated that Dr. Fox can participate as a First Responder if he chooses to do so, or as a Volunteer Firefighter. Mr. Ridley explained that there wasn't an issue when Dr. Fox was the Medical Director for the County. Mr. Ridley explained the legislative process. 8. City Manager's Report a. City Manager's Report - June 2022 City Manager Wood gave the monthly report on sales tax, wholesale beer tax, liquor inspection fees, and hotel occupancy tax. He also reported on activities within the police, fire, airport, and codes departments; as well as special projects, debt, grants, and water loss. Mr. Wood announced Billy Martin's retirement effective June 30. Mr. Wood asked Wastewater Treatment Plant Operator, Darian Dykes, to explain issues he's experiencing at the plant. He expressed that the plant is averaging 7 MGD, which is twice its capacity. Mr. Wood related that upcoming COVID funding will help reduce I&I, improving the plant's efficiency.
