Mayor James Mayberry was present and presiding. He called the meeting to order at 6 p.m. Fire Chief Chris South provided the invocation and the Young Marines presented the Colors and led the Pledge of Allegiance. Proclamations/Presentations a. Presentation/Proclamations September 2022 Rhett Sharp received the Student of the Month for the September Character trait, Cooperation. Mayor Mayberry presented him with a proclamation. Mayor Mayberry also presented a proclamation to Julia Goss and Karen Prince, who were representatives for Adult Literacy month. This Presentation was announced. 2. Public Comment There were not any comments received. 3. Appointments - None 4. Chamber of Commerce Report Ethan Hadley, President of Crossville-Cumberland County Chamber of Commerce, reported on the monthly activities of the Chamber. He also announced that the tourism statistics for the State of Tennessee were released and Cumberland County was ranked 15th, generating $170 million tourism dollars. This report was received. Consent Agenda Approval of the Consent Agenda A motion was made by Council Member Rob Harrison , seconded by Council Member Scot Shanks, to approve the Consent Agenda, Items 5A-M as the items have been discussed at the recent work session and recommended by City staff. Approval of minutes (08/09, 08/16, 08/26, 09/06) The Minutes were approved as presented. Ordinances on First Reading b. Ordinance amending FY 2022-2023 Budget A budget amendment is necessary to correct the FY22-23 budget in the amount of $295,625. This Ordinance was approved on first reading. c. Ordinance amending FY22-23 Budget-Northwest Connector 3 Staff has been notified by TDOT that additional deposits will be required for the Northwest Connector 3 project due to the bid being over the original cost estimate. The City has currently received invoices in the amount of $483,375.28; however, Staff requests a budget amendment in the amount of $1,996,000.00 to cover all of the anticipated overages. This Ordinance was approved on first reading. Additional Consent Items d. Approval of temporary street closing for CCHS Homecoming Parade CCHS staff requests approval to change the date of the temporary street closure for the CCHS Homecoming Parade approved by City Council. The original date approved was on Friday, September 23, 2022. They request to change the date to Thursday, September 22 at 1:30 and reserve the previously approved date as a rain date. This Permit was approved as recommended. e. Approval of 2022-23 lease of Catoosa Utility Department building The lease expires September 30 on the building occupied by the Catoosa Utility Department. The lease amount is $1,550 per month, which is the same as the current City of Crossville Page 2 City Council Minutes September 13, 2022 lease. This Contract was approved as recommended. f. Approval of contract for telemetry system extended service warranty with MicroComm The current contract for service warranty for Catoosa telemetry expires on October 25, 2022. The contract includes service warranty coverage for damage to the telemetry system, including lightning. Staff requests approval to renew the annual contract in the amount of $7,400. This Contract was approved as recommended. g. Approval of FY22-23 Airport Maintenance Grant The Tennessee Department of Transportation-Aeronautics Division is providing a maintenance grant in the amount of $15,000 to cover maintenance costs at the Crossville Memorial Airport. This Contract was approved as recommended. Bids/Purchases h. Approval of Employee Health Insurance Renewal The renewal has been received for plan year 2023 on employee health insurance. The renewal came in at a 9.71% increase. Employee insurance coverage would remain the same for 2023. A 10% increase was budgeted for employee insurance, therefore the amount budgeted will cover the increase. This Bids/Purchases was approved as recommended. i. Approval of bid award for GNSS Network Reference Station Kit Engineering Department solicited bids for GNSS Network Reference Station Kit. There was only one bid placed by Precision Products, LLC for $21,640.00. The staff recommends approval of this bid. A budget amendment is not necessary. This Bids/Purchases was approved as recommended. j. Approval for bid award for Turbidimeter Replacement Water Plant supervisor solicited bids for Turbidimeter Replacement. There was only one bid submitted by Labtronx for $63,329.40. Staff recommends approval of this purchase. A budget amendment is not necessary. This Bids/Purchases was approved as recommended. k. Approval of repairs at Wastewater Treatment Plant for Housing Authority North Lift Station Veolia is requesting to replace a pump, discharge piping, and base elbow in the amount of $13,555.83. The quotes are attached for review from the only provider available. The replacement is due to the age and condition of the equipment and to City of Crossville Page 3 City Council Minutes September 13, 2022 avoid service interruption. A budget amendment is not necessary. This Bids/Purchases was approved as recommended. l. Approval of MIOX Cell Rehabilitation The cell for the MIOX machine for the Holiday Hills Water Plant is out of service. MIOX has provided a quote to rebuild the cell in the amount of $12,780. Staff recommends rebuilding rather than replacing due to the cost to replace being twice as much. This Bids/Purchases was approved as recommended. m. Approval of resolution to submit application and receive ARPA funds The City of Crossville has been appropriated $2,113,187.85 by Tennessee Department of Environment and Conservation (TDEC) through the American Rescue Plan Act (ARPA). Staff requests approval to submit an application and receive these funds and commit to the maximum 15% local match. The amount could be reduced to 10% if the projects address the critical needs identified on the infrastructure scorecard. Projects proposed by Staff: Genesis/I-40 Sewer upgrade, SCADA upgrade, I & I, and Hwy 127/I-40 sewer upgrade. Cumberland County has also received funds and proposes to transfer an amount to the City of Crossville if approved by the Cumberland County Commission. The amount will be $1,436,564.55 based upon cost estimates of the projects prioritized by the Mayors. Staff requests approval to receive the funds. Projects to be funded through County funds: Catoosa/Creston area waterline improvements, Cumberland County jail bar screen, Tansi emergency station sewer pump, Peavine/I-40 sewer upgrade, Holiday Plant water pump drives, and Obed River bar screen. This Resolution was approved as recommended. 6. Other Business a. Discussion and action regarding Mobile Home Variance - Cook Road The owner of the property, located at 627 Cook Road, is wanting to install a manufactured home on the lot. The manufactured home was constructed in 1997. Per the City of Crossville’s Mobile Home Ordinance 14-402(A)(1), which states “The mobile home is new or no more than 20 years old,”. The property owner is requesting a variance from the maximum age limit. Since this is a variance request to an ordinance, only the City Council may grant or deny it. The Planning Commission reviewed the information on July 18, 2022 and voted to send the request to City Council for approval. The Codes Department recommends approval. A motion was made by Council Member Scot Shanks, seconded by Council Member Rob Harrison, to approve the variance based on the recommendations of the Crossville Regional Planning Commission and the Crossville Codes Department. Approval of sidewalk at corner of Webb Avenue & Neecham Street Crossville First United Methodist is in the process of constructing a retaining wall at the corner of Webb Avenue and Neecham Street due to safety and erosion concerns. The church requests that the City build a sidewalk at the corner to the end of the wall. Their project won’t begin until the sidewalk has been completed; therefore, they are only asking for approval before starting the wall, not necessarily completion of the sidewalk at this point. They have agreed to grant any access or easements as required. Director of Engineering Tim Begley reported the cost is estimated at $3,737.72. Council Member Harrison stated a conflict of interest as he is a member of Crossville First United Methodist Church. A motion was made by Council Member Scot Shanks, seconded by Council Member Art Gernt, to approve construction of the sidewalk. The motion carried by the following vote: Aye: 4- Council Member Scot Shanks, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry Recuse: 1- Council Member Rob Harrison c. Acceptance of property donation from TAP Publishing/Cosby Harrison Company, LLC TAP Publishing/Cosby Harrison Company, LLC desires to donate to the City of Crossville two parcels, Tax Map 113B-G-13.00 & 14.00. The owners will provide a quitclaim deed if accepted. There is a 5 ft. strip of land between the two parcels that has been turned over to the Clerk & Master for back taxes. The Clerk & Master advised it will be two years before the property will be sold. City Attorney Randy York reported that the property owners live in White House, Tennessee and he will attempt to contact them. The property taxes have not been paid since 2012 and the property is assessed at $200-$300. The lot will be sold for back taxes in 2023. Council member Harrison stated a conflict of interest as he is related to the owners of TAP Publishing/Cosby Harrison, LLC. A motion was made by Council Member Scot Shanks, seconded by Council Member Art Gernt, to accept property donation. Discussion and action regarding TCAT proposal for property donation at Interchange Park TCAT President, Cliff Wightman, submitted a proposal regarding donation of the City’s lot that TCAT currently uses for its truck driving school. A 30-day public notice will be required. City of Crossville Page 5 City Council Minutes September 13, 2022 Mayor Mayberry asked if the City needed CDL training, would TCAT be willing to provide training for 1-2 City employees per year and Mr. Wightman agreed. A motion was made by Council Member Scot Shanks, seconded by Council Member Rob Harrison, to approve donation and start 30-day advertising period. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry e. Discussion regarding speed limit on Old Mail Road City Council recently discussed commercial traffic on Old Mail Road and expressed desire to reconsider the speed limit for the road. It is currently 30 mph. A motion was made by Mayor James Mayberry, seconded by Council Member Art Gernt, to reduce speed limit on Old Mail Road to 25 mph. The motion carried by the following vote: Aye: 5- Council Member Scot Shanks, Council Member Rob Harrison, Council Member Art Gernt, Mayor Pro-tem R.J. Crawford and Mayor James Mayberry 7. City Attorney's Report a. City Attorney’s Report-September 2022 City Attorney Randy York reported there have not been any new lawsuits from the last report. One lawsuit (Jenna Walls vs. City of Crossville) has been dismissed, which was resolved through the Building Codes Board of Appeals. There are six condemnation cases and Mr. York reported that he has a conflict of interest on one of the cases and is working with the Attorney General's office about the matter. He stated he would report back to City Council on the status next month. City Attorney Randy York also reported that Nathan Clouse shared an update via email on the abandoned airplanes at the airport. All owners and lien holders have been notified. The State of Tennessee has a lien on the 1980 Piper PA 31T1, in the amount of approximately $43,000 and Edward Johnson also has a lien on the plane. The amount is unknown and Mr. Johnson has not responded. Cellular Partners, Inc. has a lien on the 1977 Piper PA 32R300. The company has been notified, not responded and the lien amount is unknown. Mr. York stated that Nathan Clouse advised that if the City desires, they can proceed with selling the airplanes. First, notice must be given through newspaper publication.. City Manager Wood recommended to sell the airplanes on www.gov deals.com. Mr. Wood stated the airplanes have been abandoned and one is partially disassembled in the quonset hut and is taking away space that could potentially be leased. The other aircraft has been sitting in the weather and is not in good condition although was very valuable at one point. A motion was made by Mayor James Mayberry, seconded by Council Member Scot Shanks, to authorize publishing notice and subsequent sale. City Manager's Report City Manager Greg Wood gave monthly revenue reports on sales tax (over $1 million), wholesale beer tax, liquor tax, hotel/motel tax, police & fire activity reports. Mr. Wood also reported on water loss and utility maintenance, and stated that building permits remain steady. Mr. Wood reported that easements for the downtown sidewalk project have been acquired except for one and that the Lantana Road and Main Street traffic signal replacement project is expected to start December 5. Mr. Wood announced that the Fly-In will be held October 1 and thanked J.R. Wauford Co. (in the audience) for its sponsorship. He also reported that there were other sponsors allowing the Cessa plane rides to be only $25. This Report was received and filed.
