Regular Meeting
Call to Order
Present 4 - Vice Chair Kevin Poore, Gordon Atchley, Council Member Rob Harrison,
and Chairman Mike Moser
Absent 3 - Greg Tabor, Mayor James Mayberry, and Landon Headrick
Also present were Tim Wilson, Kevin Dean and Malena Fisher.
Chairman Mike Moser called the meeting to order at 12:03 p.m.
Agenda Items
1. Approval of 6/17 minutes
A motion was made by Vice Chair Kevin Poore, seconded by Council Member
Rob Harrison, to approve the minutes of the 6/17 meeting. The motion carried
by the following vote:
Aye: 4- Vice Chair Poore, Atchley, Council Member Harrison and Chairman Moser
Absent: 3- Tabor, Mayor Mayberry and Headrick
Landon Headrick arrived at 12:04 p.m.

3. The Gardens Phase 8 Plat 4a, Final
The developer is proposing a 14-lot subdivision between Holly Tree Drive and Northside
Drive (Northwest Connector). This proposed subdivision is a part of The Gardens and
would be Phase I of the preliminary plat approved in November 2020. This phase would
include approximately 1,188 feet of 4-inch low pressure sewer, 1,282 feet of 8-inch
water line, and 1,241 feet of new road. Letters of Credit have been provided for the
proposed infrastructure in the following amounts:
• Completion of Sewer: $87,630.00 (6-month agreement)
• Completion of Water: $107,950.00 (6-month agreement)
• Completion of Road Base and Drainage: $114,300.00 (6-month agreement)
• Completion of Finish Road and Curbing: $114,300.00 (12-month agreement)
City Planner Kevin Dean amended the legislative text to include:
• Completion of Water Distribution: $15,000 (12-month agreement)

As in previous phases of the Gardens, they are requesting a variance for outside
setbacks on the zero lot lines from the required 15-foot to a 10-foot setback, and a
side setback on lots abutting greenspace from the required 10-foot to a 6-foot
setback.
A motion was made by Vice Chair Kevin Poore, seconded by Council Member
Rob Harrison, to approve the variance. The motion carried by the following
vote:

Headrick
Absent: 2- Tabor and Mayor Mayberry
A motion was made by Vice Chair Kevin Poore, seconded by Council Member
Rob Harrison, to approve the final plat and accept the letters of credit. The
motion carried by the following vote:
Aye: 5- Vice Chair Poore, Atchley, Council Member Harrison, Chairman Moser and
Headrick
Absent: 2- Tabor and Mayor Mayberry
2. Baisley Split - Glenn Clark, HWY 70N
The developer is proposing purchase of an approximately 50-foot-wide strip off the
adjacent property, to be joined to his greater than 5-acre tract. The proposed strip is
on the opposite side of the property from the existing house and according to the
property owner, will not affect the existing septic system field lines. They are
requesting a variance for an additional soils test for a backup system. Staff
recommends approval of the variance due to the size of the remaining parcel (3.78
acres) and the distance from the existing house.
A motion was made by Gordon Atchley, seconded by Vice Chair Kevin Poore,
to approve the variance and plat. The motion carried by the following vote:

Lantana Rd, near the intersection with Miller Ave. Approved and recorded at the
Register of Deeds as DB1613p2341

A motion was made by Gordon Atchley, seconded by Councilmember Rob
Harrison, to adjourn the meeting. Motion carried by the following vote:
