Main Street The purpose of this meeting was to consider Personnel & Ordinance Committee matters; however, members of the Town Council who were not members of the committee were in attendance and participated in the discussion, resulting in a special meeting of council. R/R Re: Amendment to Section 8.20, Military Leave, of the Personnel Policies and Employee Handbook Mrs. Jones presented the report and recommendation stating the existing policy for military leave is inconsistent with current requirements of Virginia Code § 44-93, which requires up to 21 days of paid military leave per federal fiscal year for all days during which an employee is engaged in federally funded military duty, to include training duty, or state active duty as ordered by the Governor. The policy amendment would become effective immediately upon approval by council. There is no financial impact for the proposed changes. Designation of Consent Agenda Item - R/R Re: Amendment to Section 8.20, Military Leave, of the Personnel Policies and Employee Handbook ORDINANCE ITEMS – None TOWN & COUNTY INTERACTION COMMITTEE Potential Items for Discussion at Next Interaction Committee Meeting – Scheduled for May 22, 2026 Mr. Short stated that the Culpeper County Fire Inspector was still on the agenda. He also informed the committee that the May meeting would be held at the new swimming pool and included a tour. Chapter 11, Sec. 11-45(b) currently reads: When a parking space is parallel with the adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked so that the vehicle shall be alongside the curb and between the front and rear lines and markings established for such space. When a parking space is diagonal to the curb or sidewalk, any vehicle parked in such parking space shall be parked with the vehicle directed at the curb and between the lines and markings established for such space. A vehicle parked parallel to a curb or sidewalk shall be parked faced in the direction of the flow of traffic. Page 14 of 22 Agenda Item Summary Committee: Ordinance Committee Title: R/R Re: Ordinance No. O-2026-005; Amending Chapter 2, Section 2-77 of the Town Code, Relating to Order of Business (first reading) Background: Beginning July 1, 2026, no final action may be taken on any items added to an agenda after a meeting commences unless the matter is time-sensitive or is the subject of a closed meeting, per SB699 which was signed into law by the Governor. The term “time-sensitive” is not defined in FOIA, and because it is new language, there are no court decisions or advisory opinions interpreting it; which could increase the Town’s legal exposure when items are added to the agenda after a meeting has commenced. In reviewing the origin of SB699, its intent is to increase public notice by minimizing items being added to an agenda at the meeting and then immediately approved. Currently Sec. 2-77 of the Town Code requires all items to be directed through a council committee before being added to a regular council agenda. Page 19 of 22 ORDINANCE #O-2026-007 Introduction: June 9, 2026 Adoption: July 14, 2026 Effective: July 14, 2026 AN ORDINANCE TO AMEND SECTIONS 4-6 AND 4-7 OF CHAPTER 4 OF THE CODE OF ORDINANCES, TOWN OF CULPEPER, VIRGINIA (1991), AS AMENDED, RELATING TO CRIMINAL AND CIVIL ENFORCEMENT OF BUILDING CODE VIOLATIONS, UNSAFE STRUCTURES, AND NUISANCES WHEREAS, the Town of Culpeper wishes to amend its current Ordinance relating generally to the criminal and civil enforcement of building code violations, unsafe structures, and nuisances. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Town Council for the Town of Culpeper, Virginia, meeting in regular session this 14th day of July, 2026, that the Town Code be amended as follows: That Sections 4-6 and 4-7 of Chapter 4 of the Code of Ordinances, Town of Culpeper, Virginia (1991), as amended, are amended as follows: Sec. 4-6. Violations. Whoever violates any provisions of this chapter, by doing a prohibited act, or failing to perform a required act, or failing to perform permitted acts in the prescribed manner shall be subject to the penalties as specified in the Code of Virginia and the USBC. (1) Criminal. Unless designated otherwise in this Article, violations of this Chapter are misdemeanors and, upon conviction, may be punished by a fine or incarceration of not more than that amount or period authorized for violations by the Code of Virginia, as applicable. (2) Civil. (1) There are hereby established civil penalties for any violation of the provisions of Part I of the USBC, known as the Virginia Construction Code, and Part III of the USBC, known as the Virginia Maintenance Code, (collectively, the Code) adopted by the Town in this Chapter. Upon failure to abate or remedy pursuant to a notice of violation, the Building Official (with respect to the Virginia Construction Code), Property Maintenance Code Official (with respect to the Virginia Maintenance Code), or their designee may issue a civil summons to any person in violation of any of the provisions of the Code as enumerated herein. The penalty for any one violation shall be a civil penalty of not more than $100 for the initial summons, and not more than $350 for each additional summons. Each day during which the violation is found to have existed shall constitute a separate offense. However, specified violations arising from the same operative set of facts shall not be Page 20 of 22 Ord. No. O-2026-007 7/14/2026 Page 2 charged more frequently than once in any ten-day period, and a series of specified violations arising from the same operative set of facts shall not result in civil penalties which exceed a total of $4,000. (2) Any person summoned for a scheduled violation may make an appearance in person or in writing by mail to the Town Treasurer’s Office prior to the date fixed for trial in court. Any person so appearing may enter a waiver of trial, admit liability, and pay the civil penalty established for the offense charged. Such person shall be informed of their right to stand trial and that a signature to an admission of liability will have the same force and effect as a judgment of court. As a condition of waiver of trial, admission of liability, and payment of a civil penalty, the violator and a representative of the locality shall agree in writing to terms of abatement or remediation of the violation within six months after the date of payment of the civil penalty. (3) If a person charged with a scheduled violation does not elect to enter a waiver of trial and admit liability, the violation shall be tried in the General District Court in the same manner and with the same right of appeal as provided for by law. In any trial for a scheduled violation authorized by this section, it shall be the burden of the locality to show the liability of the violator by a preponderance of the evidence. An admission of liability or finding of liability shall not be a criminal conviction for any purpose. (4) If the violation concerns a residential unit, and if the violation remains uncorrected at the time of assessment of the civil penalty, the court shall order the violator to abate, or otherwise remedy through hazard control, the violation in order to comply with the Code. Except as otherwise provided by the court for good cause shown, any such violator shall abate, or otherwise remedy through hazard control, the violation within six months of the date of the assessment of the civil penalty. (5) If the violation concerns a nonresidential building or structure, and if the violation remains uncorrected at the time of assessment of the civil penalty, the court may order the violator to abate, or otherwise remedy through hazard control, the violation in order to comply with the Code. Any such violator so ordered shall abate, or otherwise remedy through hazard control, the violation within the time specified by the court. (6) The remedies provided for in this Section are cumulative and not exclusive and shall be in addition to any other remedies provided by law. Sec. 4-7 Abatement or removal of nuisances. A notice of violation issued pursuant to the Uniform Statewide Building Code shall constitute reasonable notice under Va. Code § 15.2-1115(A). This ordinance shall become effective upon adoption.
