CITY OF CUMMING COUNCIL MINUTES WORK SESSION OCTOBER 6, 2020 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, October 6, 2020, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present. Mayor Troy Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked Mr. Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- Mayor Brumbalow requested to combine under New Business, C. City Center, Items #1 RFP Results- Buildings A, B, C and D Concrete and # 2 RFP Results- Building M Concrete. A motion was made by Jason Evans and seconded by Christopher Light to combine the two items under New Business as requested by Mayor Brumbalow and adopt the remainder of the agenda as presented. The motion carried 5-0. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of September 15, 2020: A motion was made by Chad Crane and seconded by Jason Evans to approve the minutes of the Regular Council Meeting of September 15, 2020 as presented. The motion carried 5-0. B. Executive Session Meeting of September 15, 2020: A motion was made by Joey Cochran and seconded by Christopher Light to approve the minutes of the Executive Session Meeting of September 15, 2020 as presented. The motion carried 5-0. VI. Acknowledgements, Proclamations, Resolutions, etc.: A. Hispanic Heritage Month: Mayor Brumbalow read aloud and presented a proclamation proclaiming September 15 through October 15, 2020 as Hispanic Heritage Month in the City of Cumming. VII. Old Business- none VIII. New Business A. Administration: 1. Alcohol Ordinance Update (Information Only): City Attorney Kevin Tallant made a presentation about the changes coming to the City’s Alcohol Code as a result of legislation passed by the Georgia General Assembly in 2020. Among these changes coming as a result of the 2020 legislation are changes to tastings, deliveries, permitting, Sunday sales and distance requirements. A draft ordinance would be presented at a future meeting for the Mayor and Council’s comments. 2. Land and Water Conservation Grant Resolution: City Administrator Phil Higgins presented a resolution to authorize the City of Cumming to submit a Pre-application to the Department of Natural Resources for funding, (up to $500,000.00), from the Land and Water Conservation Fund. The City has to assure that it has the ability and intention to finance their 50 percent of the total project cost and will move forward with due diligence to prepare, or have prepared, appropriate documentation required for a formal LWCF application. A motion was made by Chad Crane and seconded by Jason Evans to authorize the Resolution to submit the Pre-application. The motion carried 5-0. 3. Georgia Power- Request for Easement: The Georgia Power Company requested an easement for property located at 203 E. Main Street, Cumming, Georgia 30040. This is required to upgrade an existing transmission line. This was postponed until the October 20, 2020 regular Council Meeting. B. Planning and Zoning 1. Zoning Ordinance Amendment (Information Only) City Attorney Kevin Tallant presented the following ordinance: AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF CUMMING, GEORGIA, TO REGULATE TEMPORARY OPEN-AIR MARKETS; TO PROVIDE FOR FEES; TO PROVIDE FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. After receiving input from the Council, the City Attorney will revise the drafted ordinance for their consideration at a future meeting. C. City Center 1. RFP Results- Buildings A, B, C and D Concrete and 2. RFP Results- Building M Concrete: City Administrator Phil Higgins reported that six (6) proposals were received. After consulting with our Construction Management Contactor, Beltan Properties, it is my recommendation to accept the proposal from Cooper & Company. Theirs was the only proposal to include sandwich roofing between the concrete roofing slabs and weatherproofing. A motion was made by Jason Evans and seconded by Christopher Light to accept Cooper & Company’s proposal in the amount of $1,590,000.00 for Buildings A, B, C, D and M Concrete. The motion carried 5-0. 3. Stream Mitigation Credits: City Administrator Phil Higgins explained the purchase of Stream Mitigation Credits were needed for stream crossings to complete the City Center Project. Director of Engineering with Foresite Group, Mr. Alan Neal explained that the use of culvert pipe, as opposed to arch span-type culverts, for four (4) of the six (6) required stream crossings would result in a substantial savings. A motion was made by Christopher Light and seconded by Chad Crane to purchase the Stream Mitigation Credits needed to proceed with the City Center Project for a cost of approximately $240,240.00. The motion carried 5-0. IX. Announcements: A. Taste of the Fairgrounds- Oct. 9-11 & 16-18 B. House of Four Scythes Haunted Attraction at the Fairgrounds (Fundraiser for American Cancer Society) Oct. 9, 10, 16, 17, 23, 24, 30 & 31 X. Executive Session Mayor Brumbalow stated there a need to have Executive Session to discuss real property acquisition and leasing. A motion was made by Chad Crane and seconded by Jason Evans to recess into executive session. The motion carried 5-0. After a brief executive session, a motion was made by Linda Ledbetter and seconded by Joey Cochran to reopen the regular meeting. The motion carried 3-0. XI. Adjournment: A motion was made by Jason Evans and seconded by Linda Ledbetter to adjourn. The motion carried 3-0. Approved this 20th day of October, 2020.
