COUNCIL MINUTES
WORK SESSION
OCTOBER 5, 2021
I. There was a Work Session meeting of the Mayor and Council of the City of Cumming
on Tuesday, October 5, 2021, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor
and all Council Members were properly notified as required by law and all were present.
Mayor Troy Brumbalow presided over the meeting and called the meeting to order.
II. Invocation: Mayor Brumbalow asked Mr. Phil Higgins to deliver the invocation.
III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American
Flag.
IV. Consider Agenda for Adoption- Mayor Brumbalow requested to remove under New
Business, B. City Center: 1. Report of Quotes- Amphitheater and Building- A
Outdoor Lighting and 2. Report of Quotes- Amphitheater and Building- A Outdoor
Audio. A motion was made by Chad Crane and seconded by Jason Evans to amend the
agenda as requested by Mayor Brumbalow and adopt the remainder of the agenda as
presented. The motion carried unanimously.
V. Consider for adoption the following meeting minutes: A. Regular Council Meeting
of September 21, 2021: A motion was made by Chad Crane and seconded by Jason Evans
to approve the minutes of the Regular Council Meeting of September 21, 2021 as
presented. The motion carried unanimously.
VI. Acknowledgements, Proclamations, Resolutions, etc.- A. Retired Educators Day:
Mayor Brumbalow read aloud a proclamation proclaiming Sunday, November 7, 2021 as
Retired Educators Day in the City of Cumming.
B. Hispanic Heritage Month: Mayor Brumbalow read aloud a proclamation proclaiming
September 15 through October 15, 2021 as Hispanic Heritage Month in the City of
Cumming.
VII. Old Business A. Utilities: 1. City/ County Water Storage IGA: City Attorney
Kevin Tallant presented a revised copy of the IGA with Forsyth County concerning
Water storage in Lake Lanier and the allocation of Withdrawals. He stated that the clause
to review the agreement after two years was agreeable by both parties and the
Environmental Protection Division of the State of Georgia. After further discussion, a
motion was made by Christopher Light and seconded by Jason Evans to approve the City/
County Water Storage IGA. The motion carried unanimously.
VIII. New Business A. Administration: 1. Legal Memorandum- Opioid
Manufacturer: City Attorney Kevin Tallant explained that Mallinckrodt PLC, a
significant manufacturer of opioid medications has filed multiple bankruptcy cases in
Delaware. The firm of Brinson Askew Berry is representing local and county governments
in the plan to provide a resolution to the claims and losses experienced by this opioid crisis.
A motion was made by Joey Cochran and seconded by Chad Crane to ratify the decision
to accept the reorganization plan. The motion carried unanimously.
B. City Center: 1. Report of Quotes- Amphitheater and Building-A Outdoor
Lighting: Postponed until the October 19, 2021 regular Council Meeting.
2. Report of Quotes- Amphitheater and Building- A Outdoor Audio: Postponed until
the October 19, 2021 Regular Council Meeting.
IX. Announcements- A. Cumming Country Fair and Festival, October 7-17, 2021.
X. Executive Session: Mayor Brumbalow stated there was no need to have Executive
Session.
XI. Adjournment: A motion was made by Chad Crane and seconded by Jason Evans to
adjourn. The motion carried unanimously.
