There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, May 3, 2022, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present. Mayor Troy Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded by Jason Evans to adopt the agenda as presented. The motion carried unanimously. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of April 19, 2022: A motion was made by Jason Evans and seconded by Joey Cochran to approve the minutes of the Regular Council Meeting of April 19, 2022 as presented. The motion carried unanimously. B. Executive Session Meeting of April 19, 2022: A motion was made by Jason Evans and seconded by Chad Crane to approve the minutes of the Executive Session Meeting of April 19, 2022. The motion carried unanimously. VI. Acknowledgements, Proclamations, Resolutions, etc.- A. Professional Municipal Clerks Week, May 1-7, 2022. Mayor Brumbalow read aloud and presented a proclamation proclaiming May 1-7, 2022 as Professional Municipal Clerks Week in the City of Cumming, Georgia. City Clerk Jeff Honea accepted the Proclamation on behalf of the City’s accounting staff. B. National Travel & Tourism Week, May 1-7, 2022. Mayor Brumbalow read aloud and presented a proclamation proclaiming May 1-7, 2022 as National Travel & Tourism Week in the City of Cumming, Georgia. Members of the Forsyth Chamber of Commerce accepted the proclamation. VII. Old Business: None VIII. New Business A. Administration: 1. 2021 Audit Report- Clay Pilgrim, Rushton Group: Mr. Clay Pilgrim with Rushton Group presented an overview of the City of Cumming 2021 Annual Audit. After some discussion, a motion was made by Chad Crane and seconded by Joey Cochran to accept the 2021 Audit Report by Rushton Group as presented. The motion carried unanimously. 2. 2021 Budget Amendment: City Administrator Phil Higgins presented the Budget Amendment for the 2021 Budget. The Hotel/Motel tax is accounted for in a Special Revenue Fund, which are legally restricted or committed to expenditures for specific/restricted purposes. This amendment adjusts those balances. A motion was made by Jason Evans and seconded by Joey Cochran to adopt the 2021 Budget Amendment as presented by City Administrator Phil Higgins. The motion carried unanimously. B. Planning and Zoning: 1. Conditional Use Permit #2022122- New Generation Investment Group, LLC (Public Hearing): Planning Director Scott Morgan read into the record the following staff report: The applicant has made application, on behalf of the property owner and to the proper authorities, for a Conditional Use Permit (CUP), to establish a used automobile dealership, in addition to their existing aftermarket automotive customization shop. The back and south sides of their facility are enclosed and secured, which is where they be locating their customized vehicles for sale. No for- sale vehicles will be located at the front of their facility, which will be used for retail customer parking, or visible from the public right-of-way (ROW). The Planning Commission held a public hearing on April 19, 2022 and with no public comments, voted to recommended approval of the CUP, with the following conditions: 1. Vehicle inventory will remain in the back and south fenced parking areas of the facility, per the applicant’s submitted plan. 2. No advertising/signage for vehicle sales will be visible from the ROW. A motion was made by and seconded by to open the public hearing. The motion carried unanimously. Mr. Adam Richmond explained that plans for the property were to establish a used automobile dealership, named Richmond Auto Sales to their existing business, Southern Automotive Specialty Shops. This would allow us to acquire the vehicles and offer ready to sell units to our customers stated Richmond. No other public comments were recorded. A motion was made by Chad Crane and seconded by Jason Evans to close the public hearing. The motion carried unanimously. After some discussion, a motion was made by Christopher Light and seconded by Jason Evans to approve Conditional Use Permit #2022122 by New Generation Investment Group, LLC. with the conditions recommended by the Planning Commission and adding Condition #3 This CUP shall be limited and personal to this applicant, and shall not transfer with ownership of the property to any other owner. The motion carried unanimously. C. Utilities: 1. Report of Quotes- Two Pickup Trucks: The Department of Utilities advertised on the Georgia Procurement Website for the purchase of two (2) half-ton Crew Cab 4wd pickup trucks for the Water Production Department and received three (3) bids ranging from $35,844.60 to $69,500.00. This was a 2022 budgeted item. The Department of Utilities staff recommends accepting the low bid from Wade Ford. A motion was made by Chad Crane and seconded by Linda Ledbetter to accept the low bid from Wade Ford in the amount of $35,844.60 each. The motion carried unanimously. 2. Report of Quotes- Sewer Line Rapid Assessment Tool: The Department of Utilities advertised on the Georgia Procurement Website for a Sewer Line Assessment Tool and received one (1) bid from InfoSense, Inc., since this was the sole source provider. This tool would assist in the location of blockages between manholes prior to using the sewer camera. This was a 2022 budgeted item. The Department of Utilities recommends accepting the low bid from InfoSense, Inc. A motion was made by Chad Crane and seconded by Joey Cochran to accept the sole source bid from InfoSense, Inc. in the amount of $28,255.00. The motion carried unanimously. D. Police: Report of Quotes- Two Police Interceptor Vehicles: Chief David Marsh reported that Requests for Proposals were sent out for the purchase of two Police Interceptor Vehicles. This was a 2022 budgeted item. It is the Police Department’s recommendation to accept the sole proposal from Wade Ford. A motion was made by Chad Crane and seconded by Jason Evans to authorize the purchase to two Police Interceptor Vehicles from Wade Ford in the amount of $37,821.34 each. The motion carried unanimously. IX. Announcements: 1. National Day of Prayer at the Cumming City Center on Thursday, May 5 at 11:00 a.m. 2. Special Called Council Meeting on Tuesday, May 10, 2022 at 7:15 p.m. X. Executive Session: Mayor Brumbalow stated there was no need to have Executive Session. XI.
