Executive Session (If Needed) XI. Adjourn. CITY OF CUMMING COUNCIL MINUTES WORK SESSION OCTOBER 4, 2022 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, October 4, 2022, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present with the exception of Councilman Light. Mayor Troy Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded by Joey Cochran to adopt the agenda as presented. The motion carried 4-0 with Councilman Light absent. After the vote Councilman Light joined the meeting. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of September 21, 2022: A motion was made by Chad Crane and seconded by Jason Evans to approve the minutes of the Regular Council Meeting of September 21, 2022 as presented. The motion carried unanimously. B. Executive Session Meeting of September 21, 2022: A motion was made by Jason Evans and seconded by Joey Cochran to approve the minutes of the Executive Session Meeting of September 21, 2022. The motion carried unanimously. VI. Acknowledgements, Proclamations, Resolutions, etc.- A. Long-Term Care Residents’ Rights Month. Mayor Brumbalow read aloud and presented a proclamation proclaiming October 2022 as Long-Term Care Residents’ Rights Month in the City of Cumming, Georgia. VII. Old Business: A. Planning and Zoning: 1. Resolution to Adopt the City Comprehensive Plan 2022 Five-Year Update: Planning Director Scott Morgan presented a resolution for the adoption of the City Comprehensive Plan 2022 Five-Year Update. He said that the plan had met all the requirements of the Department of Community Affairs and ARC. A motion was made by Jason Evans and seconded by Christopher Light to authorize Mayor Brumbalow to sign the resolution to adopt the City Comprehensive Plan 2022 Five-Year Update. The motion carried unanimously. 2. Resolution to adopt the Capital Improvements Element of the Comprehensive Plan: Planning Director Scott Morgan presented a separate resolution to adopt the Capital Improvements Element of the Comprehensive Plan. A motion was made by Jason Evans and seconded by Joey Cochran to authorize Mayor Brumbalow to sign the resolution to adopt the Capital Improvements Element of the Comprehensive Plan. The motion carried unanimously. B. Administration: 1. Impact Fee Agreement-Providence Group: City Attorney Kevin Tallant explained that at the last meeting, a draft of the Impact Fee Agreement between the City of Cumming, The Providence Group of Georgia, LLC and JBGL, Atlanta Development 2014, LLC was presented for discussion. In the agreement, the Road Impact Fees would be paid up-front and applied toward the construction of the Sawnee Drive extension. A motion was made by Christopher Light and seconded by Chad Crane to approve the Impact Fee Agreement with Providence Group. The motion carried 4-1 with Councilmember Ledbetter against. VIII. New Business A. Utilities: 1. Sewer Project Conglomeration: The Department of Utilities requested the consideration of the following proposals for the Department’s Sewer Projects Conglomeration: 1. F.S. Scarbrough, LLC $1,658,225.45 2. Site Engineering, Inc. $2,676,955.00 3. Reeves Young, LLC $3,610,375.00 Utilities Engineer Andy Lovejoy explained a portion of this multi-stage project will be funded by the Forsyth County School Board and a portion by Georgia DOT. The Department of Utilities recommends the low proposal from F.S. Scarbrough, LLC. After some discussion, a motion was made by Christopher Light and seconded by Joey Cochran to accept the low proposal from F.S. Scarbrough, LLC in the amount of $1,658,225.45. The motion carried unanimously. IX. Announcements: A. Cumming Country Fair and Festival: October 6-16, 2022. X. Executive Session: Mayor Brumbalow stated there was no need to have Executive Session. XI. Adjournment: A motion was made by Jason Evans and seconded by Joey Cochran to adjourn. The motion carried unanimously. Approved this 18th day of October, 2022.
