Administration 1. LOST (Local Option Sales Tax) IX. Announcements X. Executive Session (If Needed) XI. Adjourn. CITY OF CUMMING COUNCIL MINUTES WORK SESSION DECEMBER 6, 2022 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, December 6, 2022, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present with the exception of Councilman Crane. Mayor Troy Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked the Cumming Police Department Chaplin to deliver the invocation. III. Pledge to the Flag. The Coal Mountain Cub Scout Pack #211 led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Joey Cochran and seconded by Jason Evans to adopt the agenda as presented. The motion carried 4-0 with Councilman Crane absent. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of November 15, 2022: A motion was made by Christopher Light and seconded by Joey Cochran to approve the minutes of the Regular Council Meeting of November 15, 2022 as presented. The motion carried 4-0 with Councilman Crane absent. B. Executive Session Meeting of November 15, 2022: A motion was made by Joey Cochran and seconded by Jason Evans to approve the minutes of the Executive Session Meeting of November 15, 2022. The motion carried 4-0 with Councilman Crane absent. VI. Acknowledgements, Proclamations, Resolutions, etc.- None VII. Old Business: None VIII. New Business A. Planning and Zoning: 1. Alcohol License Application- Homestead Restaurant Group, 420 Vision Drive, Suite 101: The Department of Planning and Zoning received an Alcoholic Beverage License application for the sale of distilled spirits, malt beverages and wine for consumption on the premises for the business of Homestead Restaurant Group located at 420 Vision Drive- Suite 101 in the Cumming City Center. City Code Enforcement Officer, Lenny Mancinelli, stated that in accordance with the City’s alcohol ordinance, a background check was conducted on the license applicants an no issues were found to deny the applicants the licenses. Additionally, the applicants have met all the requirements of the application process and have paid all fees due the City. A motion was made by Christopher Light and seconded by Jason Evans to approve the 2023 Alcoholic Beverage License for the sale of distilled spirits, malt beverages and wine for consumption on the premises to Homestead Restaurant Group located at 420 Vision Drive- Suite 101 in the Cumming City Center. The motion carried 4- 0 with Councilman Crane absent. 2. 2023 Alcohol License Renewals: Councilman Chad Crane joined the meeting at 6:08 pm. City of Cumming Code Enforcement Officer, Lenny Mancinelli presented the Mayor and Council a list (Attachment A) of fifty-six (56) businesses which currently hold an alcohol license and who have successfully completed their renewal applications for their 2023 alcohol license. Investigations have been completed and all appropriate fees have been paid. All of these businesses are complying with the alcohol ordinance adopted by the City of Cumming stated Mancinelli. Two current licensees (El Rio and Happy Family) have not completed the renewal process and will be subject to late fees and interest charges. It is the recommendation of the Cumming Planning Department that each of these licenses be approved. Then a motion was made by Joey Cochran and seconded by Jason Evans approving the renewal of fifty-six (56) alcohol licenses as presented by of the Cumming Planning Department. The motion carried unanimously. B. Police: Annual Awards: Chief David Marsh acknowledged the hard work and dedication given by the officers of the Cumming Police Department. He presented the annual awards for Officer of the Year and the Life-Saving Award. The Life Saving Award was given to Sergeant Strano, who is now being promoted to Captain. The Officer of the Year Award was given to Officer Tyler Burns. Mayor Brumbalow thanked the Police Department for their loyal and dedicated service to the City of Cumming. C. Utilities: 1. RFP Results- F250/2500 4X4 Service Truck: The Department of Utilities requests to purchase a Chevrolet 2500 from John Megal Chevrolet. Ford Motor Company has the State Contract but no dealer has one available. This vehicle is on the lot and available for purchase now. A motion was made by Chad Crane and seconded by Joey Cochran to authorize the purchase of a 2022 Chevrolet 2500 4X4 Service truck from John Megal Chevrolet in the amount of $55,892.00. D. Administration: 1. LOST (Local Option Sales Tax): Mayor Brumbalow presented the most current LOST negotiation offer from the Forsyth County Board of Commissioners and the counter-offer made by the City of Cumming. After much discussion, a motion was made by Jason Evans and seconded by Joey Cochran to send the counter-offer to the Board of Commissioners, removing item III. Bulk Sewer Agreement (see attached). The motion carried 4-1 with Councilmember Ledbetter against. IX. Announcements: None X. Executive Session: Mayor Brumbalow stated there was no need to have Executive Session. XI. Adjournment: A motion was made by Chad Crane and seconded by Jason Evans to adjourn. The motion carried unanimously. Approved this 21th day of December, 2022.
