Announcements X. Executive Session (If Needed) XI. Adjourn. CITY OF CUMMING COUNCIL MINUTES WORK SESSION APRIL 4, 2023 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, April 4, 2023, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present with the exception of Mayor Brumbalow. Mayor Pro-tem Christopher Light presided over the meeting and called the meeting to order. II. Invocation: Mayor Pro-tem Light asked Director of Utilities Jon Heard to deliver the invocation. III. Pledge to the Flag. Mayor Pro-tem Light led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Joey Cochran and seconded by Chad Crane to adopt the agenda as presented. The motion carried 4-0. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of March 21, 2023: A motion was made by Joey Cochran and seconded by Jason Evans to approve the minutes of the Regular Council Meeting of March 21, 2023 as presented. The motion carried 4-0. B. Executive Session Meeting of March 21, 2023: A motion was made by Chad Crane and seconded by Jason Evans to approve the minutes of the Executive Session Meeting of March 21, 2023. The motion carried 4-0. VI. Acknowledgements, Proclamations, Resolutions, etc.- None VII. Old Business: None VIII. New Business A. Administration: 1. IGA- Forsyth County Operation of Mary Alice Park: City Administrator Phil Higgins explained that pursuant to the December 2022 Local Option Sales Tax Agreement the City and the County agreed to (1) work cooperatively to cause the Corps to request the Park be de-annexed from the municipal limits- with the City, upon such request, de-annexing the Park, and (2) work cooperatively to cause the Corps to assign the operations and management Master Lease from the City to the County; or, alternatively enter into a new ground lease with the County. The County would assume the operation and maintenance to the Park. The parties agree that this IGA is a stop-gap accommodation to authorize the County to expend resources, maintain and restore, and otherwise assume operational control of the Park while the parties work with the Corp on assignment of the Master Lease to the County. A motion was made by Jason Evans and seconded by Chad Crane to authorize Mayor Brumbalow to sign the IGA on behalf of the City of Cumming. The motion carried 3-1 with Linda Ledbetter opposed. 2. Joint Resolution- Assignment of Lease to Forsyth County of Mary Alice Park (Information Only): City Administrator presented a “JOINT RESOLUTION OF THE BOARD OF COMMISSIONERS OF FORSYTH COUNTY, GEORGIA, AND THE MAYOR AND COUNCIL OF THE CITY OF CUMMING, GEORGIA”. By approving this Resolution and transmitting the same to the District Engineer, the City and County are jointly requesting that the U.S. Corp of Engineers take steps necessary to approve the assignment of the Lease from the City to the County. This would be up for approval at the April 18, 2023 Regular Meeting. B. Utilities: 1. Request to Purchase Property- Mountain Road: The Department of Utilities requests to purchase 11.0 acres on Mountain Road to be used as a storage yard for the Distribution and Collection Division Shop. The property was appraised by Pendley and Pendley and the owner has accepted the offer amount of $45,000/acre for a total of $495,000.00. A motion was made by Linda Ledbetter and seconded by Joey Cochran to authorize the purchase of 11.0 acres on Mountain Road for $495,000.00. The motion carried 4-0. 2. Results of Proposals- Retaining Wall: The Department of Utilities budgeted in 2023 for a retaining wall at the Distribution and Collection Shop due to severe erosion issues and water run-off coming from an adjacent property. After advertising on the State Procurement Website, the following two proposals were received: 1. Vertical Earth $40,770.51 2. ACE Site Solutions $40,500.00 The Department of Utilities recommended accepting the proposal from Vertical Earth in the amount of $40,770.51. A motion was made by Chad Crane and seconded by Linda Ledbetter to award the proposal to Vertical Earth in the amount of $40,770.51. The motion carried 4-0. IX. Announcements: none X. Executive Session: Mayor Pro-tem Light stated there was no need to have Executive Session. XI. Adjournment: A motion was made by Chad Crane and seconded by Jason Evans to adjourn.
