Adjourn.  CITY OF CUMMING COUNCIL MINUTES WORK SESSION APRIL 2, 2024 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, April 2, 2024 at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present with the exception of Christopher Light. Mayor Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded by Jason Evans to adopt the agenda as presented. The motion carried 4-0 with Christopher Light absent. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of March 19, 2024: A motion was made by Susie Carr and seconded by Jason Evans to approve the minutes of the Regular Council Meeting of March 19, 2024 as presented. The motion carried 4-0 with Christopher Light absent. VI. Acknowledgements, Proclamations, Resolutions, etc.-Proclamation: None VII. Old Business: None VIII. New Business: A. Administration: 1. Removal of Former War Memorial Monument: City Administrator Phil Higgins explained that with our new Veterans Monument and Avenue of Flags located at the Cumming City Center, we now need to address the old monument located on the property at the Cumming Police Department. With the Police Department relocating in the near future it is best to remove the structure of the former monument. A large part of the old monument has been relocated to the new monument site at the City Center. Approval in needed to remove the remaining structure and to approve the expenditure of up to $25,000.00. Our on-call service provider, Jasper Grading has agreed to perform the work. A motion was made by Jason Evans and seconded by Susie Carr to authorize the relocation and/or removal of the old monument and approve the expenditure up to $25.000.00. The motion carried 4-0 with Christopher Light absent. 2. RFP Results- City Center Residential Site Work: On January 31, 2024 the City of Cumming put out an RFP for the purpose of constructing the needed site work for the empty parcel at the Cumming City Center that will marketed for Residential development. After placing the RFP on the State Procurement Registry, the Forsyth County News and the City’s website the following Proposals were offered on the project: 1. Vertical Earth, Inc. $2,814,289.25 2. Jasper Grading and Pipeline, Inc. $2,900,000.00 3. Brock Built Development, LLC $5,184,691.00 4. Summit Construction & Development, LLL $3,285,253.00 5. Landtec Consulting, LLC $4,750,000.00 After consulting with the Design Engineer, Foresite Group and negotiating with the contractors, it is their recommendation to approve the low proposal from Vertical Earth, Inc. in the amount of $2,814,289.25 for this project. A motion was made by Jason Evans and seconded by Susie Carr to approve the low proposal from Vertical Earth, Inc. in the amount of $2,814,289.25. The motion carried 4-0 with Christopher Light absent. 3. Update to Retiree Healthcare Resolution: City Administrator Phil Higgins explained that under our Retiree Healthcare Policy the City previously had an automatic enrollment for those individuals that are on the plan at age 65. The post 65 plan was administered by GMA. GMA has stopped providing this plan for some time. Currently, when a retiree turns 65 they have to elect to participate in the Health Reimbursement plan offered by the City of Cumming that pays for their Medicare Supplement. Simply put, their enrollment into the post 65 benefits are no longer automatic. The Council’s approval is requested to amend the Resolution of the Retiree Healthcare Policy. A motion was made by Joey Cochran and seconded by Jason Evans to amend the Retiree Healthcare Policy. The motion carried 4-0 with Christopher Light absent. 4. Restatement of Defined Benefit Retirement Plan: City Administrator Phil Higgins explained that the purpose of this item is to continue tax qualified status of our retirement plan. This ensures that the plan will continue to accrue benefits tax-free until benefits are distributed to retirees. The Council’s approval of the attached ordinance and adoption agreement to restate our GMEBS Defined Benefit Retirement Plan. A motion was made by Jason Evans and seconded by Chad Crane to authorize Mayor Brumbalow to sign the ordinance and adoption agreement on behalf of the City of Cumming. The motion carried 4-0 with Christopher Light absent. B. Parks and Recreation: 1. Report of Quotes- Playground Repair: The Cumming Recreation and Parks Department has requested quotes from three (3) different companies to remedy the incorrect drainage problem by placing a French drain grid system within the playground and have the pipes connected by coring into the main drain that is located in the center of the playground. This includes reworking the subflooring, smooth out rough areas, and placing new padding and try to match existing turf. The Cumming Recreation and Parks Maintenance Coordinator, City Engineer, City Erosion Control Inspectors and the Recreation Director will assist in overseeing the repairs. The following three (3) quotes were received: 1. KorKat $63,045.00 2. Rubber Floors and More $61,000.00 3. PlaySouth $192,940.00 It is the recommendation of the Cumming Recreation and Parks Department to accept the low quote from Rubber Floors and More. A motion was made by Joey Cochran and seconded by Susie Carr to approve the low quote from Rubber Floors and More in the amount of $61,000.00. The motion carried 4-0 with Christopher Light absent. IX. Announcements: None X. Executive Session: Mayor Brumbalow stated there was no need for Executive Session. XI. Adjournment: A motion was made by Chad Crane and seconded by Jason Evans to adjourn.
