CITY OF DACONO PLANNING COMMISSION MEETING MINUTES Tuesday, July 9, 2019 Chairperson Plain called the meeting to order at 6:00 p.m. Members present: Kevin Plain, Chairperson Stan Owens Shelly Kettering Derrick Worden Gen Schneider Members absent: Joseph Westbrook, excused Staff present: Jennifer Krieger, Community Development Director Donna Case, Community Development Technician AJ Euckert, City Manager Member Owens moved to approve the minutes of the June 25, 2019, Planning Commission Meeting. The vote was unanimous and Chairperson Plain declared the motion carried. GENERAL BUSINESS Consideration of an Ordinance Amending Chapter 16, Article 22, Related to Oil and Gas Regulations. Jennifer Krieger presented her report and was available for questions and a discussion ensued. Member Kettering asked about the three potential sites and wanted to know if they would have to determine the pro’s and con’s of each site. Jennifer Krieger stated yes, that’s what we are trying to do. Chairperson Plain asked on each of the three sites what if they were only 5 feet apart, what could they do. Jennifer stated that she thought that it was up to Planning Commission to catch it and state this is not acceptable. Chairperson Plain asked if there was anything on air quality/air monitoring, and Jennifer Krieger stated yes we just haven’t got to it yet. Member Schneider asked about odor and how to monitor it. Jennifer stated that it’s difficult to monitor but there are mud chillers and additives that they can use, and Jennifer also stated the odor comes from the drilling mud. Member Worden asked if we could tie air monitoring or testing to an odor complaint where we could actually get some air testing done. Jennifer stated yes, that we have an emissions mitigation plan requirement. Page 1 of 2 Member Worden asked how flexible the operator agreement is and if the testing could be made public or if it could be a requirement. Jennifer stated yes that we could do that with an operator agreement. Member Schneider asked if they had to do an economic study to see how bad house prices fall within 500’ of a well. Member Worden asked about the traffic plan and what do we do with that. Jennifer Krieger stated that we had negotiated the operator agreement and then asked for a baseline road study, now we are asking for the baseline road study first and then the operator agreement. Member Kettering asked if there is anything that’s going to state if the wells are leaking. Jennifer stated that remains with the state regulations. Member Worden asked if they could go back in time for Legacy. Jennifer stated no this only applicable to new wells. Member Owens asked if we could have them submit the findings on ongoing air quality. Jennifer stated yes we could. Member Worden asked if we are just testing the air around the pad or various locations in and around the community. Jennifer stated yes, just around the pad sites. Member Schneider stated that we can never go lower than the states regs. Jennifer stated that’s correct you can go higher with your standards, but not lower. Member Owens made a motion to continue the Public Hearing until August 13, the vote was unanimous and Chairperson Plain declared the motion carried. Staff Reports: None. Commissioner Reports: None.
