Hon. Mark D. Boughton, Mayor Common Council Members Mayor Mark D. Boughton called the Common Council Meeting to order at 7:30 p.m. on Wednesday, October 2, 2007. Present were Council Members: Louise P. McMahon, Shay Nagarsheth, Michael J. Calandrino, Fred Visconti, Duane E. Perkins, Benjamin Chianese, John J. Esposito, Thomas J. Saadi, Joseph M. Cavo, Pauline R. Basso, Paul T. Rotello, Jane Diggs, Mary Teicholz, Philip D. Curran, Robert T. Riley, Mary G. Saracino, Gregg W. Seabury, Colleen A. Stanley and Lynn Taborsak Absent were Council Members: Charles Trombetta (out of town) PRESENT: 20, ABSENT: 1 Also present were Jean Natale, City Clerk; Robert J. Yamin, Corporation Counsel; Laszlo L. Pinter, Deputy Corporation Counsel and Eric Gottschalk, Parliamentarian PLEDGE OF ALLEGIANCE TO THE FLAG & PRAYER: Councilwoman Jane Diggs led everyone in the room in the Pledge of Allegiance. Councilman Phil Curran led everyone in the room in a prayer. PUBLIC PARTICIPATION: Gerard O’Callaghan, 136 Pembroke Road, spoke in favor of item #8 Eileen Cipolla, 124 Coalpit Hill Road, spoke in opposition of item #8 Christina Halfar, 8 Settlers Hill Road, spoke in opposition of item #8 Lynn Waller, 83 Highland Avenue, read a letter from Margaret Mitchell, speaking against item #5 Elise Marcianco, 179 Long Ridge Road, spoke in favor of item #8 Jean Hislop, 10 Moran Avenue, spoke in opposition of item #8 Ken Gucker, 89 Padanaram Road, spoke in opposition of item #8 Mary Collins, 2 Frontier Lane, spoke in opposition of item #8 Sunnye Ann Rosasco, 31 Hillside Avenue, spoke in favor of item #8 Joel Urice, 44 Olympic Drive, spoke in favor of item #8 Emanuela Lima, 32 Farview Avenue, spoke on item #8 Pat Kadet, 19 Lakeview Drive, spoke in favor of item #8 Public Participation was closed at 8:04 p.m. Mayor Boughton read the announcements for the month of October. MINUTES: A motion was made by Councilman Cavo and seconded by Councilman Seabury that the Common Council approve the Minutes of the Common Council Meeting of September 5, 2007 as presented and to waive the reading of same as the Council have copies of the Minutes and are available in the City Clerk’s office. The motion carried unanimously. -1- Page 1 of 5 CONSENT CALENDAR: Councilwoman Basso presented the following items for the Consent Calendar: 7 - COMMUNICATION - Danbury Train Station Lease Proposed Budget Receive the communication and approve the Danbury Train Station Lease Proposed Budget for the fiscal year 2007-2008. 10 - COMMUNICATION - Assignment of Real Estate Liens Receive the communication and authorize the assignment of real property tax liens on the grand list as of October 1, 2006 to American Tax Funding. 11 – COMMUNICATION - Fire Hydrant Easement – 50 Beaver Brook Road Receive the communication and accept the proposed easement for a fire hydrant at 50 Beaver Brook Road. 20 – RESOLUTION - EMPG Grant – Emergency Management Receive the report and approve the recommendations of the committee. 21 - RESOLUTION - Achieve Initiative – Health Department Receive the report and approve the recommendations of the committee. 22 – REPORT & ORDINANCE - Danbury Museum and Historical Society Receive the report and approve the recommendations of the committee. 23 – AD HOC REPORT & ORDINANCE - Other Post-Employment Benefit and Trust Agreement Receive the report, approve the recommendations of the committee and refer to Public Hearing 24 – AD HOC REPORT - Request for Water - Backus Avenue and 3 - 5 Sugar Hollow Road Receive the report as revised and approve the recommendations of the committee. 25 – AD HOC REPORT - Request for Sewer – Johnson Drive Area Receive the report as revised and approve the recommendations of the committee. Councilwoman Taborsak asked to have item #20 removed from the consent calendar. A motion was made by Councilman Seabury and seconded by Councilman Chianese to accept the Consent Calendar. The motion carried unanimously. Councilwoman Saracino noted that Councilman Perkins was omitted from report #24 and #25 as being absent 1 – COMMUNICATION - Snow Emergency Protocols City Clerk Natale read the communication from the Mayor requesting an ad hoc committee. Councilwoman McMahon asked that this be referred to an Ad Hoc Committee, the Corporation Counsel and Director of Public Works. Mayor Boughton so ordered and appointed Council Members Basso, Curran and Visconti to the Committee. -2- Page 2 of 5 2 – COMMUNICATION - Open Space and Recreation Bond City Clerk Natale read the communication from the Mayor. Councilman Nagarsheth moved to accept the communication and send to a Public Hearing. Mayor Boughton so ordered. 3 – COMMUNICATION - Donations to the Fire Department City Clerk Natale read the communication of donations to the Fire Department from Sears and Lowes, for Engine 26. Councilman Curran moved to accept the donations and send a letter of thanks. The motion was seconded by Councilman Chianese. The motion carried unanimously. 4 – COMMUNICATION - Donation to the Health Department City Clerk Natale read the communication of a donation to the local Interim Medical Respite program from Danbury Hospital. Councilman Seabury moved to accept the donation and send a letter of thanks and seconded by Councilman Chianese. The motion carried unanimously. 5 – COMMUNICATION - Donation of a Monument City Clerk Natale read the communication of a donation of a monument and walkway from Amerigo Vespucci Club commemorating Amerigo Vespucci and Christopher Columbus. Councilwoman Saracino moved to accept the donation and send a letter of thanks and seconded by Councilman Riley. Councilwoman Taborsak moved to send to an Ad Hoc Committee. The Mayor so ordered and appointed Council Members Cavo, Basso and Esposito. 6 – COMMUNICATION - Donation to the Parks and Recreation Department City Clerk Natale read the communication of a donation from the Westerners and Addessi Fencing of a fence for Rogers Park Baseball Field. Councilwoman Diggs moved to accept the donation and send a letter of thanks and seconded by Councilman Seabury. The motion carried unanimously. 7 - COMMUNICATION - Danbury Train Station Lease Proposed Budget The communication was received on the consent calendar and approved. 8 – COMMUNICATION - ICE ACCESS City Clerk Natale read the communication. Councilman Cavo asked that this be referred to the Mayor’s Office, Corporation Counsel and the Chief of Police for reports. 9 - COMMUNICATION - Request for Ad Hoc – The Yellow Pages City Clerk Natale read the communication. Councilwoman Teicholz asked that this be referred to an Ad Hoc Committee. Mayor Boughton so ordered and appointed Council Members Trombetta, Johnson and Rotello to the Committee 13 – COMMUNICATION - Request for Sewer – 8 East Hayestown Road City Clerk Natale read the communication. Councilwoman Stanley asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Johnson, Trombetta and Rotello to the Committee 14 – COMMUNICATION - Request for Sewer – 10 East Hayestown Road City Clerk Natale read the communication. Councilwoman Stanley asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Johnson, Trombetta and Rotello to the Committee 15 – COMMUNICATION - Request for Sewer – 12 East Hayestown Road City Clerk Natale read the communication. Councilwoman Stanley asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Johnson, Trombetta and Rotello to the Committee 16 – COMMUNICATION - Request for Water – 79 - 81 Sand Pit Road City Clerk Natale read the communication. Councilman Riley asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Calandrino, McMahon and Chianese to the Committee 17 – COMMUNICATION - Request for Sewer and Water – 91 Boulevard Drive City Clerk Natale read the communication. Councilwoman Teicholz asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Calandrino, McMahon and Chianese to the Committee 18 – COMMUNICATION - Request for Sewer and Water – 33 Golden Hill Road City Clerk Natale read the communication. Councilman Nagarsheth asked that this be referred to an Ad Hoc Committee along with the Director of Public Works Department and 30 day report from Planning Commission. Mayor Boughton so ordered and appointed Council Members Calandrino, McMahon and Chianese to the Committee 19 – COMMUNICATION - Easement – Sheridan Commons – Sheridan Street City Clerk Natale read the communication. Councilwoman Diggs asked that this be referred to the Corporation Counsel, Director of Planning and Zoning Commission for 30 day reports. 20 – RESOLUTION - EMPG Grant – Emergency Management -4- Page 4 of 5 Councilman Cavo moved to adopt the Resolution and apply for the Grant. Councilman Curran seconded the motion. Councilwoman Taborsak questioned Airport Administrator Estefan about the Grant. The motion carried unanimously. 21 – RESOLUTION - Achieve Initiative – Health Department The communication was received on the consent calendar and approved. 22 – REPORT & ORDINANCE - Danbury Museum and Historical Society The communication was received on the consent calendar and the Ordinance approved. 23 – AD HOC REPORT & ORDINANCE - Other Post-Employment Benefit and Trust Agreement The Report was received on the consent calendar and approved for public hearing. 24 – AD HOC REPORT - Request for Water - Backus Avenue and 3 - 5 Sugar Hollow Road The Report was received on the consent calendar and approved. 25 – AD HOC REPORT - Request for Sewer – Johnson Drive Area The Report was received on the consent calendar and approved. 26. DEPARTMENT REPORTS—Police, Fire, Health-Housing & Welfare, Dream Homes, Public Works, Permit, Unit, Library: A motion was made by Councilman Cavo and seconded by Councilman Perkins to receive the communication and accept the Department Reports as presented. The motion carried unanimously. Councilman Riley commended the Police SWAT Team and Fire Department and Volunteers for their efforts during the recent fire at the Airport and with the Anthrax. Councilwoman Teicholz thanked everyone for their support of the Bone Marrow Drive especially the Firefighters. Mayor Boughton extended all committees. A motion was made by Councilman Saadi and seconded by Councilman Rotello that the Common Council Meeting be adjourned. The motion carried unanimously at 8:30 pm.
