Ord. Sec. 8-2: Voting wards of city (Reapportionment)

Chairman Ben Chianese called the meeting to order at 6:03p.m. on Tuesday, April 29, 2025. Present were
Committee Members Joseph Britton and Elmer Palma. From the City were Dan Casagrande, Corporation
Counsel, Joseph Mortelliti, Outside Counsel; Joan Bielizna, Democratic Registrar of Voters; MaryAnn Doran,
Republican Registrar of Voters; Taylor O’Brien, Chief of Staff, Mayor’s Office; Yuri Farrison, GIS Specialist,
City of Danbury. Ex-Officio members; Frank Salvatore, Peter Buzaid, Lou Giordano, Michael Coelho, Paul
Rotello, Duane Perkins and Bill McAllister. From the public was Tom Brown.
Chair Chianese asked Counsel to provide an overview of this phase of reapportionment; Mr. Casagrande
explained that a modified plan was approved in July 2023 and that it would be in effect for the 2025 municipal
election. He explained that with the adoption of the plan, came the need for amendments to be made to the
boundaries to reflect the approved plan. He confirmed that the only topic before the ad hoc tonight is Ordinance
Section 8-2; no changes to Sec. 8-1 with regards to precincts. He asked that the ordinance be voted on by June
11th which is the final date for municipalities to establish ward boundaries per state statute. He reiterated that the
charge of the ad hoc is not to revisit the plan, but to review the accuracy of the boundary changes in the
ordinance.
Chair Chianese noted that the street list provided by the Registrars should not be used as a reference. He
explained that the data used to establish the new boundaries is the number of people, not number of voters; and
that census blocks are used so that streets are not cut in half, however, they can divide streets by sides (ie: even
vs odd house numbers). He also pointed out that the wording in the ordinance is law, not what the map depicts.
Mr. Farrison explained how the map was created, he spoke starting with just boundaries and then adding
context including streets to allow for specific modifications; he met with the Registrar to review every ward,
street and homes in depth to make slight adjustments where needed.
Mr. Farrison highlighted the boundaries set forth in the Ordinance for the First Ward, and Mr. Doran spoke on
the changes. Mr. Mortelliti explained that the changes are reflected in the redlined version Ordinance Sec. 8-2.
The Second Ward was reviewed: Member Palma asked how many individuals will change; Chair Chianese
confirmed the ward will gain 503 individuals.
The Third Ward was reviewed: Mr. Salvatore asked about language changes; Mr. Mortelliti confirmed language
was changed to be more specific, and Mr. Farrison confirmed there was a slight boundary change; Chair
Chianese confirmed there are 184 less individuals in the ward due to a population change. The Fourth Ward was
reviewed; Mr. Farrison confirmed there was little change; Chair Chianese identified 468 less individuals due to
population changes (Census).
The Fifth Ward was reviewed: Mr. Rotello and Mr. Duane Perkins asked for clarification of some boundaries in
this ward. The Sixth Ward was reviewed: Mr. Rotello asked for the population; Chair Chianese identified 2,176
individuals who are being moved out of the ward. Mr. Rotello identified 1,000 less voters, Chair Chianese
noted the intent is to use individuals and not voters. Mr. Rotello spoke on the intent of balancing population to
assure fair representation; he spoke on losing more voters than individuals. Ms. Doran explained the status of
Kennedy Flats in 2011 and identified it as vacant land during a previous inquiry by Mr. Rotello at that time;
Mr. Rotello reiterated that the map did not match the ordinance at the time. He identified the Jefferson Avenue
boundary as a creek vs. a street which did cause a boundary that breaks up a street; he noted the loss of all of
Southern Blvd; and he discussed the change to the minority population in the north-eastern section of the Sixth
Ward, he identified this as a violation of civil rights laws.
The Seventh Ward was reviewed: Chair Chianese identified a change of Mill Plain Road into the Seventh Ward.
Mr. Giordano asked for clarification of the ward boundaries on Mill Plain Road and downtown; Mr. Farrison
identified the railroad tracks as the boundary near Rose Hill Avenue; Chair Chianese re-read language regarding
Rose Hill Avenue in the ordinance; Mr. Peter Buzaid confirmed the language in the ordinance is correct despite
the map being wrong. Mr. Duane Perkins expressed concern regarding minority representation in this ward.
Mr. Goirdano asked how many voters were gained; Chair Chianese confirmed that the ward gained 549
individuals and that the ad hoc is not meant to address the number of voters; Mr. Casagrande confirmed the
Census uses population and that the 14th Amendment requires the use of population. Chair Chianese did note
that the plan does include a percentage of the population in each ward that is 18+ but does not confirm voter
registration.
Member Palmas asked for confirmation that the approval will be for the Ordinance; Chair Chianese confirmed
that it is the Ordinance that is being approved, not the map; and he asked that a new map that matches the
ordinance will be created. Member Britton asked Counsel if the total deviation of the plan is within the bounds
of the law; Mr. Casagrande confirmed it is. Mr. Coelho asked for a map differentiating the changes clearer if
possible; Mr. Farrison confirmed that that can be created by ward as a hardcopy and an electronic version for
the Council. Member Palma asked for separate ward maps. Mr. Salvatore asked if a map with old vs new
wards can be provide to allow for more zoom clarity; Mr. Farrison confirmed he will need to recreate the old
map to provide the overlap. Member Palma asked for a clear map of the new plan.
Mr. Rotello asked Counsel if an ordinance was voted on in 2023; Mr. Casagrande confirmed an ordinance was
not presented in 2023. Mr. Rotello identified changes from Sixth Ward to the Seventh Ward and spoke on
Section 2 of the Voting Rights Act, specifically with regards to minority populations. He is concerned that
these boundary changes will result in voters losing representation. He is also concerned with this Ordinance
matching the 2023 plan, as well as the timeline restrictions they are facing to review this ordinance, he
specifically identified the Mill Plain Road change. He asked that the Council take no action, and that the old
voting wards be used for the 2025 Municipal Election. He further suggested that the state would not cite the
city for not complying because the plan is not compliant with the Voting Rights Act. Ms. Doran explained that
the Secretary of State would not be ok with not implementing a plan, and that the majority of work by the Voter
Registrars is now complete. Ms. Doran thanked Mr. Farrison and Mr. Mortelitti for all their hard work and
confirmed that their portion of the process was completed to the best of their ability.
Chair Chianese asked for the ramification of a no vote; Mr. Casagrande confirmed that taking no action is the
same as violating state statute and that that will open the city to lawsuits. Mr. Rotello suggested that
reapportionment start over before the ten-year requirement.
A motion was made by Member Britton, second by Member Palma, to recommend to the full Council,
subject to a Public Hearing, the amendments to Ordinance Sec. 8-2 as presented; with the understanding that
the Council shall receive clarifying maps prior to the public hearing demonstrating that the maps are
illustrative of the corresponding ordinance language. The motion passed unanimously.
Chair Chianese clarified his vote in favor of this motion because the Ordinance matches the plan, however, he
wanted to note for the record that he does not support the process that was used to get here.
A motion was made by Palma, and seconded by Britton, to adjourn. The motion passed
unanimously. The meeting adjourned at 7:33 p.m.

That Section 8-2 of the Code of Ordinances is hereby amended and reads as follows:
