ROLL CALL:
Chairman Bernard Gallo called the meeting to order at 7:07 p.m. Present were Alternate
Elizabeth Falk, Commissioners Tom Giegler, Geoff Herald, Mary Cronin, and Mark Massoud.
Absent were Matt Rose and Alex Wolk. Mr. Gallo seated Elizabeth Falk in place of Matt Rose.
ACCEPTANCE OF MINUTES: January 11, 2023
Motion to accept the Minutes of January 11, 2023 was made by Geoff Herald; seconded by
Mary Cronin. All in favor with Ayes from Mary Cronin, Elizabeth Falk, Tom Giegler, Geoff Herald,
and Mark Massoud.
OLD BUSINESS:
#1183 40 Apple Ridge, Danbury, City of, Antonio Iadarola, P.E. Public Works Director/City
Engineer, (E17061/E17061-1) RA-40 Zone. Career Academy
Motion to approve with 8 conditions recommended by staff, No. 1183, 40 Apple Ridge,
(E17061/E17061-1) was made by Geoff Herald; seconded by Tom Giegler. All in favor with Ayes
from Mary Cronin, Elizabeth Falk, Tom Giegler, Geoff Herald, and Mark Massoud.

(K12180), IG-80 Zone. Installation of groundwater pumping system
Motion to table to No. 1181, 11 August Drive, Electroformers, LLC was made by Geoff
Herald, seconded by Mary Cronin. All in favor with Ayes from Elizabeth Falk, Mary Cronin, Tom
Giegler, Geoff Herald, and Mark Massoud.
#1182 39 Lindencrest Drive, Duncan, Donna, (D13104), RA-40 Zone.
Proposed new home construction.
Ms. Duncan spoke at the meeting and said that she had furnished all of the reports the
Commission requested at the last meeting. No questions from the Commissioners.
Motion to approve with 13 conditions recommended by staff, was made by Geoff Herald;
seconded Tom Giegler. All in favor with Ayes from Mary Cronin, Elizabeth Falk, Tom Giegler, Geoff
Herald, and Mark Massoud.
#1184 7 Tanmar Drive, Resource 360 LLC, Gordon Hallas, (F20118), Site septic plan,
construction and erosion controls for proposed dwelling.
Motion to table to February 8, 2023 was made by Mark Massoud; seconded by Geoff Herald.
All in favor with Ayes from Mary Cronin, Elizabeth Falk, Tom Giegler, Geoff Herald, and Mark
Massoud.
ADMINISTRATIVE STAFF ACTIONS:
#1080 Pamela Equities Corp., Candlewood Pines, (I03011) Permit Renewal
#1084 Pamela Equities Corp., Candlewood Pines, (I03005) Permit Renewal
Motion to approve both Nos. 1080 & 1084 administratively was made by Geoff Herald;
seconded by Mary Cronin. All in favor with Ayes from Mary Cronin, Elizabeth Falk, Tom Giegler,
Geoff Herald, and Mark Massoud.
VIOLATIONS:
Barnum Road, Danbury, CT - Cease & Desist
Sharon Dornfeld, Esq., Counsel for the City of Danbury, introduced herself and explained why
she was present.
Attorney Dornfeld began by calling Kara Prunty, Director of Health & Human Services, as a
witness. Mr. Gallo swore Ms. Prunty in.
Ms. Dornfeld produced several documents as exhibits, A-G. Assessor’s cards, violation issued
by EIC, Cease & Desist order, etc. Counsel for Michael Halas, John Dunne, had no objections. It
should be noted that the handheld microphone was not working properly, and much was inaudible.

Ms. Prunty was questioned briefly by Attorney Dornfeld as to the scope of her responsibilities.
Ms. Prunty assigned Public Health Inspector and staff liaison to the Environmental Impact
Commission to investigate the complaint. Chairman Gallo swore in Ms. Lewis. Attorney Dornfeld
questioned Ms. Lewis as to her experience and training.
Questioning continued regarding the reasons for the Cease & Desist order and additional
exhibits were entered. As some materials were only made available to the Commission and to
Attorney Dunne just prior to the meeting, it was agreed by both parties that a future date for a hearing
would be established. It was agreed that the matter would be continued for approximately three weeks
to give ample time for review and for Attorney Dunne and his client to confer with their experts.
Attorney Dornfeld stated she would need to ask for another special meeting. It was suggested the EIC
adjourn now and pick up where they left off. Commissioner Massoud thought they should continue
with Ms. Lewis’s testimony and then adjourn. Commissioner Geoff Herald did not think this would
work. Commissioner Mary Cronin agreed with Mr. Herald.
Motion to table to a future date to be announced and adjourn this evening was made by Geoff
Herald, seconded by Mary Cronin. All in favor with Ayes: Elizabeth Falk, Geoff Herald, Mary
Cronin, and Tom Giegler. Nay from Mark Massoud.
Meeting adjourned at 8:20 p.m.
