Present by roll call: Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. Staff present was Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector. Absent were Matthew Rose, Mark Massoud and Alex Wolk. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Geoff Herald. ACCEPTANCE OF MINUTES: October 11, 2023 Motion to accept the minutes of October 11, 2023 as presented was made by Elizabeth Falk; seconded by Tom Giegler. No remarks. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Tom Giegler, and Bernard Gallo. Next regular meeting is scheduled for November 8, 2023. NEW BUSINESS: #1206 20 Apple Blossom Lane, Vitti, Anthony; (I10080), RA-20 Zone, Legalize 2 previously completed additions and installation of a dock Robert Vitti, homeowner’s son, was present to represent the application. They are looking to legalize two additions done in 1989: a screened in porch and an additional room on the southeast side of the property. Richard Antos and Ratichowski, builders of fine homes, did EIC Minutes – October 25, 2023 Page 2 the work, and they thought permits had been taken out. They are selling the house now. During the title search for the sale, they found out there were no permits taken for the structures. Mr. Liebman states that he and Mr. Gallo visited the site. In addition to the structures, there was also a dock installed on the pond in 2008 that was unpermitted. The legalization of the dock is also included in this application. During the site visit, it appeared everything was stable. There was no evidence of erosion, sedimentation or drainage impacts from the dock or additions. Mr. Herald asks if any additional inspections will be required to ensure the additions adhere to building code and if there is a foundation under the addition. Mr. Vitti said that three sonitubes exist under the room which is adjoined to the house. The porch was built on an existing slab which had previously been a patio. Mr. Herald asks how big the room for the addition is. Mr. Vitti states that it is 12’2”x14’9”. Motion to table No. 1206, 20 Apple Blossom Lane, for staff report was made by Geoff Herald; seconded by Tom Giegler. All in favor with Ayes from Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. OLD BUSINESS: #1204 4 Lee Mac Ave., J.A.R. Associates, Beecher, Thomas W. Esq., Agent; (K14122), IL-40 Zone, Construction of two new buildings and site improvements including parking and storm drainage. Mr. Doto informed the commission prior to the meeting that he was unable to prepare the additional information in time for the meeting. He requested the application be tabled to the next regularly scheduled meeting. Motion to table No. 1204, 4 Lee Mac Ave., for additional information as the presenter was not available was made by Geoff Herald, seconded by Tom Giegler. All in favor with Ayes from Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. ______________________________________________________________________________ #1205 Franklin Street Extension Bridge, City of Danbury; Rehabilitation/ Replacement of bridge located over Mercer’s Pond Brook Mr. Altermatt was present from the City of Danbury Engineering Department. He acknowledged receipt of the staff report, and accepted the conditions as presented. Motion to approve No. 1205, Franklin Street Extension Bridge, with a summary ruling and six conditions was made by Geoff Herald; seconded by Tom Giegler. All in favor with Ayes from Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. ______________________________________________________________________________ #1188 1 Mariana Farms Dr., Piacente, Devin & Josemary, (B13048), RA-80, Feasibility of Subdivision Mr. Gallo informed the commission that he spoke with Ralph Gallagher. Mr. Gallagher intends on withdrawing the application, so it will be removed from the agenda. We are just waiting for something in writing from Mr. Gallagher. EIC Minutes – October 25, 2023 Page 3 Motion to table to No. 1188, 1 Mariana Farms Dr, for more information was made by Tom Giegler, seconded by Elizabeth Falk. All in favor with Ayes from Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. VIOLATIONS: Barnum Road, Danbury, CT- Cease & Desist Mr. Gallo informed that commission that this is now being handled in house by Corporation Counsel, Attorney Yamin. They told Mr. Gallo they are setting up a meeting with Mr. Halas’ attorney to determine the next steps. There is no other update at this time. Mr. Giegler states that he heard Mr. Halas is still dumping on the site. Mr. Gallo said he visited the site recently, and there was no evidence of additional dumping. Motion to table discussion of Barnum Road Cease & Desist until the next regularly scheduled meeting was made by Geoff Herald, seconded by Elizabeth Falk. All in favor with Ayes from Tom Giegler, Elizabeth Falk, Mary Cronin, and Geoff Herald. ADJOURNMENT: Motion to adjourn was made by Geoff Herald; seconded by Mary Cronin.
