Alternate Alex Wolk Jr. was seated for a vacancy on the Commission. Staff present was Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Chairman Gallo. ACCEPTANCE OF MINUTES: March 27, 2024 Motion to accept the minutes of March 27, 2024 as presented was made Geoff Herald; seconded by Alex Wolk Jr.. No remarks. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Alex Wolk Jr., Geoff Herald, and Bernard Gallo. Next regular meeting is scheduled for May 8, 2024. OLD BUSINESS: #1212 20 Barnum Road, Mejia, Alejandro; (F06063), RA-40 Zone, Legalization of previously installed pool, grading and plantings No one was present to represent the application. Motion to approve No. 1212, 20 Barnum Road, with a summary ruling and six conditions as presented was made by Geoff Herald; seconded by Matthew Rose. During discussion, Geoff Herald asked how they would ensure compliance, and if inspections could be EIC Minutes – April 24, 2024 Page 2 performed in the future. Mr. Liebman said the staff report requested an as-built survey by a licensed surveyor which will help with compliance. They could also inspect the property after to ensure that the applicant is compliant. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. _____________________________________________________________________________ #1213 262 Great Plain Road, Egret Investments, LLC; (J04197), RA-20 Zone, Construction of single-family dwelling, including installation of storm drainage, septic system, and grading Nicholas Yuschak of CCA was present. He acknowledged the staff report, and found the conditions acceptable. Motion to approve No. 1213, 262 Great Plain Road, with a summary ruling and eleven conditions as presented was made by Geoff Herald; seconded by Matthew Rose. During discussion, Ms. Falk thought that condition #2 was going to be revised regarding removal of the pump equipment. Mr. Liebman clarified that the pump equipment would be removed but the pump house would remain. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. _____________________________________________________________________________ #1211 117 Boulevard Drive, Cavalcanti, Sergio R.; (D16023), RA-40 Zone, Legalization of previously built/ installed dock, deck, shed, and platform No one was present to represent the application. Motion to table No. 1211, 117 Boulevard Drive, until the next regularly scheduled meeting was made by Geoff Herald; seconded by Elizabeth Falk. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. ______________________________________________________________________________ #1208 7A Brighton St, Katz, Jeffrey, Ralph Gallagher Jr., Agent; (I06077), RA-20 Zone, Construction of single-family dwelling, driveway, well and septic system Chairman Gallo informed the Commission a request to withdraw the application without prejudice was received from the applicant. Motion to accept the applicant’s request to withdrawal without prejudice for No. 1208, 7A Brighton St., was made by Geoff Herald; seconded by Alex Wolk Jr. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. VIOLATIONS 1. Halas, Barnum Road, Danbury, CT- Cease & Desist Chairman Gallo said this issue has been in front of the Commission for 13 months and multiple meetings. The latest draft of the letter was provided to the Commission with the biggest EIC Minutes – April 24, 2024 Page 3 change being in item #3. Mr. Halas is responsible for the signs despite who makes them. Mr. Gallo feels if Mr. Halas doesn’t accept this letter then it should be referred to Corporation Counsel. Motion to acknowledge the Chairman’s letter and authorize him to send it Mr. Halas for Halas, Barnum Road Cease & Desist, was made by Geoff Herald; seconded by Elizabeth Falk. During discussion, Mr. Herald agrees this should be the last draft presented to Mr. Halas or it should be referred to Counsel. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. 2. 24 Barnum Road Violation Mr. Liebman informs the Commission he has spoken with Artel Engineering and was sent a preliminary remediation plan. He requested revisions to the plan, and expects to have the new plan prior to the next meeting. Motion to table 24 Barnum Road Violation until the next regularly scheduled meeting was made by Geoff Herald; seconded by Matthew Rose. All in favor with Ayes from Mark Massoud, Elizabeth Falk, Alex Wolk Jr., Geoff Herald, Matthew Rose, and Bernard Gallo. OTHER MATTERS: Chairman Gallo informed the Commission that three new members will be presented to City Council at the next meeting for possible appointment. CORRESPONDENCE: None ADJOURNMENT: Motion to adjourn was made by Geoff Herald; seconded by Elizabeth Falk.
