ROLL CALL:
Vice Chair Matthew Rose called the meeting to order at 7:00 p.m. Present by roll call:
Gary Dufel, John Schwartz, Elizabeth Falk, Geoff Herald, and Mark Massoud. Staff present was
Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector. Vice Chair
Matthew Rose seated Alternate Gary Dufel for Cristina Britton.
PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Mark Massoud.
ACCEPTANCE OF MINUTES: June 12, 2024
Motion to accept the minutes of June 12, 2024 as presented was made Mark Massoud;
seconded by Elizabeth Falk. No remarks. All in favor with Ayes of those eligible to vote: John
Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and Matthew Rose.
Next regular meeting is scheduled for July 10, 2024.
NEW BUSINESS: None
OLD BUSINESS:
#1215 1&3 Pembroke Rd, 3775 LLC, Benjamin V. Doto III, P.E., Agent; (G08029,
G08030, G08098), RA-20 Zone, Construction of a 9 unit, single-family residential development,
along with a pool house, sports court and site improvements

Vice Chair Matthew Rose informed the Commission that the applicant requested the
matter be tabled until the next meeting.
Motion to table No. 1215, 1&3 Pembroke Road, until the next regularly scheduled
meeting was made by Geoff Herald; seconded by Elizabeth Falk. All in favor with Ayes: Gary
Dufel, John Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and Matthew Rose.

#1216 145 Middle River Rd, DeBellis, Nicholas; (C10054), RA-40 Zone, Construction of
a single family dwelling with related driveway, septic system and well
Vice Chair Matthew Rose informed the Commission that the applicant requested the
matter be tabled until the next meeting.
Motion to table No. 1216, 145 Middle River Road, until the next regularly scheduled
meeting was made by Elizabeth Falk; seconded by Mark Massoud. All in favor with Ayes:
Gary Dufel, John Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and Matthew Rose.

#1217 147 Middle River Rd, DeBellis, Nicholas; (C10053), RA-40 Zone, Construction of
a single family dwelling with related driveway, septic system and well
Nicholas Yuschak from CCA LLC was present to represent the application. He
acknowledged receipt of the staff report, and accepted the conditions presented.
Mr. Herald asked Mr. Liebman to clarify is the conditions presented were the standards
conditions; Mr. Liebman confirmed.
Motion to approve No. 1217, 147 Middle River Road, with five conditions as noted in the
staff report was made by Geoff Herald; seconded by Mark Massoud. All in favor with Ayes of
those eligible to vote: John Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and
Matthew Rose.
ADMINISTRATIVE STAFF ACTIONS:
VIOLATIONS:
1. Halas, Barnum Road, Danbury, CT- Cease & Desist
Motion to table Halas, Barnum Road- Cease & Desist until the next regularly scheduled
meeting was made by Elizabeth Falk; seconded by Geoff Herald. All in favor with Ayes: Gary
Dufel, John Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and Matthew Rose.
2. 24 Barnum Road Violation
Dainius Virbickus from Artel Engineering was present to represent the property. He
stated that they made revisions to the plans based on staff feedback. He read the enforcement
report and finds the conditions acceptable.
Motion to accept and approve the report with the seven conditions for the restoration of
24 Barnum Road Violation with completion no later than June 26, 2025 was made by Geoff

Herald; seconded by Elizabeth Falk. All in favor with Ayes of those eligible to vote: John
Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and Matthew Rose.
OTHER MATTERS:
1. Election of Interim Officers:
Vice Chair Matthew Rose informed the Commission they will hold elections for interim
officers, and will hold regular elections in December as usually performed.
Geoff Herald nominated Matthew Rose to serve as Interim Chairman, seconded by Mark
Massoud. All in favor with Ayes of those eligible to vote: John Schwartz, Elizabeth Falk, Geoff
Herald, and Mark Massoud.
Geoff Herald nominated Mark Massoud to serve as Interim Vice Chair, seconded by
Elizabeth Falk. All in favor with Ayes of those eligible to vote: John Schwartz, Elizabeth Falk,
Geoff Herald, and Matthew Rose.
No other nominations. Geoff Herald made a motion to close nominations; seconded by
Elizabeth Falk. All in favor with Ayes of those eligible to vote: John Schwartz, Elizabeth Falk,
Geoff Herald, Mark Massoud, and Matthew Rose.
Matthew Rose will serve as Interim Chairman until regular elections in December. Mark
Massoud will serve as Interim Vice Chair until regular elections in December.
2. Geoff Herald accepts responsibility to lead the planning and execution of planting a tree in
honor of former Chairman Bernard Gallo. He will discuss sites with the City agencies, along
with Mr. Gallo’s widow. He will also look into the appropriate tree which possibly could be
a Dutch Elm tree.

Motion to adjourn was made by Geoff Herald; seconded by Mark Massoud. All in favor
with Ayes: Gary Dufel, John Schwartz, Elizabeth Falk, Geoff Herald, Mark Massoud, and
Matthew Rose.
