Staff present was Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Mark Massoud. ACCEPTANCE OF MINUTES: October 9, 2024 Motion to accept the minutes of October 9, 2024 as presented was made by Geoff Herald; seconded by Michael Flanagan. No remarks. All in favor with Ayes of those eligible to vote: John Schwartz, Geoff Herald, Michael Flanagan, Elizabeth Falk, and Matthew Rose. Next regular meeting is scheduled for November 13, 2024. NEW BUSINESS: None OLD BUSINESS: #1223 2 Ezra Road, Dumser, Christopher, Correia, Jamie/ Hat City Pools, Agent, (H11114), RA-20 Zone, Installation of in-ground pool Jamie Correia was present to represent the application. He acknowledged receipt of the staff report, and accepted the conditions as presented. EIC Minutes – October 23, 2024 Page 2 Mr. Herald asked Mr. Correia was there was no permit prior to the start of construction. Mr. Correia said it was an oversight on his part, but they did apply once they were notified. Motion to approve No. 1223, 2 Ezra Road, with the 6 conditions noted in the staff report was made by Geoff Herald; seconded by Michael Flanagan. All in favor with Ayes: John Schwartz, Geoff Herald, Michael Flanagan, Elizabeth Falk, Mark Massoud and Matthew Rose. ______________________________________________________________________________ #1224 36 Newtown Road, 36 Newtown Road LLC, Ronald Wolff, P.E., Agent, (K13188), CG-20 Zone, Redevelopment of site to proposed restaurant use Ron Wolff, P.E. was present to represent the application. He acknowledged and accepted staff report that was provided. Mr. Herald asked Mr. Liebman is the concerns over the stream were included in the staff report that they had discussed on site. Mr. Liebman said the applicant has agreed to clean the area. IHOP will also be helping clean as the stream is on their property as well. Mr. Liebman informs Mr. Wolff that he will want more information on the tank once they have it pumped and possibly removed. Motion to approve No. 1224, 36 Newtown Road, with the 7 conditions as noted in staff report was made by Elizabeth Falk; seconded by Geoff Herald. All in favor with Ayes: John Schwartz, Geoff Herald, Michael Flanagan, Elizabeth Falk, Mark Massoud and Matthew Rose. ______________________________________________________________________________ #1222 Country Ridge Road, Lariccia, Tania & Philip, Mazzucco, Michael J., P.C., Agent, (K08115 & K08172), RA-40 Zone, Construction of single family dwelling, septic, well, drainage systems and utilities Mr. Rose informs the Commission that the applicant has requested to table the application to the next meeting. Mr. Liebman adds that no new information has been received from the applicant or agent. Motion to table No. 1222, Country Ridge Road, per the applicant’s request was made by Mark Massoud; seconded by Elizabeth Falk. All in favor with Ayes: John Schwartz, Geoff Herald, Michael Flanagan, Elizabeth Falk, Mark Massoud and Matthew Rose. APPLICATION FOR ADMINISTRATIVE APPROVAL: None ADMINISTRATIVE STAFF ACTIONS: None VIOLATIONS: 1. Halas, Barnum Road, Danbury, CT- Cease & Desist Mr. Rose informs the Commission that Corporation Counsel is working on a possible agreement. Motion to table Halas, Barnum Road- Cease & Desist until the next regularly scheduled meeting was made by Geoff Herald; seconded by Michael Flanagan.
