CITY OF DANBURY 155 DEER HILL AVENUE DANBURY, CONNECTICUT 06810 PLANNING COMMISSION (203) 797-4525 www.danbury-ct.gov (203) 797-4586 (FAX) MINUTES OCTOBER 6, 2021 The web-based meeting hosted on Zoom was called to order by Vice-Chairman Joel Urice at 7:33 PM. Present were Robert Chiocchio, Helen Hoffstaetter, Perry Salvagne, and Joel Urice. Also present was Deputy Planning Director Jennifer Emminger. Absent were Chairman Arnold Finaldi and Alternates Kevin Haas and Gary Renz. Mrs. Hoffstaetter made a motion to accept the September 20, 2021 minutes. Mr. Salvagne seconded the motion and it was passed unanimously by voice vote with four ayes. CONTINUATION OF PUBLIC HEARING: Nejame Plaza LLC – Application for Special Exception/Revised Site Plan Approval to permit Storage of Concrete Aggregates or Manufacture of Concrete & Concrete Products, Storage of Bituminous Product, Storage or Sale of Building Materials, & Storage of Construction Equipment (Nejame Pool Industrial Site) in the IG-80 Zone - 44 Payne Road (N12004) - SE #776. Attorney Ward Mazzucco quickly reviewed their July presentation and said they had made the requested revisions to the site plan and also updated the operations plan. He said they had received late comments this afternoon from the Engineering Department so they will need to come back on the October 20th meeting to deal with those issues. Ralph Gallagher PE spoke next. He pointed out the opaque gate that had been installed from the corner of the building to the northern property line. He said this really shields the rear yard from roadway view. He said they added seven more parking places because they had the room to do that. He said they reconfigured the bin layout so water will be able to pass through without accumulation. He said all of the drainage that was installed when they were approved for the larger building has been in operation for the past eleven years without problems. He explained exactly how the drainage works and said they are capturing 90% of the runoff and treating it. He continued saying every small change causes other parts of the development to change. He said they can make changes to the mountable island to give it more definition. There were no questions for Mr. Gallagher. Planning Commission Minutes October 6, 2021 Virtual Meeting hosted on Zoom Page 2 Vice-Chairman Urice asked since the sediment basins have been there at least eleven years, how many times have they been cleaned out. Tom Nejame, one of the applicants, said there is another galley system in the front of the building which has been in since the small building was put in and it has been cleaned out several times during the twenty years it has been in. He said for the newer system, they can see into the manhole so they know when it needs to be cleaned out. He said usually once every three-to five years they need to be done. Vice-Chairman Urice asked if there was anyone to speak in opposition to this application and there was no one. He then asked Mrs. Emminger to give them an update as to outstanding comments from any departments. She said there is still the outstanding comment from Construction Services regarding the mountable curb and the requested delineation between ingress and egress to/from the site. She said the plans show this curb as concrete but it needs to be shown as mountable. She said she spoke to the Town of Bethel, specifically Planning Director Beth Cavagna, and all of their staff comments have been addressed. She then said the most significant outstanding issues are the Engineering Department comments which need to be resolved in order to get a clean final letter. She said the Engineering staff suggested they continue the hearing tonight to give the applicant the opportunity to provide the requested information. Lastly, she said that Attorney Mazzucco has submitted an extension letter to allow them to continue this hearing until the next meeting on October 20th. Vice-Chairman Urice then addressed the project team and said the Commission has been patient about waiting for them to provide answers to staff questions. He said unfortunately they are running out of time so if the applicant still cannot address the outstanding comments by the October 20th meeting, they need to let staff know because they may need to withdraw or the Commission may have to deny this application. Attorney Mazzucco and Mr. Nejame both thanked the Commission for their patience through this process. Mr. Gallagher said he is confident they will be able to clear up all of the Engineering issues in time for the October 20th meeting. Mr. Salvagne made a motion to continue the public hearing. Mr. Chiocchio seconded the motion and it was passed unanimously by voice vote with four ayes. OTHER MATTERS: Request for Lot Line Revision (between lots #16, #17, & #18) on Shoreview Lane in the Pine Ledge Subdivision. Mrs. Emminger said they have to table this because the map is missing notations which are required to show that none of the lots will be made non-conforming by this lot line revision. She said we should have a revised plan in time for the next meeting.
