City Commission

On Wednesday, February 21, 2024, at 6:00 p.m., the Dayton City Commission met in regular session in the Commission Chambers of City Hall. CALL TO ORDER Mayor Mims called the meeting to order. ROLL CALL Roll call was taken, and Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss were present. The Clerk of Commission, Ms. Regina Blackshear, and the City Manager, Ms. Shelley Dickstein, were also present. Commissioner Joseph made a motion to excuse the absence of Commissioner Shaw. Commissioner Fairchild seconded the motion. The motion was unanimously approved. INVOCATION Mayor Mims asked for a moment of silence to commemorate the passing of world leaders along with community leaders Mr. James Wingfield, Ms. Marva Cosby, Mr. Herbert Burton, Mr. Richard Green, and Mr. Joe Madison. Commissioner Turner-Sloss gave the invocation. PLEDGE OF ALLEGIANCE Mayor Mims led the public in the Pledge of Allegiance. APPROVAL OF MINUTES Commissioner Joseph made a motion to approve the minutes from the February 14, 2024, City Commission meeting. Commissioner Fairchild seconded the motion. The previous meeting minutes were unanimously approved. COMMUNICATIONS AND PETITIONS There was no communication or petitions. SPECIAL AWARDS/PRESENTATIONS Mayor Mims said in honor of Black History Month he would like to honor three former mayors who contributed to Black History Mayor James H. McGee the first black mayor who served from 1970 through 1982, Mayor Richard Clay Dixon who served from 1987 until 1993, and Mayor Rhine McLin the first black female mayor who served from 2002 until 2010. ADDITIONS OR DELETIONS TO THE CALENDAR The Clerk of Commission, Ms. Regina Blackshear, requested the legislation be read first because Commissioner Joseph needed to leave the meeting early. Ms. Blackshear also corrected Ordinance No. 32085-24. She said it should be read as an emergency. LEGISLATION EMERGENCY ORDINANCES – SECOND READING Emergency Ordinance No. 32084-24- Authorizing the Grant of a Right of Way Easement to Pioneer Rural Electric Cooperative, Inc. for the Complete Construction, Installation, Reconstruction, Rephasement, Relocation, Extension, Operation, Maintenance, Testing, Repair, and Removal, at any Time or Times Hereafter, of the Cooperative’s Electric Transmission and/or Distribution Line or System and/or Communication Systems, Including Conduits, Cable, Wires, Poles, Fixtures and Appurtenances on Parcels of Land Located at the Dayton International Airport, and Declaring an Emergency. The question being shall Emergency Ordinance No. 32084-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Emergency Ordinance was passed. Emergency Ordinance No. 32085-24- Enacting Section 137.23 of the Revised Code of General Ordinances Regarding Nuisance Parties and Declaring an Emergency. The question being shall Emergency Ordinance No. 32085-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Emergency Ordinance was passed. EMERGENCY RESOLUTION – FRIST READING Emergency Resolution No. 6781-24- Approving the Submission of Applications and Authorizing the Acceptance of Grant Awards from the Ohio Department of Transportation Under the Safe Routes to School Program for State Fiscal Year 2020, and Declaring an Emergency. Commissioner Turner-Sloss moved that this being an emergency measure for the immediate consideration of the Ordinance. Commissioner Joseph seconded the motion. The motion was passed with a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. Emergency Resolution No. 6782-24- Appointing Mayor William D. Duncan to the Montgomery County 9-1-1 Program Review Committee Pursuant to Ohio Revised Code Section 128.06(A)(5) and, Declaring an Emergency. Commissioner Fairchild moved that this being an emergency measure for the immediate consideration of the Ordinance. Commissioner Joseph seconded the motion. The motion was passed with a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. ORDINANCE – FIRST READING Ordinance No. 32087-24- Appropriating Funds for the Year 2024 to Provide for the Operating and Capital Expenses of Various Offices, Departments, and Divisions of the Government of the City of Dayton. ORDINANCE- SECOND READING Ordinance No. 32086-24- Amending the Official Zoning Map to Establish Planned Development-187 for 5.28 Acres for the Properties Located at 1233 N Keowee Street and 1301 N Keowee Street. The question being shall Ordinance No. 32086-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Ordinance was passed. RESOLUTION – SECOND READING Resolution No. 6780-24- Authorizing the Submission of an Application for Funding Consideration by the United States Department of Transportation under the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) Program. The question being shall Resolution No. 6780-24 be approved. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Resolution was approved. Commissioner Joseph left the meeting at 6:10 p.m. DISCUSSION OF CALENDAR ITEMS Calendar Item No. 3. G F Bailey Wolf Creek LLC – Service Agreement The City Manager, Ms. Shelley Dickstein, said the agreement is part of the $12M investment in housing for vacant home rehab, owner-occupied home repairs, Habitat, and the Sims predevelopment. She said there would be down payment assistance coming soon as part of the investment. Calendar Item No. 5. Miami Valley Housing Opportunities, Inc. – Grant Agreement The City Manager, Ms. Shelley Dickstein, said the agreement is an annual continuum care agreement to provide permanent subsidized housing support for homeless adults. Calendar Item No. 8. Joby Aero, Inc. – Lease Agreement The City Manager, Ms. Shelley Dickstein, said the agreement is for the old post office located at the airport. She said Joby will bring 2000 jobs to the area to manufacture their flying cars. Calendar Item No. 10. Milton Industries, Inc. dba Steck Manufacturing-Development Agreement The City Manager, Ms. Shelley Dickstein, said the agreement is for an incentive to help them relocate and expand their company. Ordinance No. 32087-24- Appropriating Funds for the Year 2024 to Provide for the Operating and Capital Expenses of Various Offices, Departments, and Divisions of the Government of the City of Dayton. The City Manager, Ms. Shelley Dickstein, said the ordinance reflects the budget as was presented in October with adjustments that have occurred in November, December and January. Ms. Dickstein invited Ms. Abbey Patel-Jones, Director of Management and Budget, to the podium to present the changes to the appropriation. Ms. Jones said the first reading of the original appropriations for fiscal year 2024 is 982M is hovering under that billion-dollar mark. She said this is a 37.2M increase over the temporary budget that was passed in November. She said the increase is due to the carryover budget which represents the previously approved unexpended budget which is reappropriated. She gave an overview of the various changes and said the detailed information is available on the City of Dayton’s website under management and budget. Commissioner Turner-Sloss thanked her for the update and for answering her questions. She said she was pleased that the detailed information was available for citizens on the website. REPORTS 1. Commissioner Fairchild Commissioner Fairchild thanked citizens and community leaders for their comments at the meeting. Commissioner Fairchild highlighted his tour and thanked his tour guides of the Arcade. Commissioner Fairchild congratulated Mayor Mims on the State of the City address. He said it was also National Transit Day. Mayor Mims Mayor Mims highlighted his visit with Wilberforce University at the Fitz Center and the new sports program they are proposing. Mayor Mims highlighted his attending Parity Inc.’s Top Ten African American Men event, and the Dance Stop and Shake event at the Masonic Temple.
