City Commission

On Wednesday, May 1, 2024, at 6:00 p.m., the Dayton City Commission met in regular session in the Commission Chambers of City Hall. CALL TO ORDER The Temporary Chairperson Commissioner Joseph called the meeting to order. INVOCATION Commissioner Shaw gave the invocation. PLEDGE OF ALLEGIANCE The Temporary Chairperson, Commissioner Joseph led the public in the Pledge of Allegiance. ROLL CALL Roll call was taken, and Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss were present. The Clerk of Commission, Ms. Regina Blackshear, and the City Manager, Ms. Shelley Dickstein, were also present. Commissioner Shaw made a motion to excuse the absence of Mayor Mims from this week's meeting. Commissioner Fairchild seconded the motion. The motion was unanimously passed. APPROVAL OF MINUTES Commissioner Shaw made a motion to approve the minutes from the April 24, 2024, City Commission meetings. Commissioner Fairchild seconded the motion. The previous meeting minutes were unanimously approved. COMMUNICATIONS AND PETITIONS There were no communications or petitions. SPECIAL AWARDS/PRESENTATIONS There were no special awards or presentations ADDITIONS OR DELETIONS TO THE CALENDAR There were no additions or deletions to the calendar. DISCUSSION OF CALENDAR ITEMS Calendar Item No. 3. County Corp – Service Agreement The City Manager, Ms. Shelley Dickstein, said the agreement is for downpayment assistance and financial counseling at the Homeownership Center of Dayton. Calendar Item No. 5. Outdoor Enterprise, LLC. -Award of Contract The City Manager, Ms. Shelley Dickstein, said the contract will upgrade amenities and sidewalks at McCabe Park. Calendar Item No. 6. Invictus Development Group – Development Agreement The City Manager, Ms. Shelley Dickstein, said the development agreement is for upgrades at the Healthy Family Food Market which will be part of the Dayton Children’s West Campus. Calendar Item No. 7. Montgomery County Convention Facilities Authority – Development Agreement The City Manager, Ms. Shelley Dickstein, said yesterday Montgomery County passed their agreement for $1.5M and this contract is the City of Dayton’s part. REPORTS 1. APPROVAL OF CITY MANAGER’S REPORTS Commissioner Shaw made the motion to approve the City Manager’s Reports. Commissioner Fairchild seconded the motion. The City Manager’s Reports were approved with a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. LEGISLATION EMERGENCY ORDINANCE – SECOND READING Emergency Ordinance No. 32096-24- Amending Sections 115.30(A), 115.60, and 115.701 of the Revised Code of General Ordinances Relating to Taxicabs for Low-Speed Vehicle Commercial Business and Commercial Quadricycles, Enacting Section 115.80, and Declaring an Emergency. The question being shall Emergency Ordinance No. 32096-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph and Shaw. Commissioner Fairchild voted no. The Ordinance was passed. RESOLUTION – SECOND READING Resolution No. 6797-24- Declaring the Intention of the Commission to Vacate a Ten-Foot Easement of Marimont Drive from the West Property Line of City Lot #56497 to Pershing Boulevard. The question being shall Resolution No. 6797-24 be adopted. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The Resolution was adopted. BOARD APPOINTMENT Commissioner Turner-Sloss made a motion to reappoint Lola Smith to the Greater Dayton Premier Management Board for a term ending June 30, 2029. Commissioner Fairchild seconded the motion. The motion was unanimously approved. CITIZENS’ COMMENTS Citizens’ comments were received from the following: 1. Ms. Lee Cook, 4808 Hassan Cir. - spoke in opposition to R.C.G.O. Code Section 137.21. 2. Mr. Keith Lander, 429 S. Kilmer – spoke about the closing of stores in West Dayton. 3. Ms. Maggie Burk, 1200 Epworth Ave. - spoke in opposition to R.C.G.O. Code Section 137.21. 4. Mr. Allen Lemp, 5136 Grantis Frederick - spoke in opposition to R.C.G.O. Code Section 137.21. 5. Mr. Kevin Keller, 3922 E. Third St. – made general comments. 6. Ms. Diamond Jackson, 2005 Emerson Ave. - spoke in opposition to R.C.G.O. Code Section 137.21. 7. Ms. Samantha Klawonn, 1221 Brookview Ave. - spoke in opposition to R.C.G.O. Code Section 137.21. 8. Mr. Alec Johnson, 4822 Hassan Cir.- spoke about democracy. COMMENTS BY THE CITY MANAGER The City Manager, Ms. Shelley Dickstein, congratulated Dayton Police on their award celebration. She thanked them for their service and compassion to the citizens of Dayton. COMMENTS BY THE CLERK OF THE COMMISSION The Clerk of Commission, Ms. Regina Blackshear, had no closing comments. COMMENTS BY THE CITY COMMISSION Commissioner Turner-Sloss Commissioner Turner-Sloss thanked citizens and community leaders for their comments at the meeting. Commissioner Turner-Sloss congratulated Dayton Police on their award celebration. Commissioner Turner-Sloss said she is looking forward to more context on R.C.G.O. Code Section 137.21. Commissioner Turner-Sloss said Catholic Social Services of Miami Valley will open an extension of their exciting location soon. She said Homeful Healthy Living is scheduled to open soon as well. She said it continues to show their commitment to the most vulnerable population in the City of Dayton. Commissioner Fairchild Commissioner Fairchild thanked citizens and community leaders for their comments at the meeting. Commissioner Fairchild extended his apologies for missing the Dayton Police Award Celebration. He said the Police and Law Enforcement Memorial services will occur on Friday. Commissioner Fairchild said the Labor Council held their memorial event for their fallen comrades. Commissioner Fairchild highlighted upcoming events: First Friday, Lion King, Dayton Dragons, Levitt Pavilion schedule, and World A’Fair. Commissioner Shaw Commissioner Shaw congratulated Dayton Police on their award celebration and apologized for missing the event. He said there are a lot of positive things that come from the police. Commissioner Joseph Commissioner Joseph said the AFL-CIO organized the memorial event and read each name of the workers who had been killed on the job.
