November 1, 2024 TO: Regina Blackshear Clerk of Commission FROM: Anita Johnson, Office Assistant, City Commission Office SUBJECT: Draft Minutes of the October 2nd Dayton City Commission Meeting CITY COMMISSION MEETING On Wednesday, October 2, 2024, at 6:01 p.m., the Dayton City Commission met in regular session in the Commission Chambers of City Hall. CALL TO ORDER Mayor Mims called the meeting to order. INVOCATION Commissioner Turner-Sloss gave the invocation. PLEDGE OF ALLEGIANCE Mayor Mims led the public in the Pledge of Allegiance. ROLL CALL Roll call was taken, and Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss were present. The Clerk of Commission, Ms. Regina Blackshear, and the Acting City Manager, Mr. Joe Parlette, were also present. Commissioner Joseph made a motion to excuse the absence of Commissioner Shaw from this week's meeting. Commissioner Fairchild seconded the motion. The motion was unanimously approved. APPROVAL OF MINUTES Commissioner Fairchild made a motion to approve the minutes from the September 25, 2024, City Commission meetings. Commissioner Joseph seconded the motion. The previous meeting minutes were unanimously approved. COMMUNICATIONS AND PETITIONS There were no communications or petitions. SPECIAL AWARDS/PRESENTATIONS There were no special awards or presentations. ADDITIONS OR DELETIONS TO THE CALENDAR The Clerk of Commission requested the addition of Informal Resolution No. 1012-24- Endorsing the Five Rivers MetroParks issue on the November 5, 2024, general election ballot to protect our MetroParks for residents of Dayton and Montgomery County. Ms. Blackshear said Commissioner Turner-Sloss has requested that Calendar Item No. 6 Ordinance No. 32117-24 be pulled from the agenda for one week for further discussion. DISCUSSION OF CALENDAR ITEMS Calendar Item No. 2. Brumbaugh Construction Inc. – Contract Modification The Acting City Manager, Mr. Joe Parlette, said this item is for the West Pod Police Station for concrete work to take place before the winter months. He noted that the MBE participation goal for this portion was set at five percent, and they exceeded that goal. Ordinance No. 32116-24- Amending Sections 152.01 through 152.99 of the Revised Code of General Ordinances Concerning Public Nuisances. Commissioner Turner-Sloss thanked Planning Neighborhoods and Development and the Law Department for their work on the legislation of revising the general ordinances regarding public nuisances and said this will help to improve neighborhoods. Ordinance No. 32117-24- Enacting Section 35.25 of the Revised Code of General Ordinances Regarding Project Labor Agreements. Commissioner Turner-Sloss said she supports a project labor agreement and thanked her colleagues for their work on the ordinance but would like further conversation to strengthen the language. CITIZENS’ COMMENTS ON CALENDAR ITEMS There were no citizen’s comments on calendar items. APPROVAL OF CITY MANAGER’S REPORTS Commissioner Joseph made the motion to approve the City Manager’s Reports. Commissioner Fairchild seconded the motion. The City Manager’s Reports were approved with a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. LEGISLATION ORDINANCES – FIRST READING Ordinance No. 32116-24 - Amending Sections 152.01 through 152.99 of the Revised Code of General Ordinances Concerning Public Nuisances. Ordinance No. 32118-24 - To Vacate the Southern Portion of Buckeye Street at Wayne Avenue. RESOLUTION – FIRST READING Resolution No. 6829-24 - Approving the Submission of Grant Applications and Authorizing the Acceptance of Grant Awards from the Miami Valley Regional Planning Commission under the Transportation Improvement Program. RESOLUTION – SECOND READING Resolution No. 6827-24 - Declaring the Intention of the Commission to Vacate Brennan Drive from Hall Avenue to East Helena Street and Hall Avenue from Brennan Drive to North Keowee Street. The question being shall Resolution No. 6829-24 be adopted. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Resolution was adopted. THIS ITEM WAS ADDED INFORMAL RESOLUTION Informal Resolution No. 1012-24 - Endorsing the Five Rivers MetroParks Issue on November 5, 2024, General Election Ballot to Protect Our Metroparks for Residents of Dayton and Montgomery County. Commissioner Joseph made a motion to adopt Informal Resolution No. 1012-24. Commissioner Fairchild seconded the motion. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Mayor Mims, Commissioners Joseph, Fairchild, and Turner-Sloss. The Informal Resolution was adopted. BOARD APPOINTMENT Commissioner Joseph made a motion to appoint Glenda Camp, Porothea Dennis, and Howard Jordan to the Housing Appeals Board for a term ending September 30, 2027. Commissioner Turner-Sloss seconded the motion. The motion was unanimously approved. Commissioner Joseph requested to pull the reappointments for the Housing Appeals Board. CITIZENS’ COMMENTS Citizens’ comments were received from the following: 1. Mr. Spencer Glazer, 1305 Carlisle Ave., Dayton, Ohio 45420 - spoke about the Human Rights Assessment. 2. Ms. Anna Flores, 9227 Great Lakes Cir., Dayton, Ohio 45458 – spoke in opposition to DRITA. 3. Ms. Tara Campbell, 2224 Chamberlin Ave., Dayton, Ohio 45406 - spoke about the Human Rights Assessment. 4. Ms. Maggie Burk, 1200 Epworth Ave., Dayton, Ohio 45410 - spoke about the Human Rights Assessment. 5. Ms. Alexandra Williams, 2125 E. Whipp Road, Dayton, Ohio 45440 - spoke about the Human Rights Assessment, and in opposition to DRITA.  6. Ms. Sharon Dugger, 1503 Miami Chapel Rd., Dayton, Ohio 45417 - spoke about a gun shooting incident at her home and gun violence. 7. Mr. Hillary Lerman, 249 Wyoming St., Dayton, Ohio 45409 - spoke about the Human Rights Assessment. 8. Mr. Evan Lavoie, 1040 Harvard Blvd., Dayton, Ohio 45409- spoke about an ordinance to impose civil penalties on property owners that have building code violations. 9. Mr. Youssef Elzein, 4906 Amberwood Dr., Dayton, Ohio 45424 - spoke about Human Rights. 10. Ms. Charlene Bayless, 2422 Patterson Blvd., Dayton, Ohio 45409 - spoke about the Human Rights Assessment. 11. Mr. Alex Gorman, 133 Linden Ave., Dayton, Ohio 45403 - spoke about the Human Rights Assessment and he spoke in opposition to DRITA. 12. Mr. Greg West, 1323 Kingsley Ave., Dayton, Ohio 45406 – invited the community to a fishing event for youth. 13. Mr. Julio Mateo, 215 Ice Ave., Dayton, Ohio 45402 - spoke about the Human Rights Assessment. COMMENTS BY THE ACTING CITY MANAGER The Acting City Manager, Mr. Joe Parlette, had no closing comments. COMMENTS BY THE CLERK OF THE COMMISSION The Clerk of Commission, Ms. Regina Blackshear, had no closing remarks. COMMENTS BY THE CITY COMMISSION Commissioner Turner-Sloss Commissioner Turner-Sloss thanked staff for their work on the 3rd Annual Mayor’s Teen Youth Summit. Commissioner Turner-Sloss encouraged citizens to call Public Works at 937-333-4800 for additional assistance concerning debris from Hurricane Helene. Commissioner Turner-Sloss thanked citizens, and community leaders for their comments at the meeting. Commissioner Fairchild Commissioner Fairchild asked for clarification of the Human Rights assessment. Commissioner Fairchild highlighted the upcoming Outdoor Experience at Eastwood Park, Dayton Literary Peace Awards. Also, he reminded everyone that the last day to register to vote is Monday, October 7, 2024, he implored citizens to check their voter registration. Commissioner Fairchild wished Jewish residents a Happy New Year. Commissioner Joseph Commissioner Joseph highlighted voter registration and asked citizens to check their registration. Commissioner Joseph thanked Dr. Vannessa Ward for a tour of the Hope Center. Mayor Mims Mayor Mims thanked citizens, and community leaders for their comments at the meeting. Mayor Mims said hatred for none and love for all. ADJOURNMENT There being no further business, the meeting was adjourned at 6:53 p.m.
