City of Dayton City Plan Board Minute Record Overview May 14, 2024 4:30 P.M. Planning Resource Conference Room, City Hall 101 W. Third Street, Dayton, Ohio Members Present: Mr. William Allen, Ms. Leslie Lovelace, Mr. Matt Sauer, Ms. Ann Schenking, Mr. Greg Scott Members Excused: Ms. Rosie Miller, Ms. Geraldine Pegues Mr. Scott called the meeting to order at 4:30 P.M. A motion was made by Ms. Schenking, seconded by Mr. Sauer, and carried to excuse the absences of Ms. Miller and Ms. Pegues. A motion was made by Mr. Allen, seconded by Ms. Lovelace, and carried to approve the minutes of the March 12, 2024, meeting. Mr. Scott announced that case number 6 on the agenda, PLN2024-00094 regarding a potential rezoning of Wyoming Street at St. Paul and Illinois avenues from MR-5 Mature Single-family Residential to MNC Mature Neighborhood Commercial, had been withdrawn. Ms. Hanauer explained that community opposition at the Southeast Land Use Board meeting on May 7 led her to withdraw the case. The concerns of the community had centered on the ability to control the uses proposed for the buildings at the intersection and requiring the Use Variance process for any use other than residential. Several of the properties at the intersection have had trouble over the years, and the surrounding community does not support commercial uses by right in this location. Mr. Scott noted that the area was once a retail and commercial area. Mr. Scott asked if any of the poorly maintained residential properties along Wyoming Street were discussed during the meeting, and Ms. Hanauer replied that no, they were not. Mr. Sauer asked if the meeting had been public, and Ms. Hanauer replied that yes, the meeting had been public, and four residents had been in attendance. Ms. Hanauer stated that while the goal of a rezoning of this area would encourage development and growth, due to the strong opposition from the neighborhood, the rezoning will not be pursued at this time. Mr. Scott noted that Plan Board is charged with decisions on use of property and land within the city and that those should be in the best interest of the community, even if those decisions are in opposition to four voices from the community. 1. PLN2024-00071 – Honorary Designation for Joe Madison Located at Cowart Avenue Applicant: Elizabeth Watson 3101 Hilliard Ave Dayton, OH 45415 Priority Land Use Board: West Planning District: Arlington Heights Decision: Approved Ms. Hanauer noted that Mr. Gondol was announced as the Acting Director of the Department of Planning, Neighborhoods & Development at the March 12 meeting of Plan Board and is now the Director. Ms. Hanauer provided an update on the property at Claridge Park. The case for rezoning the parcel in the southwest corner of the park, PLN2023-00408, that would have facilitated the sale of the property was withdrawn. The Division of Economic Development is now leading the RFP process to find a new buyer. Ms. Hanauer wished Planning Division Manager Tony Kroeger a happy birthday. Mr. Scott thanked the City for the invitation to the Dragons game on April 19. The Plan Board meeting was adjourned by Mr. Scott at 5:21 P.M. Minutes approved by the City Plan Board on June 11, 2024. PLN2024-00064 – A preliminary subdivision record plan to split one (1) City lots into forty (40) City lots Applicant: Tom Cahalan Priority Land Use Board: Northeast Planning District: Pheasant Hill Decision: Approved with conditions Staff Comments Jeff Green presented the case. A preliminary subdivision record plan to split one (1) City lots into forty (40) City lots 188 feet west of the intersection at the corner of Ring Neck Dr and Pheasant Ridge Rd. The proposal would create 38 single-family homes. The subject property is located in the SR-2 Suburban Single-Family zoning district. Mr. Green noted the proposal meets the minimum zoning requirements for the SR-2 Zoning District and is requesting no variances. Mr. Green went over that this proposal, due to being considered a major record plan, would require both preliminary and final approval by Plan Board. He went over the conceptual plan, storm water plan, and tree plan that were submitted as part of this application to give the board further context for the development. Mr. Green went over the received comments and noted that the proposal would appear to be appropriate and would meet the code requirements for the SR-2 Zoning District and PD-42. Public Comments Peter Hitzeman (5779 Jansin Place, Huber OH) – had questions regarding any potential road improvements, stormwater requirements, and the process to develop a subdivision in terms of plans. Mr. Green noted the Engineering Division not requiring a traffic study and the process for a record plan. John Norton (5758 Webster St Dayton OH) – Mr. Norton pointed out and discussed what a lift station does for to manage stormwater. Board Discussion None. Board Action A motion was made by Ms. Schenking, seconded by Mr. Allen, and carried to approve Case PLN2024- 00064 subject to the following conditions: 1. Revise the Record Plan and any Construction Drawings per the City of Dayton Subdivision Regulations and comments from the Division of Civil Engineering. 2. Ensure that the dimensions close to within a 1:10,000 ratio. 3. Add any easements required by AES Power, City of Dayton Water, etc. 4. Include the radius for the Cul-de-Sacs. 5. PLN2024-00071 – Honorary Designation – Joe Madison Way Applicant: Eileen Watson Land Use Board: West Planning District: Arlington Heights Decision: Approved Staff Comments Ellen Sizer presented the staff report. The Honorary Designation would establish Cowart Avenue as “Joe Madison Way.” The planning district is Arlington Heights, which is in the West land use area. The official name of Cowart Avenue will remain. It is proposed to be a two-year honorary designation. Mr. Madison, a native of Dayton, Ohio, was a civil rights activist, an author, and a groundbreaking radio personality. Additionally, Mr. Madison grew up on Cowart Ave. His radio program, ''The Joe Madison Show", talks about political and social issues, brings attention to social injustices around the world, and challenges himself and his listeners daily to "do something about it." He has interviewed President Barack Obama in the Oval Office, Senator Chuck Schumer, Spike Lee, Barry Gordy, and hundreds of people around the world. TALKERS magazine ranked Mr. Madison's show in the top ten of their 100 Most Important Radio Talk Show Hosts in America over one dozen times. Ms. Sizer stated that no objection to the request has been received. Effort was made both by the applicant, Eileen Watson, and staff, signed petitions were obtained from property owners along the proposed Honorary Designation and the City of Dayton. No opposition has been raised from Public Works, Fire, Police, or the West Priority Land Use Board. Staff believes that the intent of the requirement for 51 percent of abutting property owners to sign petitions of support. Staff believes that the application meets the rules and guidelines set forth in Resolution Number 5014-99, and therefor recommends approval. Public Comments The applicant, Eileen Watson, spoke to Joe Madison’s biography. Joe Madison's lifelong dedication to civil rights and social causes along with his insightful radio show on Sirius XM have amplified the voices of marginalized communities and shedding light on systemic injustices. Joe's unwavering commitment to equity, justice, and equality embodies the very spirit of our great city. Board Discussion The Board found that the application could be approved and endorsed based on the required standards in the allowing Resolution.
