City of Delray Beach 100 NW 1st Avenue - Delray Beach, Florida 33444 Phone: (561) 243-7000 - Fax: (561) 243-3774 www.mydelraybeach.com Minutes - Final Wednesday, April 12, 2017 6:00 PM Special Meeting at 6:00 PM Delray Beach City Hall City Commission City Commission Minutes - Final April 12, 2017 Pursuant to Section 3.12 of the Charter of the City of Delray Beach the Mayor has instructed the City Clerk to announce a Special Meeting of the City Commission to be held for the following purposes: The Special Meeting of the City Commission of the City of Delray Beach, Florida was called to order by Mayor Cary Glickstein in the Commission Chambers at City Hall at 6:05 p.m. on Wednesday, April 12, 2017. Roll call showed: Commissioner Shelly Petrolia Vice Mayor James Chard Deputy Vice Mayor Shirley Ervin Johnson Commissioner Mitchell Katz Mayor Cary D. Glickstein Absent: None Also present were: Caryn Gardner-Young, Assistant City Manager R. Max Lohman, Interim City Attorney Kimberly Wynn, Acting City Clerk 17-375 Pursuant to Section 3.12 of the Charter of the City of Delray Beach the Mayor has instructed the City Clerk to announce a Special Meeting of the City Commission to be held for the following purposes: ATLANTIC CROSSING SETTLEMENT AGREEMENT - EDWARDS CDS, LLC VS. THE CITY OF DELRAY BEACH: Recommendation: Motion to Approve the settlement agreement between Edwards CDS, LLC and the City of Delray Beach related to the Atlantic Crossing development. Attachments: Settlement Agreement Addendum 4.6.17 Mayor Glickstein requested a moment of silence in honor of Police Officer Christine Braswell. He also wished for a speedy recovery for Officer Bernenda Marc. Mayor Glickstein praised and thanked the Police Department and the Fire Department for their service to the community. At this point it was the consensus of the Commission to allow public comments on the workshop item being presented. Mr. Jamie Cole, Special Counsel for the City of Delray Beach, gave a brief overview on the Atlantic Crossing Settlement Agreement. Mr. Cole addressed the key concerns of the citizens while explaining the intent of the City of Delray Beach Page 1 Printed on 4/6/2018 City Commission Minutes - Final April 12, 2017 Settlement Agreement. At this time, Mayor Glickstein called for public comments. Public Comments: 1. Ms. Rita Rana read a letter in record on behalf on Mr. Bruce Leiner which stated his support of the Settlement Agreement but asked for a postponement if uncertain about agreement. and commended the Mayor, Commissioners and City Attorney. 2. Ms. Justina Boughton, owner of the Colony Hotel, discussed the plans and how they had not been changed for years by the Developer. 3. Mr. Alan Slossberg discussed his concern with the underground garage and questioned the several subpoenas issued by the Developer. 4. Mr. Arlan Domnick thanked the Commission and read an email into records. 5. Ms. Jill Schifferli thanked the Commissioners for their time and effort on the project. She stated that the agreement addressed some issues, but she looked forward to working with the Mayor and Commissioners. 6. Mr. Sandy Zeller thanked the Commissioners and City Attorney for representing the city. He hoped that the Developer would accept the addendum. 7. Mr. Dan Sloan gave comments and suggestions about the agreement. 8. Dr. Victor Kirson commented on the project. 9. Mr. Bob Gainger talked about the journey of the Atlantic Crossing project. He commended the Mayor and Commissioners on their hard work and patience. 10. Ms. Beatty (sp?) Scherer recognized the Commissioners for getting the job done. There being no further requests, Mayor Glickstein closed public comments. Mayor Glickstein spoke about a third party challenge. Commissioners Petrolia and Katz thanked the residents for their hard work and dedication. Vice Mayor Chard questioned Mr. Cole about the Florida Department of City of Delray Beach Page 2 Printed on 4/6/2018 City Commission Minutes - Final April 12, 2017 Transportation (FDOT) Agreement. He requested further clarification. Deputy Vice Mayor Johnson applauded the residents for their time, energy and resources in helping the city to get to this point and also thanked Mr. Lohman. Mayor Glickstein addressed some of the comments and concerns made during public comments. Mr. Lohman advised that the underground garage is not city owned. Further discussion ensued with the Commissioners.
