The following were in attendance: Mayor Shelly Petrolia Vice Mayor Adam Frankel Deputy Vice Mayor Shirley Ervin Johnson Commissioner Bill Bathurst Commissioner Ryan Boylston Others present were: Mark R. Lauzier, City Manager Lynn Gelin, Deputy City Attorney Katerri Johnson, City Clerk SP.1. 18-794 City Commission Selection of Interim City Attorney Sponsors: City Manager Department Mayor Petrolia stated because the City is without lead counsel she requested this Special Meeting to take place so that the City Commission can contemplate moving forward with temporary counsel. Vice Mayor Frankel stated he emailed the City Manager, Mark Lauzier asking him if there was someone in-house capable of filling the role as City Attorney and he indicated that there was. Vice Mayor Frankel stated he also emailed Deputy City Attorney Lynn Gelin who indicated that she would be interested. Deputy Vice Mayor Johnson concurred with comments expressed with Vice Mayor Frankel and stated she supports an in-house attorney. Commissioner Boylston commented that he would have liked to have seen Mr. Lohman kept in place while the City Commission performed their search for lead counsel and then there would not have been an issue with having to appoint an Interim City Attorney. However, Commissioner Boylston stated he supports an in-house attorney with someone the City already has. Commissioner Bathurst stated he feels that the City has competent in-house attorneys to handle what is needed and also feels that outside City of Delray Beach Page 1 Printed on 12/13/2018 City Commission Minutes - Final November 13, 2018 counsel can be utilized when necessary. Mayor Petrolia expressed concern over the duration of time that Ms. Gelin is willing to fill the role as Interim City Attorney. Lynn Gelin, Deputy City Attorney gave a few brief comments. Mayor Petrolia gave a few brief comments. At this point, Mayor Petrolia invited the following attorneys to present their proposals: Matthew Mandel, Attorney with Weiss Serota, et al, stated he was contacted by the City Manager to submit Weiss Serota's proposal. John Herin, Attorney with Gray Robinson, stated he too was contacted by the City Manager to present Gray Robinson's proposal. Commissioner Boylston made a motion to appoint Lynn Gelin as Interim City Attorney. It was seconded by Vice Mayor Frankel. A roll call vote was taken and all were in favor. The motion carried 5-0.
