Public Hearing - Ordinance No. 07-2023, repealing Ordinance No. 11-2018, Chapter 96-Improvements-Article II-Design and Construction Standards of Improvements-Section 96-34-Water and Sewer, (c) Sewer Facilities; By creating a new Subsection (C) 7-Relating to Sewer Connection; Repealing New Subsection (C) 7-Relating to Sewer Connection. - City Manager (386) 878-8858. Strategic Goal: Infrastructure Background: Ordinance No. 07-2023 is being presented to repeal Ordinance No. 11-2018 which amended provisions of Chapter 96 - Improvements and to include a provision which allows existing residential customers to voluntary connect to the City of Deltona sewer system, if the customer so desires and if such sewer service is available, but does not under any circumstance force an existing residential customer to connect to the City of Deltona’s sewer system. Resolution No. 2023-02 - Variance request to allow the development of a Single-Family Dwelling on an existing 50-foot wide lot with an area of ±5,000 square feet within the R1, Single-Family Zoning District located at 3602 Apple Orchard Drive. - Joseph Ruiz, Planning & Development Services Interim Director Strategic Goal: N/A Background: The applicant desires to develop the property located at 3602 Apple Orchard Drive with a single-family residence. The property is zoned R1, Single-Family Zoning District and surrounded by developed Deltona Lakes lots. This parcel consists of two (2) 25-foot wide lots, which are a product of an antiquated plat, filed on February 16, 1925, known as the City of Deltona Page 2 Printed on 4/17/2023 City Commission Regular Commission Meeting April 17, 2023 Carnell plat (Map Book 22, Pages 93-96). This property has a total width of ±50 feet and an area of ±5,000 square feet, as the typical Carnell Plat lots were 25 feet by 100 feet (2,500 square feet). On June 2, 1966, Unit 62 of the Deltona Lakes plat was filed (Map Book 28, Pages 95-99). However, this plat excluded the subject property and many other lots remaining within the Carnell Plat. The applicant is requesting a variance to waive the minimum lot size requirements stipulated within Section 110-307 - R1, Single-Family Classification of the City’s Land Development Code. The variance from the R1 minimum lot size standards would allow the applicant to develop a single-family residence on a non-conforming, but viable lot. Despite the lot size non-conformity, the applicant demonstrated, per the attached documents, that a single-family residence could be constructed to meet the minimum yard size and building requirements. At the March 15, 2023, the Planning and Zoning Board recommended the City Commission deny Resolution No. 2023-02 on a 6-1 vote, the variance application for 3602 Apple Orchard Drive. CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine and non-controversial. If discussion is desired by any member of the City Commission, that item must be removed from the Consent Agenda and considered separately. All other matters included under the Consent Agenda will be approved by one motion. Citizens with concerns should address those concerns by filling out a public participation slip and giving it to the Deputy City Clerk prior to Consent Agenda items being pulled. A. Request for approval of the proposed contract between the City of Deltona and Axis Infrastructure - Proposal for public scoping regarding land planning and development matters - RFP #23003 - Joseph Ruiz, Planning and Development Services Interim Director (386) 878-8624. Strategic Goal: Community Development and Redevelopment Background: On June 20, 2022, the City Commission adopted Ordinance No. 12-2022 (temporary moratorium on requests to increase density entitlements for detached single-family development projects). The moratorium was to allow for community outreach regarding growth and development. The moratorium expired on March 31, 2023. In preparation for the moratorium, City staff on May 31, 2022, initiated a request for proposal (RFP) process to solicit proposals from planning firms to assist in the public scoping process. The first RFP was issued for approximately one month. After the RFP was due, the City received no formal responses to the first RFP #22039. The City extended the RFP until July 19, 2022. The RFP extension generated one formal response. After review, the firm that responded to the RFP was determined to be marginally qualified. In addition, the price for services ($412,020.00) was out of budget. Planning and Development staff was able to essentially recruit a firm through a piggy-back arrangement with another local government. The firm, Axis Infrastructure, generated a draft scope of work in August of 2022. City staff reviewed the scope and worked with the consultant to update and finalize the scope of work. The scope of work was finally City of Deltona Page 4 Printed on 4/17/2023 City Commission Regular Commission Meeting April 17, 2023 updated on September 7, 2022. The total price was $189,050.00. As a point of reference, the other firm that responded to the RFP #22039 quoted $412,020.00; $222,970.00 more than what Axis Infrastructure quoted. Axis’ initial proposal was discussed at the City Commission Workshop dated September 26, 2022. The City Commission directed staff to move forward with engaging the community, gathering the information the City needs to start the process, and to come back to the Commission to determine whether Axis Infrastructure will participate. On September 28, 2022, Hurricane Ian hit Florida (City Hall closed 9/28, 9/29, and 9/30/22). Following the impact of Hurricane Ian, Tropical Storm Nicole then hit Florida on November 9, 2022 (City Hall closed from 11/9 through 11/11/2022). The community input on growth management issues was put on hold in order to respond to the natural disasters. On January 6, 2023, the RFP #23003 was posted with due date of January 25, 2023. The City received one (1) formal response to this RFP. The company that responded to RFP #23003 was Axis Infrastructure. The City extended the RFP #23003 for 30 days, until February 27, 2023. The RFP extension generated one formal response. Again, the company that responded to this RFP was Axis Infrastructure. The Axis Infrastructure public interface process is proposed to take about 16 months. The scoping process includes the following steps: I. Current City Data Analysis II. Public Engagement and Outreach III. Compilation and Analysis of Input IV. Draft Report and Analysis V. Final Report and Recommendations VI. Reimbursables These steps are described in detail within the attached Scope of Services and Fee Schedule for the RFP #23003. Total Fees: $197,465.00 The City Manager has the authority to make corrections of scrivener’s errors and the like. Request approval of the Task Authorization with Mead & Hunt for the Deltona Lakes/Fisher WRF Planning Analysis, in accordance with their agreement with the City of Deltona Utility Plant Engineering Services RFQ PW-2020-10, in the amount of $82,567.00 - Glenn Whitcomb, Public Works/Deltona Water (386) 878-8929. Strategic Goal: Infrastructure Background: The purpose of this project is to provide an analysis of four alternatives for the Deltona Lakes/Fisher WRF. Alternative 1 - Rehab Deltona Lakes/Fisher WRF. Alternative 2 - Convert DLWRF to a Master Lift Station, which would then pump to the Eastern WRF. Alternative 3 - Convert DLWRF to a Master Lift Station, which would then pump to the Volusia County’s Southwest Regional WRF. Alternative 4 - Convert DLWRF to a master Lift Station, which would then pump to both EWRF and Volusia County’s Southwest Regional WRF. The alternatives will be scored and ranked based on criteria that the City of Deltona will provide to the consultant. Mead & Hunt will analyze the four alternatives, develop conceptual improvements, perform hydraulic calculations to properly size pumps and force mains, propose conceptual routes for the force mains. The consultant will also score, rank and provide cost estimates on the four alternatives. Approval of this item authorizes the necessary budget transfers to facilitate Commission approval and further authorizes the City Manager to sign any documents necessary to further Commission approval of this item. Request approval to authorize issuance of a Purchase Order to Whitehouse Masonry to install, repair or replace sidewalk throughout the City for FY 22/23 in the amount of $250,000. The City has a current contract with Whitehouse Masonry as executed on November 8, 2021 and remains valid until November 2023 - Glenn Whitcomb, Public Works/Deltona Water (386) 878-8929. Installation locations are consistent with City Commission directive to provide connection between existing sidewalks missing links as well as looking at areas that would benefit from enhanced sidewalk widths or adjustments. Approval of this item authorizes the necessary budget transfers to facilitate Commission approval and further authorizes the City Manager to sign any documents necessary to further Commission approval of this item. Strategic Goal: Infrastructure Background: The need for this contract is to resume milling & resurfacing the roadways throughout the City, focusing on those roadways will a Pavement Condition Index below 50. This contract does not provide for permanent pavement markings upon completion of the milling & resurfacing and requisite 30-day curing period, therefore there is a supplemental request to utilize Fausnight Stripe & Line, Inc. contract with Seminole County for this final step of milling & resurfacing. Approval of this item authorizes the necessary budget transfers to facilitate Commission approval and further authorizes the City Manager to sign any documents necessary to further Commission approval of this item. Request for approval to contract with CivicPlus for City website redesign. - Catherine Barker, Public Information Office (PIO), (386)878-8755 Strategic Goal: Accurate, Timely and Identifying Communication Background: City Commission approved the FY 2022/2023 budget which included a website redesign at a cost of $130,000. After negotiations CivicPlus drastically lowered the price for the redesign saving the City approximately $75,000. This contract will be a piggyback off of the Jacksonville Beach contract which is attached. CivicPlus is our current website provider and specializes in government websites making for a smoother transition. The last redesign for the City’s website was in 2018.
